Ren Jianguo (Ren), the plaintiff, filed an administrative lawsuit before the Lishi County People's Court of Shangxi Province because he was dissatisfied with the review decision on sustaining the reeducation through labor for one year as made by the Reeducation-through-labor Management Committee under Shanxi Lǚliang Administrative Office (hereinafter referred to as Lǚliang Reeducation-through-labor Committee).@#
Ren complained that: after he has an entanglement with the mine director Zhang Fubao (Zhang), Lǚliang Reeducation-through-labor Committee was biased and exaggerated the facts, and made the decision on imposing the reeducation through labor for one year on him. Ren was not an object of the reeducation through labor, and there lacked the basis for the decision made by Lǚliang Reeducation-through-labor Committee. In order to give people the impression of handling cases according to law, Lǚliang Reeducation-through-labor Committee just asserted “ according to the relevant provisions of the State Council on the reeducation through labor” in the aforesaid decision, but did not cite the specific provision as prescribed. After Ren applied to Lǚliang Reeducation-through-labor Committee for review, Lǚliang Reeducation-through-labor Committee was unable to directly answer the question raised by Ren, and only prevaricated it by saying that “the facts ascertained in the original decision were clear, the nature was accurately determined and the punishment was appropriately given”, and then made the review decision on sustaining the original decision upon the strength of its authorities. Ren requested the people's court to cancel the aforesaid specific administrative act of Lǚliang Reeducation-through-labor Committee.@#

原告任建国不服山西省吕梁行政公署劳动教养管理委员会作出的对其维持劳动教养一年的复查决定,向山西省离石县人民法院提起行政诉讼。@#
原告任建国诉称:原告与矿长张福保发生纠纷后,被告偏听偏信,夸大事实,对原告作出劳动教养一年的决定。原告不属于劳动教养的对象,被告的决定于法无据。为了给人以依法办案的印象,被告在决定中只是称“根据国务院劳动教养的有关规定”,没有引用规定的具体条文。原告依法向被告申请复查后,被告无法正面回答原告提出的问题,仅以“原决定事实清楚,定性准确,处罚适当”的空话搪塞,又依职权作出维持原决定的复查决定。原告请求人民法院撤销被告的这一具体行政行为。@#
被告吕梁行政公署劳动教养管理委员会辩称:原告任建国实施暴力,阻碍矿长张福保执行职务的事实是清楚的,根据《山西省人民政府关于保护企业厂长、经理依法执行职务的规定》第八条第(二)项:“以暴力、威胁方法阻碍厂长、经理依法执行职务,尚不够刑事处罚的,可实行劳动教养。”被告决定对原告实行劳动教养,并依照国务院有关劳动教养的程序规定办理了劳动教养手续。因此被告的具体行政行为适用法律正确,程序合法,应当维持。@#
离石县人民法院经审理查明:1992年7月15日下午,原告任建国到高阳煤矿矿长张福保的办公室,见张福保正与本矿一干部谈话。任建国让该干部先出去一下,他要与张福保谈分房一事。张福保对任建国说:你先出去,我们正研究工作。任建国不出去,张福保便上前往外推任建国。这时任建国就拽住张福保的领口来回推拉,并抓其头发。经他人劝阻,平息了事端。被告根据上述事实,以任建军不听劝阻,实施暴力推拉矿长,阻碍矿长执行职务,影响了企业生产的正常进行为由,于1992年8月28日根据国务院劳动教养有关规定和《山西省人民政府关于保护企业厂长、经理依法执行职务的规定》第八条第(二)项决定对任建国劳动教养一年。任建国不服,依法于9月9日向被告申请复查。被告于9月28日以原决定事实清楚,定性准确,处罚适当为由,维持原劳动教养决定。任建国对复查决定仍不服,遂提起诉讼。@#
