Meng Yuan, the plaintiff, brought a lawsuit to the People's Court of Xuanwu District, Beijig Municipality (hereinafter referred to as Xuanwu District Court) against Zhongjia International Cooperation Travel Agency (hereinafter referred to as Zhongjia Travel Agency) on May 26, 2004 due to the dispute over a travel agreement.@#
Meng Yuan claimed that, on April 21, 2004, she concluded a travel agreement with Zhongjia Travel Agency, entrusting Zhongjia Travel Agency to reserve air tickets and hotel services, and paid 21,480 Yuan to Zhongjia Travel Agency. Due to the epidemic situation of SARS, she proposed to Zhongjia Travel Agency on April 24 for withdrawal from the group and refund of the expenses, but was refused. On April 28, she sent a written notice to Zhongjia Travel Agency on withdrawing from the group, but did not get any satisfactory reply. The travel agreement she concluded with Zhongjia Travel Agency was of entrustment nature, and was a standard form contract. Zhongjia Travel Agency did not inform her that the air fares and the accommodation fees were not refundable, hence the agreement was obviously unfair. Meng Yuan pleaded the court to revoke the agreement, and to order Zhongjia Travel Agency to refund the 21,480 Yuan and bear the litigation costs.@#

一方当事人提出解除合同后,在未与对方协商一致的情况下,拒绝对方提出减少其损失的建议,坚持要求对方承担解除合同的全部损失,并放弃履行合同,致使自身利益受到损害的,应自负全部责任。@#

法定代表人:贾敏生,该旅行社总经理。@#
原告孟元因与被告中佳国际合作旅行社(以下简称中佳旅行社)发生旅游合同纠纷,于2004年5月26日向北京市宣武区人民法院提起诉讼。@#
原告诉称:2004年4月21日我与被告签订了旅游协议,委托被告代订机票和酒店服务,并向被告交纳21480元。由于出现“非典”疫情,4月24日,我向被告提出退团、返还费用,遭对方拒绝。4月28日,我向被告发出书面退团通知,但始终没有得到满意的答复。我与被告签订的旅游合同是委托性质的合同,双方签订的协议是格式合同,被告未告知我机票和房款不能退还,因此协议显失公平。请求:撤销该协议,由被告退还21480元并承担诉讼费。@#
原告提供的证据有:@#
1.《中佳国际合作旅行社三亚协议》和中佳旅行社开具的21480元收据,用以证明已根据协议向中佳旅行社付费。@#
2.原告2004年4月28日以传真形式发给中佳旅行社的通知,用以证明其已书面通知中佳旅行社退出旅游团。@#
被告辩称:我社与原告签订旅游协议后,即向有关航空公司和酒店支付了全款。原告在4月24日咨询退出旅游团时,我社明确表示可以解除合同,但支付的费用已不能退还。考虑原告可能因此遭受损失,建议其授权我社代为转让,但被拒绝。由于原告未接受我社转让名额的建议,耽误了减少损失的时机。4月28日16时,我社接到原告的书面退团申请后,当即用传真方式通知原告:4月30日是出发日期,无法全额退款;如在4月29日10时前告知名单,我社继续安排原告等人的行程。此后,再没有接到原告的电话。原告以“非典”为由提出退团要求时,我社已经开始履行协议,有关费用无法退还原告。原告没有正式办理退团手续,我社只能继续按协议执行,由此产生的经济损失,不应由我社承担。@#
被告提供的主要证据有:@#
1.三亚椰林滩大酒店2004年“五一”期间房间报价表及三亚椰林滩大酒店的说明。用以证明已根据协议为原告预定了酒店,并支付了房款,且“五一”黄金周期间该酒店不退预付款。@#
2.赛特旅行社与中佳旅行社的飞机座位包销协议书、赛特旅行社出具的机票费收据及说明。用以证明已根据协议为原告预定了机票,并支付了机票款,机票为不得退款的包机机票。@#
3.孟元名下南方航空公司CZ3112航班机票一张。用以证明航空公司已经为原告出票。@#
4.中佳旅行社于2004年4月28日向原告传真的回复通知,用以证明已及时对原告退出旅行团的要求进行了详细答复。@#
5.《中佳国际合作旅行社三亚协议》,用以证明双方在协议中已经明确约定了权利和义务。@#
在法庭调查中,被告对原告提供的证据无异议;原告认为,酒店的房间报价表不是原件,缺乏效力;现有证据不能证明被告已代付了房款;被告与其他旅行社的协议书的效力有问题,并对没有提供其他人名字的情况下,被告能否买飞机票提出异议;否认曾接到被告的答复传真。@#
北京市宣武区人民法院应原告的申请,就本案争议的事实向中国南方航空公司进行了调查。调查结果为:该公司4月30日CZ3112航班有198个座位,实际登机者为192人。原、被告双方对此调查结果均无异议。@#

2004年“五一”期间,被告中佳旅行社组织了“三亚自由人旅行团”,旅行社为该旅行团提供的具体服务为:为游客提供往返机票和入住酒店,游客到达后自由活动。@#
4月21日,原告孟元为参加该旅行团,与中佳旅行社签订了《中佳国际合作旅行社三亚协议》。协议约定:旅行社为孟元及其余5人提供4月30日北京去海南三亚和5月4日返回北京的机票,并提供6人入住三亚椰林滩大酒店的3间花园房,每人为此支付的费用是3580元。协议还约定:旅行社提供的机票为团队折扣票,不得签转、退换、更改。协议签订后,原告当即交付了6人的全部费用共计21480元。4月22日,中佳旅行社向三亚椰林滩大酒店交付旅游团全部预订房费,共计43804元,其中原告及其余5人的预订房费为5460元,人均910元;并向赛特国际旅行社交付了往返包机票费用106680元,预订42位包机的往返机位,每位往返机票为2540元,其中为原告及其余5人预订的往返机票交款15240元。@#
