| | 类似商品是动态的范围，在驰名商标司法认定日趋严格的情形下，对于商标知名度、显著性较高的知名品牌，法院可以按个案实情，在立足商品关联性、坚持避免混淆的基础上，能动地认定类似商品的范围。 |

| | 原告埃克森美孚公司（以下简称美孚公司）与美孚石油有限公司是世界五百强能源公司。美孚石油公司于1983年3月30日在第4类润滑油等商品注册了“美孚”和 “MOBIL”商标，并分别于2002年3月14日、2011年5月27日将上述两商标转让给美孚公司。2010年初，两原告发现浙江慈溪市中恒车业有限公司、慈溪市正大车业有限公司在火花塞、减震器商品上突出使用“美孚”商标。两原告为此诉至法院，请求法院确认两商标构成驰名商标，判令两被告停止侵权并赔偿损失50万元。 |

| | 宁波市中级人民法院经审理认为，尽管被诉侵权商品减震器、火花塞和“美孚”、“MOBIL”商标注册核定使用的润滑油类商品分属于不同类别的商品，但从商品自然属性考量，从相关公众的一般认识来看，两者在用途、消费对象、销售渠道上均存在紧密的关联性，属于关联商品，而且两原告在润滑油商品上所用“美孚”、“MOBIL”商标具有较高的显著性和极高的知名度，这使得相关公众易混淆误认商品来源，故应认定两者为类似商品。依据驰名商标按需认定原则，因无需给予两原告商标跨类别的司法保护，故不必认定。两被告未经许可在类似商品上使用与“美孚”注册商标相同、近似商标的涉案行为，已构成商标侵权，故判决两被告停止对“美孚”注册商标的侵权行为，并赔偿两原告损失共50万元。 |
