原告叶兆言创作的中篇小说《马文的战争》获得《小说月报》第10届百花奖。2006年7月21日，原告将该中篇小说的电视改编拍摄权许可给北京玫瑰影视广告有限公司（以下简称玫瑰影视公司），但约定“不承诺乙方（玫瑰影视公司）或乙方聘请的编剧以含电视小说和电视剧本在内的任何文字形式出版根据小说《马文的战争》改编的文字作品”。@#
被告陈彤系电视剧《马文的战争》的编剧，2006年9月1日，玫瑰影视公司（甲方）和陈彤（乙方）签订《合同书》，双方约定：甲方按每集15000元，共计300000元，邀请乙方作为二十集电视连续剧《马文的战争》的编剧；《马文的战争》的电视剧版权以及与电视有关的一切音像制品版权归甲方拥有，乙方只享有编剧署名权，但电视剧《马文的战争》的剧本版权及文字版权归乙方自然拥有。2007年10月19日，深圳市深广传媒有限公司（以下简称深广传媒公司）与陈彤签订《协议书》，约定玫瑰影视公司已将其合法拥有的由陈彤作为编剧的二十集电视连续剧《马文的战争》的剧本版权等相关权益全权转让给深广传媒公司用以抵偿欠款，深广传媒公司从2007年10月1日起全权独家享有由陈彤作为编剧的二十集电视连续剧《马文的战争》的剧本版权以及与电视有关的一切音像制品版权，陈彤享有剧本著作权及独立署名权。@#
