The People's Government of Xuzhou Municipality, Jiangsu Province (hereinafter referred to as Xuzhou Municipal Government) accepted the application filed by Cao Chunfang, a third person, for administrative reconsideration on October 28, 2003, and made the No. 24 [2004] administrative reconsideration decision on April 29, 2004. The decision confirmed in accordance with Sub-items (a) and (e) of Item (3) of Paragraph 1 of Article 28 of the “Administrative Reconsideration Law of the People's Republic of China” that the specific administrative conduct of the former Xuzhou Municipal Real Estate Administrative Bureau (hereinafter referred to as Xuzhou Real Estate Bureau) of entitling the house properties at No. 31 Min'an Lane and the right to use the involved state-owned land to Zhang Chengyin was illegal on the grounds including: (1) when Cao Chenshi, the user of the house properties at No. 31 Min'an Lane of Xuzhou died in 1986, Zhang Chengyin was not the lawful inheritor of the house properties; (2) Zhang Chengyin's original acquisition of the title of the house properties at No. 31 Min'an Lane, which was ascertained by Xuzhou Real Estate Bureau, did not conform to the facts, and Xuzhou Real Estate Bureau's issuance of the No. 1741 house ownership certificate to Zhang Chengyin violated Article 8 of the “Interim Measures for the Registration of Urban House Ownership”; and (3) it was inappropriate to entitle the house properties at No. 31 Min'an Lane and the right to use the involved state-owned land to Zhang Chengyin. Zhang Chengyin was dissatisfied with the reconsideration decision, and brought an administrative lawsuit to the Intermediate People's Court of Xuzhou Municipality, Jiangsu Province (hereinafter referred to as Xuzhou Intermediate Court).@#

被告江苏省徐州市人民政府2003年10月28日受理了第三人曹春芳的行政复议申请,于2004年4月29日作出徐政行决[2004]24号行政复议决定,以徐州市民安巷31号房屋使用者曹陈氏1986年死亡时,张成银不是该房产的合法继承人,原徐州市房地产管理局(以下简称房管局)认定张成银对民安巷31号房屋产权属原始取得与事实不符,为张成银颁发鼓房字第1741号房屋所有权证违反了《城镇房屋所有权登记暂行办法》第八条的规定,将民安巷31号房屋产权和国有土地使用权确权给张成银不当等为由,依据《中华人民共和国行政复议法》第二十八条第一款第(三)项第1目、第5目之规定,确认徐州市房地产管理局将民安巷31号房屋产权及国有土地使用权确权给张成银的具体行政行为违法。张成银不服该复议决定,向江苏省徐州市中级人民法院提起行政诉讼。@#
原告诉称:原徐州市房地产管理局向其颁发《房屋所有权证》是1988年,曹春芳申请行政复议的时间是2004年,已超过法定的申请行政复议的期限,复议机关受理无据;徐州市人民政府作为行政复议机关,认定曹陈氏死亡时,曹春芳和曹春义依法有权继承诉争房产,其本人不是该房屋的合法继承人,超出了职权范围;复议决定对于曹陈氏死亡时遗留多少房产未有认定,事实不清。请求撤销徐州市人民政府作出的徐政行决[2004]24号行政复议决定。@#

被告辩称:市政府曾多次电话通知张成银参加复议,但均遭拒绝,故应认定其放弃权利;曹春芳过去一直不知道张成银在1988年办理了民安巷31号房屋的《房屋所有权证》,故未超过申请复议期限;徐州市民安巷31号房屋使用者曹陈氏1986年死亡时,曹春芳、曹春义依法有权继承该处房产,张成银不是该房产的合法继承人,不应成为该房产的所有权人,原徐州市房地产管理局却认定张成银对民安巷31号房屋产权属原始取得,错误地将上述房产登记到张成银名下,违反了《城镇房屋所有权登记暂行办法》第八条规定,属确权不当;徐政行决[2004]24号行政复议决定认定事实清楚,适用依据正确。@#
