徐蕾诉中汇房产公司财产所有权纠纷案

 【裁判摘要】
 根据合同法四十一条的规定,承租人和出租人没有协商免除出租人退还押金的义务,出租人以双方签署的由其提供的解除房屋租赁关系格式合同中有“双方再无经济关系”的约定为由,拒绝退还押金,承租人提出异议的,出租人不能免除退还押金的义务。
BASIC FACTS 
Plaintiff: Xu Lei, female, 40 years of age, Employee of the Beijing Liaison Office of Changsha Municipal People's Government of Hunan Province, Living in Chaoyang District, Beijing. 原告:徐蕾,女,40岁,湖南省长沙市人民政府驻京联络处职员,住北京市朝阳区。
Defendant: Beijing Zhonghui Real Estate Agency Co., Ltd., Place of Domicile: Fengtai District, Beijing. 被告:北京中汇信元置地房地产经纪有限公司,住所地:北京市丰台区。
Legal Representative: Zhang Bingxing, General manager of the Company. 法定代表人:张秉兴,该公司总经理。
PROCEDURAL POSTURE 
The plaintiff Xu Lei brought a lawsuit to Beijing Haidian District People's Court against Beijing Zhonghui Real Estate Agency Co., Ltd. (hereinafter referred to as the Zhonghui Real Estate Company) for the dispute over property right. 原告徐蕾因与被告北京中汇信元置地房地产经纪有限公司(以下简称中汇房产公司)发生财产所有权纠纷,向北京市海淀区人民法院提起诉讼。
The plaintiff claimed that: She rented the defendant's house, the defendant collected cash deposit against her. After the tenancy contract was rescinded, the defendant failed to refund her the cash deposit within the agreed one month period. So she petitioned the court to order the defendant to refund her the cash deposit of RMB 1600 Yuan. 原告诉称:因原告承租被告的房屋,被告向原告收取了押金。双方之间的房屋租赁合同解除后,被告不按约定在一个月内退还押金。请求判令被告返还属于原告所有的押金1600元。
The defendant defended that: The rescission agreement concluded by and between the two parties clearly stipulated that, from the day when the agreement was signed, there was not any tenancy relationship and economic relationship between the plaintiff and the defendant any longer. The plaintiff requested for refunding the cash deposit after signing the agreement, which violated the stipulation between them, so the defendant could not agree with the plaintiff's claim. 被告辩称:双方签订的解除协议上明确约定:自签字之日起,原告与被告之间再无任何房屋租赁关系及经济关系。原告在签字之后要求返还押金,违反了双方的这一约定,故不同意其诉讼请求。
...... 北京市海淀区人民法院经审理查明:
 原告徐蕾通过签订北京市房屋租赁承租合同,在北京市海淀区知春东里承租了被告中汇房产公司所有的一居室楼房一套,租期自2003年10月8日至2004年10月7日,月租金为1600元。承租合同第三条第3款约定:甲方(徐蕾)应向乙方(中汇房产公司)支付1600元押金;合同期满后一个月内,乙方应在甲方结清承租期间使用的水、电、煤气、有线电视等费用后,将押金退还给甲方。附件5约定:如甲方中途解除合同,需提前一个月通知乙方,不视作违约,否则视作违约。根据承租合同,徐蕾将1600元押金交付给中汇房产公司。2003年12月5日,徐蕾向中汇房产公司申请退租。2004年1月7日,双方清点了租赁房屋内的物品,填写了物品交割单。同日,徐蕾与中汇房产公司还签订了终止协议一份,约定:自该协议签字之日起,双方再无任何房屋租赁关系及经济关系。
 上述事实,有双方当事人的陈述、北京市房屋租赁承租合同、退租申请、物品交割单、终止协议等证据证实。
 北京市海淀区人民法院认为:
 中华人民共和国合同法》(以下简称合同法)第六十条第一款规定:“当事人应当按照约定全面履行自己的义务。”原告徐蕾与被告中汇房产公司签订的房屋租赁合同及终止协议,是双方当事人的真实意思表示,不违反法律规定,合法有效,双方当事人均应按上述协议履行。在终止协议上,双方已明确约定:自签字之日起,双方再无任何房屋租赁关系及经济关系。徐蕾在签署该协议后,又请求中汇房产公司退还其房屋押金,没有事实根据和法律依据,不予支持。
