| | 再审申请人德泰公司向本院申请再审称：本案符合《中华人民共和国民事诉讼法》第二百条第二项、第六项的规定，请求对本案依法再审。理由如下：（一）原判决认定的基本事实缺乏证据证明。根据辽宁省高级人民法院作出的（2010）辽民二终字第96号民事判决可以确认农行南京三元巷支行、广发银行南京白下支行均不享有票据权利；德泰公司与大疆公司之间存在真实的买卖关系，大疆公司认可其将诉争票据交给了德泰公司，德泰公司与大疆公司于2009年7月2日签订的协议书载明，大疆公司用辽河勘探局开具的330万承兑汇票支付货款。因此，德泰公司是诉争票据的权利人。（二）原判决适用法律确有错误。德泰公司以“票据损害责任纠纷”提起诉讼，本案应当紧紧围绕各方当事人的行为在票据法律关系中的定性展开，而原判决并没有适用符合本案性质的法律条文。（2010）辽民二终字第96号民事判决确认广发银行南京白下支行不享有票据权利，根据《中华人民共和国票据法》第五十七条第二款以及《最高人民法院关于审理票据纠纷案件若干问题的规定》第六十九条之规定，如果广发银行南京白下支行因重大过失遭受了损失，应当自行承担或者向伪造者、变造者依法追偿损失。然而，广发银行南京白下支行并未依照法律规定承担责任或行使追偿权利，而是通过串通农行南京三元巷支行兑付了涉案票据，故应认定广发银行南京白下支行和农行南京三元巷支行的行为侵犯了德泰公司的合法权益。 |
