Against a decision on home demolition and relocation, No. 169 [2005] DR HLAZS, made by the defendant, Housing and Land Administration of Zhabei District of Shanghai (the “Zhabei Administration”), the plaintiff, Lu Tingzuo, brought an administrative lawsuit in the Zhabei District People's Court of Shanghai.@#
The plaintiff, Lu Tingzuo, claimed that: the plaintiff's father, owning some real estates in such land areas as one at Lane 691 Haining Road, Shanghai, had some disagreements with the defendant, Zhabei Administration, about the ownerships of these real estates, which led to the failure of reaching an agreement on compensations for home demolition and relocation. For this reason, the defendant should be recused and should not make a decision on the disputes over compensations for home demolition and relocation between the plaintiff and the third party, Shanghai Shenghesheng Realty Co., Ltd. (the “Shenghesheng Co.”); the Implementing Rules for the Administration of Urban Home Demolition and Relocation of Shanghai were not legislated by the People's Congress of Shanghai and should not be taken as the legal basis for making the decision on home demolition and relocation; the demolition and relocation company, i.e. the third party, Shenghesheng Co., did not serve the appraisal report of the demolished home on the plaintiff and this appraisal report should not be taken as the factual basis for the decision on home demolition and relocation. The plaintiff requested the court to revoke the decision on home demolition and relocation, No. 169 [2005] DR HLAZS, made by the defendant.@#

陆廷佐诉上海市闸北区房屋土地管理局房屋拆迁行政裁决纠纷案@#
【裁判摘要】
房屋拆迁过程中,被拆迁人、房屋承租人对于被拆房屋评估报告有异议的,有权申请复估。因此,基于正当程序原理,为保护被拆迁人、房屋承租人对被拆房屋评估报告依法申请复估的权利,拆迁人应将被拆房屋评估报告及时送达被拆迁人、房屋承租人。房屋拆迁行政裁决机关在裁决过程中,也应当对被拆房屋评估报告是否送达被拆迁人、房屋承租人的问题予以查明,并确保在裁决作出之前将评估报告送达被拆迁人、房屋承租人。房屋拆迁行政裁决机关未查明该问题即作出房屋拆迁行政裁决,且不能举证证明被拆房屋评估报告已经送达被拆迁人、房屋承租人的,所作房屋拆迁行政裁决属认定事实不清、主要证据不足,且违反法定程序。被拆迁人、房屋承租人诉至人民法院请求撤销该裁决的,人民法院应予支持。@#

原告陆廷佐因不服被告上海市闸北区房屋土地管理局(以下简称闸北房地局)作出的闸房地拆裁字(2005)第169号房屋拆迁裁决,向上海市闸北区人民法院提起行政诉讼。@#
原告陆廷佐诉称:原告之父在上海市海宁路691弄等地块有一批房地产,因产权的归属与被告闸北房地局存在矛盾,导致房屋拆迁补偿达不成协议,故被告应当回避,不应由其对原告与第三人上海圣和圣置业有限公司(以下简称圣和圣公司)之间的拆迁补偿安置争议进行裁决;《上海市城市房屋拆迁管理实施细则》未经上海市人大立法,不能作为房屋拆迁裁决的法律依据;拆迁人、亦即本案第三人圣和圣公司未向原告送达过被拆房屋的评估报告,该评估报告不能作为房屋拆迁裁决的事实证据。要求撤销被告作出的闸房地拆裁字 (2005)第169号房屋拆迁裁决。@#
被告闸北房地局辩称:被告与原告陆廷佐的房屋无法律上的利害关系,故被告有权对第三人圣和圣公司与原告之间的拆迁补偿安置争议作出裁决;被告根据被拆房屋产权证认定涉案被拆房屋的面积,证据充分;涉案被拆房屋的评估报告已经向原告送达,该评估报告可以作为裁决的事实依据。请求维持被诉具体行政行为。@#
第三人圣和圣公司述称:2003年12月25日,第三人向原告陆廷佐家送达了包括涉案被拆房屋评估报告在内的拆迁资料,原告之子陆达在送达回证上签字时擅自将该评估报告从送达资料中划掉。送达时的见证人、上海市闸北区北站街道长春居民委员会工作人员沈美贞、卢莉华出具的情况说明可以证明该评估报告已经向原告送达;同幢二层其他居民的三间房屋结构、层次均优于涉案被拆房屋,但是其评估单价亦均低于同区域已购公房上市交易平均市场单价,故涉案被拆房屋评估报告所确认的评估单价符合事实。被诉房屋拆迁裁决正确,请求维持该房屋拆迁裁决。@#
上海市闸北区人民法院经审理查明:@#
2003年10月30日,第三人圣和圣公司取得拆许字(2003)第18号房屋拆迁许可证,对上海市海宁路691弄所在地块实施拆迁。原告陆廷佐系上海市海宁路691弄22号一层①的产权人,该房建筑面积 12.48平方米,另有一阁楼18.37平方米,合计面积30.85平方米。经上海房地产估价师事务所有限公司评估,评估单价为每平方米人民币3510元。因就拆迁补偿安置问题无法达成协议,2005年5月24日,圣和圣公司向被告闸北房地局提出房屋拆迁裁决申请。闸北房地局于同日受理后,分别于2005年5月26日、6月15日两次主持调解,均因陆廷佐未参加导致无法调解。闸北房地局遂于2005年6月16日作出闸房地拆裁字(2005)第169号房屋拆迁裁决,裁决内容为:1.陆廷佐户(含房屋使用人)自收到裁决书之日起15日内迁出上海市海宁路691弄22号[部位:一层①(另有一阁楼)],迁至上海市月罗路307弄30号 202室;2.陆廷佐应在圣和圣公司交付房屋时一次性支付给圣和圣公司面积标准房屋调换差价款人民币130 059.57元;3.圣和圣公司应根据沪价商(2002)010号文有关规定向陆廷佐支付有关家用设施移装费等费用。@#
另查明,原告陆廷佐的父辈曾将其在上海市海宁路691弄等地的房屋用于出租,1958年该出租的房屋以国家经租形式进行了社会主义改造。@#
认定上述事实的证据有:@#
