THE CASE OF ZHANG CHANGSHENG AND YE ZHIFENG BETRAYING IMPORTANT STATE SECRETS AND ACCEPTING BRIBERY@#

Defendant, Zhang Changsheng, male, aged 31, former official of Chinese Minority Nationalities Economic and Cultural Development Corporation, arrested on Oct. 30, 1985.@#
Defendant, Ye Zhifeng, female, aged 40, former director of of Technology and Trade combination Department of the Import and Export Bureau of State Economic Committee, arrested on Nov. 28, 1985.@#
The defendant Ye Zhifeng has collaborated with Zhang Changsheng in a series of jointly designed criminal activities since they got acquainted with each other in November 1984. From November 1984 and April 1985, Ye Zhifeng repeatedly and voluntarily divulged through Zhong Changcheng to foreign businessmen and businessmen from HongKong important secrets on state exclusive importing of automobiles as well as secrets concerning negotiations on the importing of automobiles with foreign businessmen and businessmen from HongKong by virtue of her office as person in charge of the state exclusive importing of automobiles. During the negotiations between relevant Chinese companies and foreign businessmen on the importing of automobiles, Ye Zhifeng took advantage of her position to impose pressure on those Chinese companies and ordered them accept the prices offered by foreign businessmen and sign contracts within the shortest time. Zhang Changsheng frequently master minded schemes to foreign businessmen and businessmen from Hongkong when she learned that there would be changes with the state policy on the importing of automobiles, Ye Zhifeng hinted the dates of contracts through Zhang Changsheng to businessmen from Hongkong and the relevant Chinese Companies that they could cheat the relevant state departments by means of moving backward. During this period, Zhang demanded and accepted 1,988,000 HK dollars and $2,000 of bribes as well as two Hitachi videocorders and a camera. Out of those bribes, Ye Zhifeng got 25,000 HK dollars, 7,000 yuan RMB, and a "Hitachi" videocorder. Besides, Ye Zhifeng got an air-conditioner, an electric alarm clock and other utensils directly from HK businessmen.@#

张常胜、叶之枫泄露国家重要机密、收受贿赂案@#

被告人：张常胜，男，三十一岁，原系中国少数民族经济文化开发总公司职员。一九八五年十月三十日被逮捕。@#
被告人：叶之枫，女，四十岁，原系国家经济委员会进出口局技贸结合处副处长，一九八五年十一月二十八日被逮捕。@#
被告人叶之枫于一九八四年十一月与张常胜相识后，即互相勾结，合谋进行犯罪活动。一九八四年十一月至一九八五年四月，叶之枫利用主管国家专项进口汽车的职务之便，多次主动地将国家专项进口汽车的重要机密及与外商、港商谈判进口汽车的重要机密，通过张常胜分别泄露给外商和港商。在我国有关公司与外商谈判进口汽车时，叶之枫利用职权施加压力，要我国有关公司接受某外商提出的价格，并从速签订合同。张常胜多次为外商、港商出谋划策。叶之枫在得知国家关于进口汽车将有变动的情况后，通过张常胜示意港商及我国有关公司，采取倒签合同日期等手段，欺骗国家主管部门。在此期间，张常胜先后索取、收受外商、港商贿赂港币一百九十八万八千元、美元二千元、“日立”录像机二台和照像机一架。叶之枫分得港币二万五千元、人民币七千元、“日立”录像机一台。叶之枫还直接收受港商贿赂冷暖风机一台，电予闹钟一个等物品。@#
叶之枫还利用职务之便，于一九八四年十一月至一九八五年十一月间，在为深圳中华汽车公司、重庆长安机器制造厂等单位办理进口汽车散件审批手续和购买北京“２１２”型吉普车的过程中，先后收受贿赂港币五千元、人民币三千元、“东芝”彩色电视机一台。@#
此外，张常胜自一九七九年以来，长期私藏手枪一支、子弹五发。@#
综上，张常胜收受贿赂款及物品，共折合人民币七十一万一千一百余元，部分赃款、赃物已查获。叶之枫收受贿赂及物品，共折合人民币二万五千三百余元，赃款、赃物已全部查获。@#
被告人张常胜、叶之枫的上述罪行，有证人证言、物证、书证证实，足以认定。@#

北京市中级人民法院受理本案后，依照《中华人民共和国刑事诉讼法》第一百一十条的规定，不公开审理。经审理认为，被告人张常胜和叶之枫合谋并共同实施犯罪行为，属于《中华人民共和国刑法》第二十二条第一款规定的共同故意犯罪。两被告人在共同犯罪中均起主要作用，依照刑法第二十三条第一款的规定，系本案主犯，应当从重处罚。叶之枫身为国家工作人员，违反国家保密法规，与张常胜勾结，泄露国家重要机密；张常胜与叶之枫勾结，积极向外商和港商泄露国家重要机密；两被告人的行为，均构成刑法第一百八十六条第一、二款规定的泄露国家重要机密罪。张常胜、叶之枫收受贿赂，使国家利益遭受严重损失，均已构成刑法第一百八十五条第一、二款规定的收受贿赂罪。鉴于叶之枫收受贿赂数额巨大，张常胜收受贿赂数额特别巨大，且两被告人犯罪情节特别恶劣，危害特别严重，根据全国人大常委会关于《严惩严重破坏经济的罪犯的决定》第一条（二）项的规定，收受贿赂的，比照刑法第一百五十五条贪污罪论处。张常胜私藏枪支、弹药，构成刑法第一百六十三条规定的私藏枪支、张药罪。张常胜、叶之枫均一人犯数罪，依照刑法第六十四条的规定，应当数罪并罚。@#
