The plaintiff Jianming Food Co., Ltd., Sihong County, Jiangsu Province (hereinafter referred to as Jianming Company) held that the telephone instruction of the deputy county chief -in-charge of the defendant the People's Government of Sihong County, Jiangsu Province (hereinafter referred to as Sihong Government) infringed upon its legitimate rights and interests, thus brought an administrative action on April 21st, 2005. The Intermediate People's Court of Suqian City, Jiangsu Province held that the Veterinary Safety Control and Inspection Station of Sihong County, Jiangsu Province (hereinafter referred to as Vet Inspection Station) had relationship of interests with the administrative suit, thus informed it to participate in the suit as a third party in accordance with the provision of Article 27 of the Administrative Procedure Law of the People's Republic of China (hereinafter referred to as Administrative Procedure Law).@#
The plaintiff alleged that: it is a live pigs slaughter entity established upon the approval of the defendant. The live pigs shall, before and after being slaughtered, be quarantined and inspected by the third party according to law. On May 22nd, 2003, the deputy county chief-in-charge of the defendant instructed through telephone the third party to stop quarantining its live pigs, which made it impossible for it to slaughter and sell the live pigs on the market and it was forced to wind up the business. Thus the plaintiff pleaded with the court to confirm that the telephone instruction of the deputy county chief-in-charge of the defendant was illegal.@#

审查行政机关内部上级对下级作出的指示是否属于人民法院行政诉讼受案范围内的可诉行政行为,应当从指示内容是否对公民、法人或者其他组织权利义务产生了实际影响着手。在行政管理过程中,上级以行政命令形式对下级作出的指示,如果产生了直接的、外部的法律效果,当事人不服提起行政诉讼的,人民法院应当受理。@#

原告江苏省泗洪县建明食品有限责任公司(以下简称建明食品公司)认为被告江苏省泗洪县人民政府(以下简称泗洪县政府)分管副县长的电话指示侵犯其合法权益,于2005年4月21日提起行政诉讼。江苏省宿迁市中级人民法院认为,江苏省泗洪县兽医卫生监督检验所(以下简称县兽检所)同提起的行政诉讼有利害关系,依照《中华人民共和国行政诉讼法》(以下简称行政诉讼法)第二十七条规定,通知其作为第三人参加诉讼。@#
原告诉称:原告是经被告批准设立的生猪定点屠宰单位。原告的生猪被屠宰前后,依法应由第三人进行检疫、检验。2003年5月22日,被告的分管副县长电话指示第三人停止对原告的生猪进行检疫,致使原告的生猪无法屠宰和上市销售,被迫停业。请求确认被告分管副县长的电话指示违法。@#
原告提交以下证据:@#
1.企业法人营业执照、卫生许可证、动物防疫合格证、税务登记证及中华人民共和国组织机构代码证,用以证明建明食品公司是依法经批准设立的生猪定点屠宰单位,经营手续完备;@#
2.《关于加强县城生猪屠宰管理的通知》(以下简称《屠宰管理通知》)、宿迁市中级人民法院的(2004)宿中行初字第06号行政判决书,用以证明由于泗洪县政府下设的泗洪县生猪管理办公室(以下简称县生猪办)在2003年5月18日发布的《屠宰管理通知》中,仅将该县生猪定点屠宰单位标注为泗洪县食品公司肉联厂(以下简称县肉联厂),被建明食品公司诉至法院后,该具体行政行为已被生效判决确认为违法;@#
3.县兽检所和泗洪县青阳镇畜牧兽医站出具的证据,用以证明泗洪县分管副县长2003年5月22日的电话指示事实客观存在。@#
被告辩称:被告的分管副县长是根据2003年5月18日的《屠宰管理通知》,才作出内容为“停止对县肉联厂以外的单位进行生猪检疫”的电话指示。这个电话指示是分管副县长对下属单位县兽检所作出的,是行政机关内部的行政指导行为;指示内容中没有提到原告,不会直接对原告的权利义务产生影响。因此,这个电话指示不是人民法院行政诉讼管辖的具体行政行为,不在人民法院行政诉讼受案范围内,原告无权对这个电话指示提起行政诉讼。@#
第三人述称:国务院颁布的《生猪屠宰管理条例》规定,被告有权设定和取消生猪定点屠宰单位。在被告下设的县生猪办发布的《屠宰管理通知》里,生猪定点屠宰单位中没有原告,说明原告的生猪定点屠宰资格已经被取消。非定点屠宰单位的生猪,依法不能上市销售,故第三人拒绝对原告的生猪进行检疫,是正确的。@#

经质证、认证,宿迁市中级人民法院查明:@#
2001年4月,经被告泗洪县政府批准,原告建明食品公司成为泗洪县的生猪定点屠宰单位之一。在分别领取了相关部门颁发的企业法人营业执照、动物防疫合格证、税务登记证等证件后,建明食品公司开始经营生猪养殖、收购、屠宰、销售和深加工等业务。2003年5月18日,泗洪县政府下设的临时办事机构县生猪办向本县各宾馆、饭店、学校食堂、集体伙食单位、肉食品经营单位以及个体经营户发出《屠宰管理通知》。该通知第一项称,“县城所有经营肉食品的单位及个体户,从5月20日起到县指定的生猪定点屠宰厂采购生猪产品,个体猪肉经销户一律到定点屠宰厂屠宰生猪(县肉联厂)……”。2003年5月22日,泗洪县政府分管兽医卫生监督检验工作的副县长电话指示县兽检所,停止对县肉联厂以外的单位进行生猪检疫。建明食品公司报请县兽检所对其生猪进行检疫时,该所即以分管副县长有指示为由拒绝。建明食品公司认为,分管副县长的电话指示侵犯其合法权益,遂提起本案行政诉讼。@#
另查明,原告建明食品公司因对县生猪办在《屠宰管理通知》中仅标注县肉联厂为生猪定点屠宰厂不服,曾于2004年8月4日以泗洪县政府为被告,另案提起过行政诉讼。宿迁市中级人民法院的(2004)宿中行初字第06号行政判决书确认,泗洪县政府下设的县生猪办在《屠宰管理通知》中仅将县肉联厂标注为生猪定点屠宰厂,侵犯了建明食品公司的公平竞争权,这一行政行为违法。该行政判决已发生法律效力。@#
