The Municipal People's Procuratorate of Wuhan in Hubei Province initiated a public prosecution with the Intermediate People's Court of Wuhan against the defendant, Gui Guangqing, for the case of engaging in speculation and profiteering and accepting bribes. In July 1988, the Ministry of Metallurgy assigned to Wuhan Metallurgy Research Institute a supply contract on nickel plate of 30 tons at the price of 22,100 yuan per ton. After receiving the contract on nickel plate, the defendant, Gui Guangqing, lied to Wuhan Metallurgy Research Institute that, upon the approval of some competent personnel in the Ministry of Metallurgy, 5 tons of the nickel plate had been authorized to Changsha General Electrical Appliance Company, and then he assigned some staff members to go to the consignor to go through the proceedings of changing the contract. As a result, he possessed the 5 tons of the nickel plate. Afterwards, Gui Guangqing scalped 2 tons of the nickel plate to Changsha General Electrical Appliance Company at the price of 82,500 yuan per ton. This Company, according to Gui Guangqing's instruction, paid up the payment for the 5 tons of nickel plate by giving Gui Guangqing 45,000 yuan in cash and remitting the remaining 120,000 yuan to the consignor. After that, Gui Guangqing scalped 3 tons of nickel plate (actually 3.114 tons) to an unemployed man Tao in Tianjin at the price of 115,000 yuan per ton, which made him obtain illegal profits of 358,110 yuan.@#

桂广庆投机倒把、受贿案@#

被告人桂广庆因投机倒把、受贿案，由湖北省武汉市人民检察院向武汉市中级人民法院提起公诉。该院依法组成合议庭，经公开审理查明：@#
１９８８年７月，冶金部分配给武汉冶金研究所３０吨镍板的供货合同，每吨价格人民币２２１００元。被告人桂广庆收到这份镍板合同后，向本所谎称，经冶金部有关人员同意，其中有５吨拨给长沙通用电器公司，并指派工作人员到发货单位办理了合同变更手续，将５吨镍板指标控制在自己手中。之后，桂广庆将其中２吨镍板以每吨８２５００元的价格，倒卖给长沙通用电器公司。该公司按桂广庆的授意，交给桂广庆现金４．５万元，其余１２万元汇往发货单位，将５吨镍板的货款全部付清。此后，桂广庆又将３吨（实为３．１１４吨）镍板，以每吨１１．５万元，倒卖给天津市无业人员陶某某，获取非法收入３５．８１１０万元。@#
１９８８年７月，桂广庆还批准将本所用于生产的５．００４吨镍板，卖给汉川县的周某某等人倒卖。周某某等人就地加价转手倒卖后，获非法收入６万元，桂广庆收受周某某等人的贿赂款１．３万元。案发后，桂广庆将该项受贿款退还给周某某等人。１９８８年１１月２４日，桂广庆慑于法律的威力，主动向武汉市人民检察院投案自首，并退还了全部赃款。@#
上述事实，有书证、证人证言证实，被告人亦供认不讳。@#
武汉市中级人民法院审理认为：被告人桂广庆违反国家有关法律，倒卖国家计划分配物资，非法经营数额５２．３１１０万元，非法获利４０．３１１０万元，其行为已构成《中华人民共和国刑法》第一百一十八条规定的投机倒把罪；桂广庆系国家工作人员，利用职务上的便利，进行投机倒把犯罪活动，依照刑法第一百一十九条的规定，应从重处罚；桂广庆还利用职务上的便利，收受贿赂，已构成刑法第一百八十五条的规定，应从重处罚；桂广庆还利用职务上的便利，收受贿赂，已构成刑法第一百八十五条第一款规定的受贿罪。鉴于桂广庆投机倒把数额特别巨大，情节特别严重，根据全国人大常委会《关于严惩严重破坏经济的罪犯的决定》第一条第一项的规定，应从严惩处。根据桂广庆的受贿数额及情节，依照全国人大常委会《关于惩治贪污罪贿赂罪的补充规定》第五条的规定，应按第二条第（２）项的规定处罚。桂广庆一人犯数罪，依照刑法第六十四条第一款的规定，应当实行数罪并罚。依照刑法第六十条的规定，桂广庆违法所得一切财物，应当予以追缴。根据桂广庆的犯罪事实和情节，依法应当判处死刑。但是，桂广庆在犯罪后，投案自首，全部退清了赃款，认罪态度好，依照刑法第六十三条和最高人民法院，最高人民检察院《关于贪污、受贿、投机倒把等犯罪分子必须在限期内自首担白通告》第七条关于“本通告发布后，正在办理的贪污、受贿、投机倒把等经济犯罪案件，犯罪分子有自首坦白，检举立功情节的，适用本通告第二条的规定”的规定，可以从轻处罚。据此，武汉市中级人民法院于１９８９年８月１９日判决如下：@#
