The aforementioned defendants reside in Menjia Alley, Xi'an City, Shaanxi Province.@#
The plaintiffs, Xie Donghui and Zheng Zhaoben, filed a lawsuit against Chen Shijun, Chen Xiuying, Chen Ruiyu and Chen Shizhong for disputes over inheritance with the People's Court of Beilin District, Xi'an City, Shanxi Province.@#
The plaintiffs, Xie Donghui, Zheng Zhaoben, claimed that, their daughter, Zheng Ping, made acquaintance of the defendants' younger brother, Chen Shijie, via a friend's introduction in 1985, and they soon fell in affectionate love with each other. Zheng Ping cohabitated with and helped Chen Shijie with family chores from January 1987 to April 11, 1989 when the two persons were killed. Thus the two persons had formed factual relationship of man and wife. During that period, the two persons worked together, purchased color-TV sets, a refrigerator, a tape recorder, a video recorder, a washing machine and other daily commodities. The plaintiffs then made a request to the court for inheritance of their daughter's inheritance. @#

原告谢东辉、郑兆本为与被告陈世军、陈秀英、陈瑞玉、陈世忠继承纠纷一案,向陕西省西安市碑林区人民法院提起诉讼。@#
原告谢东辉、郑兆本诉称,女儿郑萍1985年经朋友介绍与被告之弟陈世杰相识,不久相爱,感情很好。郑萍从1987年1月起就帮助陈世杰料理家务并同居,至1989年4月11日2人被害死亡,已形成事实上的夫妻关系。在此期间,两人共同劳动,先后购置了彩电、冰箱、录音机、录象机、洗衣机等日常生活用品。请求法院判令原告依法继承女儿郑萍的遗产。@#
被告陈世军、陈秀英、陈瑞玉、陈世忠辩称,原告之女与其弟陈世杰生前未进行结婚登记,不是合法的夫妻关系,其同居是非法的。现2人不幸被害死亡,所遗财产是陈世杰的个人财产,不属夫妻共同财产。陈世杰的遗产原告无权继承。@#
碑林区人民法院经公开审理查明:原告谢东辉、郑兆本分别系被继承人郑萍的父母。被告陈世军、陈秀英、陈瑞玉、陈世忠分别系被继承人陈世杰的兄姐。郑萍、陈世杰从1987年1月起,即以夫妻名义公开同居生活,并购置生活用具。上述事实,有证人证言、陈世杰生前信件等书证证明。1989年4月11日夜,郑萍、陈世杰在家中被害死亡。郑萍、陈世杰死亡后,遗有存款及现金12810元,债权1万元,彩电2台,冰箱、洗衣机、收录机、电视投影机、电风扇各1台,金项链1条及家具、生活日用品等。以上遗产,经西安市公安局核查后,由被告保管。@#
还查明,郑萍生前系西安市硅酸盐制品厂车间会计,1964年4月20日出生,与陈世杰同居生活时已年满23周岁,无配偶。陈世杰生前系个体工商户,1961年6月22日出生,与郑萍同居生活时已年满26周岁,无配偶。郑萍与陈世杰共同生活期间,未生育子女。陈世杰的父亲陈先民、母亲吴兰花已分别于1977年、1982年去世。@#
碑林区人民法院认为:最高人民法院《关于人民法院审理未办结婚登记而以夫妻名义同居生活案件的若干意见》第二条规定,1986年3月15日《婚姻登记办法》施行之后,未办结婚登记手续即以夫妻名义同居生活,如同居时双方均符合结婚的法定条件,可认定为事实婚姻。郑萍与陈世杰未进行结婚登记即以夫妻名义同居生活已达两年之久,且符合结婚的法定条件,其婚姻关系应认定为事实婚姻。根据上述规定,郑萍、陈世杰在同居期间的财产,应视为夫妻共同财产。原告谢东辉、郑兆本系被继承人郑萍的继承人,依照《中华人民共和国继承法》第十条第一款的规定,有权继承郑萍的那部分遗产。被继承人陈世杰的父母均已死亡,无子女,依照上述规定,其遗产应由第二顺序继承人陈世军、陈秀英、陈瑞玉、陈世忠继承。被告陈世军、陈秀英、陈瑞玉、陈世忠辩称,郑萍、陈世杰家中财产全部属陈世杰个人所有,证据不足,不予认定。郑萍与陈世杰同居生活时间短,共同财产中较多系其与郑萍同居前所有,故其继承人应适当多分。据此,1989年11月27日,西安市碑林区人民法院判决:@#
