According to the provisions of Article 32 of the Law of the People's Republic of China on City Planning (hereinafter referred to as the City Planning Law), Beijing Municipal Commission of Urban Planning (hereinafter referred to as the Commission), issued, on December 10, 2001, a Construction Project Planning License No. 1769 (2001) to a third party, the former Institute of Food Safety Control and Inspection under the Ministry of Health (which was amalgamated with other entities into the Institute of Nutrition and Food Safety, Chinese Center for Disease Control and Prevention, hereinafter referred to as the Food Safety Institute) as well as a third party, the former Institute of Environmental Health Monitoring, Chinese Academy of Preventive Medicine, hereinafter referred to as the Health Safety Institute), permitting both the third parties to build a Grade II Animal Laboratory in No. 7, Panjiayuan Nanli, Chaoyang District. The plaintiffs were dissatisfied with the issuance of the Construction Project Planning License and thus filed an administrative action with the People's Court of Xicheng District, Beijing Municipality.@#

北京市规划委员会(以下简称规划委员会)根据《中华人民共和国城市规划法》(以下简称城市规划法)第三十二条之规定,于2001年12月10日向第三人原卫生部卫生监督检验所(已与其他单位合并为中国疾病预防控制中心营养与食品安全所,以下简称食品安全所)、第三人原中国预防医学科学院环境卫生监测所(已与其他单位合并为中国疾病预防控制中心环境与健康相关产品安全所,以下简称健康安全所)颁发了2001规建字1769号《建设工程规划许可证》,许可第三人在朝阳区潘家园南里7号建设二级动物实验室。原告不服该《建设工程规划许可证》,向北京市西城区人民法院提起行政诉讼。@#
原告诉称:我们均系北京市朝阳区潘家园南里4号楼和6号楼的居民,与第三人的住所地仅隔一条马路。被告规划委员会就动物实验室建设项目向第三人食品安全所和健康安全所核发的《建设工程规划许可证》,违反法定程序,不符合法律规定的精神。建设污染环境的项目,必须遵守国家有关建设项目环境保护管理的规定。建设项目的环境影响报告书,必须对建设项目产生污染和环境作出评价,规定防治措施,经项目主管部门预审并依照规定的程序报环境保护行政主管部门批准。环境影响报告书经批准后,计划部门方可批准建设项目设计任务书。但规划委员会于2000年9月11日就核定了《审定设计方案通知书》,确定了本项目的可行性研究结论。而本案的第三人却在2000年12月7日才就动物实验室建设项目向北京环境保护局(以下简称环保局)申请办理环保审批,2002年2月21日环保局才给予确定批复。由于本项目在可行性研究阶段并未进行环境影响评估,被告的审批行为显然不符合法律规定。本案中被告核准的动物实验室工程设计方案中,实验室与原告的住宅楼之间的距离为19.09米,不符合GB14925—2001号国家标准中关于实验动物繁育、生产、试验设施应与生活区保持大于50米距离的规定。另外,卫生部颁布施行的《卫生系统实验动物管理暂行条例》规定,具有一定规模的实验动物室建筑,周围至少应有20米的卫生隔离区,而原告住宅楼与该动物实验室之间是马路,显然不符合卫生隔离区的概念。本案中承担建设项目环境评价任务的中国预防医学科学院环境卫生与卫生工程研究所虽具有一定资质,但因与第三人同属中国预防医学科学院的下属单位,所作的环境影响评价难免有失公正。请求法院撤销被告为第三人颁发的《建设工程规划许可证》。@#
原告提交的证据有:@#
1.有关动物实验室照片15张。以证明第三人现在已有的动物实验室对周围居民环境有影响,并发生过冲突的事实。@#
2.调查笔录2份:其一为侯树森等5人的笔录,其二为贾彦君的笔录。以证明第三人现有的动物实验室对周围环境有影响,以及为建设动物实验室,建设单位与周围居民发生过冲突的事实。@#
被告辩称:我委核发《建设工程规划许可证》是依法履行法定职责,本案的建设项目建设单位曾组织专家就此进行过论证并报行业主管部门审批。卫生部于2000年1月作出批复,同意第三人在朝阳区潘家园7号院内建设清洁级动物实验室。北京市城乡建设委员会于2001年11月下达了建设项目施工计划通知书。据此,我委于2001年12月给第三人核发了《建设工程规划许可证》。关于本案审批项目的环保问题,除我委核发规划许可证前卫生部已有相关批复外,核发该规划许可证后,环保局亦于2002年2月对该建设项目核发了《关于卫生部食品卫生检验所动物房项目环境影响报告表的批复》,上述情况说明该项目通过了相关专业管理部门的批准。目前的规划审批程序并未将环保部门的意见作为前置条件,原告提出该项目应当先经环保部门同意后方可核发《建设工程规划许可证》的说法无法律依据。另外,我委在审批该建设项目时,有关国家标准尚未正式实施,故不适用本案。@#
