PROCEDURAL POSTURE@#
The People's Procuratorate of Kaiyuan District of Xiamen City, Fujian Province instituted a public prosecution in the People's Court of Kaiyuan District against Wu Caiming, Huang Dongliang, Chen Shiyu and Wu Tianshou on charges of smuggling, taking bribes and embezzlement. The People's Court of Kaiyuan District formed a collegial panel according to law, and through an open trial, found that:@#
In January 1985, Wu Caiming, upon introduction by Cai Wenhui, the chairman of the Board of Directors of Hong Kong Wenmao Industrial Ltd., negotiated in Xiamen with Chen Yinglin from Hong Kong Eurasia Industrial Ltd on importing Sanyo VTC-1000 video cassette recorders made early in Japan, and Wenmao Industrial Ltd. charged a commission fee at a rate of 2%. Chen Yinglin told Wu Caiming that because the import of video cassette recorders was restricted in China, they could be transformed into video cassette players for import purpose and then restored to video cassette recorders for sale purpose. At the same time, Chen Yinglin entrusted Wu Caiming to collect the sample machine of Sanyo VTC-1000 video cassette recorder brought from Hong Kong and transformed into “Polaris” video cassette player. In February 1985, Wu Caiming, with the transformed sample machine, in the name of Hong Kong Wenmao Industrial Ltd., negotiated with Huang Dongliang and Chen Shiyu over the import of 1,000 sets of Sanyo VTC-1000 video cassette recorders. During the negotiation, Wu Caiming told Huang Dongliang and Chen Shiyu that after the import of “video players”, technicians sent from Hong Kong should restore them to video cassette recorders for sale purpose. To make illegal profits for their employers, Huang Dongliang and Chen Shiyu even used the original quota of 10,000 sets of imported video cassette players which was granted to Kaiyuan Shopping Center upon application to arrive at an agreement with Wu Caiming on the import of video cassette recorders. Thereafter, Huang Dongliang appointed Wu Tianshou on behalf of Kaiyuan Shopping Center to conclude a contract on ordering 10,000 sets of Sanyo VTC-1000 video cassette recorders (288 U.S. dollars per set and totally 288,000 U.S. dollars) with Wu Caiming on behalf of Hong Kong Wenmao Industrial Ltd. To ensure that after the import of “video cassette players”, they could be delivered as video cassette recorders for sale, Wu Caiming produced a “memorandum” which provided for the responsibilities for sending technicians and providing funds from Hong Kong and restoring them into video cassette recorders for delivery to Kaiyuan Shopping Center, as an annex to the contract. On February 28 of the same year, Kaiyuan Shopping Center opened an irrevocable letter of credit from the Xiamen Branch of Bank of China in favor of Hong Kong Wenmao Industrial Ltd. In mid-April, goods arrived at Xiamen Port, and Kaiyuan Shopping Center declared them to the customs in the name of imported “video cassette players”. Xiamen Customs, when examining them, found that the packing boxes for “video cassette players” had been opened, the “video cassette players” had been repackaged, the logos for the machine parts and components had been altered and the inner circuits had been cut. Upon customs technical authentication, this batch of “video cassette players” were confirmed to be transformed video cassette recorders, and were detained for examination according to law. During the period of customs investigation, Wu Caiming, Huang Dongliang and Chen Shiyu conspired to conceal their acts of smuggling and destroyed the “memorandum”. After the smuggled goods were detained by the customs, Huang Dongliang did not truthfully confess smuggling to the relevant authorities and leaders, but instead on May 2, decided, without authorization, to remit the goods price, 288,000 U.S. dollars, to Hong Kong Eurasia Industrial Ltd. Of this amount, Hong Kong Wenmao Industrial Ltd. deducted 2% as a commission fee. On July 5 of the same year, in accordance with the provision of Article 175 of the Provisional Customs Law of the People's Republic of China, Xiamen Customs decided to confiscate all the smuggled goods at a value of 4,000,000 yuan. Due to the smuggling acts of Wu Caiming, Huang Dongliang and Chen Shiyu, Kaiyuan Shopping Center had suffered severe economic losses.@#

1985年1月,被告人吴才明经香港文贸实业有限公司董事长蔡文惠介绍,与香港欧亚实业有限公司陈应麟在厦门商谈进口日本早期生产的三洋牌VTC-1000型录放像机业务,文贸实业有限公司从中获取2%的佣金。陈应麟告诉吴才明,因国内限制进口录放像机,可改装成放像机进口,然后恢复成录放像机出售。同时,陈应麟委托吴才明为其领取从香港带来改装成“北极星”牌放像机的三洋牌VTC-1000型录放像机的样机。1985年2月,吴才明带着改装后的样机,以香港文贸实业有限公司名义与被告人横栋梁、陈世育洽谈进口1000台三洋牌VTC-1000型录放像机事宜。洽谈中,吴才明告知黄栋梁和陈世育,“放像机”进口后,由香港方面派技术人员来恢复成录放像机出售。黄栋梁、陈世育为本单位牟取非法利润,竟使用开元购物中心原申请获准进口1000台放像机的指标,与吴才明达成进口录放像机的协议。随后,黄栋梁指派被告人吴添寿代表开元购物中心与吴才明代表香港文贸实业有限公司签订了订购1000台日产三洋牌VTC-1000型录放像机合同(每台288美元,总计28.8万美元)。吴才明为保证“放像机”进口后,以录放像机交付出售,出具负责从香港派技术人员和提供资金,恢复成录放像机交付开元购物中心的“备忘录”,作为合同的附件。同年2月28日,开元购物中心从中国银行厦门分行开出不可撤销信用证,给香港文贸实业有限公司。4月中旬,货抵厦门口岸,开元购物中心以进口“放像机”,向海关申报。厦门海关查验时,发现“放像机”的包装箱被拆开重新包装,机零件的标志被涂改和机内线路被切断。经海关技术鉴定,确认该批“放像机”系改装的录放像机,依法予以扣留审查。在海关调查期间,吴才明、黄栋梁、陈世育共谋掩盖走私行为,并销毁了“备忘录”。在走私货物被海关扣留后,黄栋梁不但未向有关部门和领导如实交代走私问题,反而于5月2日擅自决定将货款28.8美元,汇往香港欧亚实业有限公司。香港文贸实业有限公司从中抽取了2%的佣金。同年7月5日,厦门海关依照《中华人民共和国暂行海关法》第一百七十五条的规定,决定将该批价值人民币400万元的走私货物全部予以没收。这样,由于吴才明、黄栋梁、陈世育的走私行为,使开元购物中心遭受严重经济损失。@#
另外, 1984后9月至1985年3月间,黄栋梁、陈世育、吴添寿利用职务之便,在洽谈购销业务活动中,收受港商和国内有关部门贿赂,贪污公款。其中黄栋梁收受他人贿赂人民币1500元、港币2000元、外汇兑换券100元;陈世育收受他人贿赂人民币2000元、港币5500元(其中退还黄栋梁2000元)、外汇兑换券3000元;吴添寿收受他人贿赂人民币1900元、港币4000元(已退还黄栋梁)、外汇兑换券100元。此外,吴添寿于1985年2月,与香港乐华电业有限公司王亚琅洽谈进口500台日产三菱牌冷气抽湿机时,与王亚琅商定每台港币2550元加价30元,共计加价1.5万元港币作为给吴添寿的回扣。因王亚琅没有及时从公司领到款该回扣未付。案发后,王亚琅将港币15万交给了开元购物中心,吴添寿贪污未遂。@#
