1. Case Summary (一)案情摘要
Around 03:00 on November 25, 1992, the fishing vessel “Shanwei 12138” that was owned by Zhong Xiaoyuan and requisitioned by the Anti-Smuggling Office of the Government of Zhuhai City (hereinafter referred to as the “Anti-Smuggling Office of Zhuhai”) for participating in marine anti-smuggling was hit and sank, and 21 persons onboard all fell into the water. The vessel causing the accident did not rescue any person overboard and continued to navigate eastward. Among the 21 persons overboard, 15 were rescued, the other five died, and another one was declared dead. Therefore, Zhong Xiaoyuan and the Anti-Smuggling Office of Zhuhai instituted a lawsuit in the Guangzhou Maritime Court and claimed that “Trade Expansion” owned by Panama Trade Expansion Shipping Company (hereinafter referred to as “Trade Expansion Company”) was the vessel that hit and sank “Shanwei 12138,” and requested the Court to order that Trade Expansion Company should compensate for all damages. 1992年11月25日0300时左右,由珠海市政府打击走私办公室(以下简称珠海打私办)征用参加海上缉私的钟孝源所有的“汕尾12138”渔船被撞沉没,船上21人全部落水。肇事船舶没有对落水人员进行救助,继续向东航行。落水人员中15人被救起,其余5人死亡,1人宣告死亡。为此,钟孝源、珠海打私办向广州海事法院提起诉讼,主张巴拿马易发航运公司(以下简称易发公司)所有的“易发”轮为撞沉“汕尾12138”船的肇事船,并请求判令其赔偿全部损失。
2. Judgment (二)裁判结果
After a first-instance hearing, the Guangzhou Maritime Court held that: “Trade Expansion” collided with “Shanwei 12138,” which caused the sinking of “Shanwei 12138” and “Trade Expansion” should assume all liabilities for casualties and property damages caused by the collision. The Court entered a first-instance judgment that Trade Expansion Company should compensate Zhong Xiaoyuan 2,390,400 yuan, 20,000 HKD, and interest of the two payments; and Trade Expansion Company should compensate the Anti-Smuggling Office of Zhuhai 226,420 yuan, 34,276 HKD, and interest of the two payments. The Higher People's Court of Guangdong Province entered a second-instance judgment to dismiss the appeal of Trade Expansion Company and sustain the original judgment. Trade Expansion Company and Hong Kong Weilin Sailing Co., Ltd. filed a petition for retrial with the Supreme People's Court. After a retrial, the Supreme People's Court held that: Zhong Xiaoyuan and the Anti-Smuggling Office of Zhuhai claimed that “Trade Expansion” was the vessel that hit and sank “Shanwei 12138” and Zhong Xiaoyuan and the Anti-Smuggling Office of Zhuhai should bear the corresponding burden of proof. Due to such objective facts that there was no collision trace and damage at the bow of “Trade Expansion,” the adherent paint drawn from the left stroke-side of “Trade Expansion” was totally different from the paint on “Shanwei 12138,” “Trade Expansion” did not make a sharp left turn or slow down when it passed the incident waters, the relative situations of the position of collision as claimed by Zhong Xiaoyuan and the Anti-Smuggling Office of Zhuhai, the sinking position of the vessel, and the position where the persons overboard were rescued did not conform to local tides at the time, and when the collision accident occurred, there was another container vessel coming from Hong Kong that was navigating eastward by passing the incident waters, it lacked evidence to determine that “Trade Expansion” was the vessel causing the accident. On May 18, 1999, the Supreme People's Court entered a judgment to revoke the first-instance judgment and the second-instance judgment of this case and dismiss the claims of Zhong Xiaoyuan and the Anti-Smuggling Office of Zhuhai.

 广州海事法院一审认为,“易发”轮与“汕尾12138”船发生碰撞,导致“汕尾12138”船沉没,应对碰撞造成的人身伤亡及财产损失承担全部责任。一审判决易发公司赔偿钟孝源人民币2390400元、港币20000元及两款项利息;易发公司赔偿珠海打私办人民币226420元、港币34276元及两款项利息。广东省高级人民法院二审判决驳回易发公司的上诉,维持原判。易发公司和香港威林航业有限公司向最高人民法院申请再审。最高人民法院再审认为,钟孝源、珠海打私办主张“易发”轮是撞沉“汕尾12138”船的肇事船,应承担相应的举证责任。由于“易发”轮船首没有碰撞痕迹和损伤,“易发”轮左舷提取的附着油漆与“汕尾12138”船的油漆不完全相同,“易发”轮经过出事海域时没有大幅度向左转向和减速,钟孝源、珠海打私办主张的碰撞位置与沉船及落水人员被救起位置的相对态势不符合当时当地的潮流,在碰撞事故发生时还有一艘从香港出来的集装箱船经过出事海域向东航行等客观事实的存在,认定“易发”轮是肇事船的证据不足。最高人民法院于1999年5月18日判决撤销本案一、二审判决,驳回钟孝源、珠海打私办的诉讼请求。
