PROCEDURAL POSTURE@#
The confirmation petitioner, the Liquidation Group for Cancellation of Jiangyou Urban Credit Cooperative (hereinafter referred to as “the Liquidation Group”) filed a petition with this Court against a ruling (No. 1 [2009] Confirmation, SC HPC) of the Higher People's Court of Sichuan Province for a case of application for confirmation of illegal execution by the Higher People's Court of Sichuan Province. This Court formed a collegial panel to hear the petition, and the trial of this case has concluded.@#
The Liquidation Group applied to the original trial court for confirmation of illegal execution on the following grounds: (1) In its ruling (No. 2 [2000], Execution, SC), the Higher People's Court of Sichuan Province determined that Chengdu Luoshu Real Estate Development Co., Ltd. (hereinafter referred to as “Luoshu Company”) against which execution was sought should repay debts to Jiangyou Urban Credit Cooperative (hereinafter referred to as “Jiangyou Cooperative”) with all its land use rights and buildings. Thereafter, without going through the trial supervision procedures, the court made another civil ruling (No. 2-1 [2000], Execution, SC) on account of clerical error to directly change the substantive part of the preceding ruling which had already took effect. By doing this, the court violated Article 88 of the Provisions of the Supreme People's Court on Several Issues Concerning the Execution Work of the People's Court. (2) In its other rulings (No. 2-2 [2000] and No. 2-4 [2000], Execution, SC), the Higher People's Court of Sichuan Province disposed of the property which had been awarded to Jiangyou Cooperative in favor of other creditors, which was unlawful. (3) The appraised value of the property of the judgment debtor was 31,032,500 yuan, but the Higher People's Court of Sichuan Province auctioned the property for only 6 million yuan. No consent was obtained from the Liquidation Group to the upset price.@#

[裁判摘要]@#
根据《中华人民共和国国家赔偿法》第三十一条的规定,人民法院对生效民事法律文书执行错误,造成损害的,受害人有权要求赔偿。根据最高人民法院《关于审理人民法院国家赔偿确认案件若干问题的规定(试行)》第十一条的规定,确认执行行为违法要求有职务行为(包括不作为行为)存在、行为具有违法性、有实际损害结果。人民法院在执行过程中,因执行裁定实体处理不当,以补正笔误的方式予以纠正,在程序上虽有瑕疵,但并未给确认申诉人的合法权利造成实际损失,其执行行为应不予确认违法。@#

确认申诉人江油市城市信用社撤销清算组(以下简称江油信用社清算组)为申请确认四川省高级人民法院执行行为违法一案,不服四川省高级人民法院(2009)川法确字第1号裁定,向本院提出申诉。本院依法组成合议庭进行了审理,现已审理终结。@#
江油信用社清算组向原审法院申请违法确认的理由为:1.四川省高级人民法院以(2000)川执字第2号裁定将被执行人成都市雒蜀房地产开发公司(以下简称雒蜀房地产公司)的土地使用权和房屋全部抵偿给江油市城市信用社(以下简称江油信用社),后未经审判监督程序,径以笔误为由作出(2000)川执字第2-1号民事裁定,变更了上述生效裁定的实体内容,违反了最高人民法院《关于人民法院执行工作若干问题的规定》第88条的规定;2.四川省高级人民法院作出(2000)川执字第2-2号和2-4号裁定,擅自将已裁定抵偿给江油信用社的财产处置给他人,其行为违法;3.被执行人财产的评估价值为3103.25万元,四川省高级人民法院拍卖得款仅600万元,拍卖底价未经江油信用社同意。@#
原审法院查明:江油信用社诉雒蜀房地产公司借款纠纷一案,四川省江油市人民法院于1998年5月27日立案审理,并裁定将雒蜀房地产公司位于成都市天涯石南街的土地使用权、锦江区莲花小区及成华区沙板桥小区的房屋予以查封。后该案依法移送至四川省高级人民法院审理,该院于1999年5月19日作出(1998)川经二初字第70号民事判决,判令雒蜀房地产公司偿还江油信用社借款本金3400万元及利息。判决生效后,四川省高级人民法院根据江油信用社的申请,于1999年11月17日立案执行。2000年3月1日,四川省展望实业公司持四川省公证处(2000)蜀公证字第0593号公证债权文书亦向四川省高级人民法院申请强制执行雒蜀房地产公司 382.4万元的欠款。该院于2000年3月9日立案执行。@#
四川省高级人民法院于2000年3月 13日委托四川泰华会计师事务所(后更名为四川通和会计师事务所)对雒蜀房地产公司被查封财产进行评估。该事务所于 2000年3月17日作出的评估结论为:天涯石南街7000.04平方米土地使用权估价 2741.62万元,沙板桥小区38套房屋估价 282.29万元,莲花小区11套房屋估价 79.34万元,共计3103.25万元;估价结果使用的限制条件为:尚欠土地出让金 165.32万元,预计拆迁费用1950万元,以及两处房产未过户。该评估报告注明有效期为半年,即从2000年2月29日至8月 28日。@#
2000年3月20日,四川省高级人民法院作出(2000)川执字第2号民事裁定,将雒蜀房地产公司天涯石南街7000.04平方米土地使用权、成华区沙板桥小区38套房屋和锦江区莲花小区11套房屋抵偿给江油信用社。同日,该裁定送达江油信用社。2000年4月7日,四川省高级人民法院以补正(2000)川执字第2号民事裁定的笔误为由,作出(2000)川执字第2-1号民事裁定,内容为:(2000)川执字第2号民事裁定书第2页第12行中“商品房”后至“抵偿给申请执行人”前,应添加“待出具评估报告,视其他债权人参与分配情况后,再裁定具体数额”。同日,该裁定送达江油信用社。@#
2000年8月14日,四川省成都市工商行政管理局向四川省高级人民法院出具书面证明称,雒蜀房地产公司已两年以上未年审,应视为自动歇业。@#
第一次评估报告逾期失效后,四川省高级人民法院再次委托四川通和会计师事务所于2001年11月15日对雒蜀房地产公司被查封财产进行了评估。评估结论为:天涯石南街7000.04平方米土地使用权估价2787.44万元,沙板桥小区38套房屋估价262.08万元,共计3049.52万元。莲花小区11套房屋未纳入评估范围。估价报告还声明了其使用的限制条件。@#
