The People's Procuratorate of Taizhou City, Jiangsu Province lodged a public prosecution before the Intermediate People's Court of Taizhou City, Jiangsu Province, against the defendant, Wang Guiping, for the crimes of endangering public security by dangerous means, selling counterfeit or inferior products and making a false contribution of the registered capital.@#
As alleged in the indictment:@#
I. The defendant, Wang Guiping, committed a crime of endangering public security by dangerous means.@#
In January 2005, Wang Guiping gained the trust of Qiqihaer No. 2 Pharmaceutical Factory with a forged business license, pharmaceutical production license and pharmaceutical registration certificate of Taixing Chemical Plant of China National Geological & Mining Corporation. In September 2005, a purchasing agent of Qiqihaer No. 2 Pharmaceutical Factory, Niu Zhongren (who was prosecuted in a separate case for the crime of major accident), ordered one ton of medical propylene glycol at the price of 14,500 yuan from Wang Guiping. Knowing that diethylene glycol could not be used for medical purpose, Wang Guiping purchased one ton of it at the price of 7,200 yuan from Huabang International Trade Co., Ltd. in Zhangjiagang Bonded Zone, and on September 22, in the name of Jiangsu Meiqi Refined Chemical Engineering Co., Ltd., fraudulently delivered such diethylene glycol as medical propylene glycol to Qiqihaer No. 2 Pharmaceutical Factory through Changzhou Yutian Logistics Co., Ltd. and mailed five fake product inspection certificates with a batch number of 050919 to Niu Zhongren who pasted them on the barrels.@#

起诉书指控：@#
一、被告人王桂平犯以危险方法危害公共安全罪。@#
2005年1月，被告人王桂平以伪造的“中国地质矿业总公司泰兴化工总厂”营业执照、药品生产许可证、药品注册证，取得齐齐哈尔第二制药有限公司的信任。2005年9月，该公司采购人员钮忠仁(已因犯重大责任事故罪被另案处理)向王桂平订购 1吨药用丙二醇，每吨价格14 500元。王桂平明知二甘醇不能作为药用，仍以每吨 7200元的价格，从张家港保税区华邦国际贸易有限公司购买二甘醇1吨，冒充药用丙二醇，以“江苏美奇精细化工有限公司”名义，于9月22日通过常州雨天物流有限公司发货给齐齐哈尔第二制药有限公司，并将伪造的批号为050919的5张产品合格证，邮寄给钮忠仁贴在货桶上。@#
2006年3月，齐齐哈尔第二制药有限公司用被告人王桂平出售的批号为 050919的假冒药用丙二醇，生产出规格为10ml：5mg，批号为06030501的亮菌甲素注射液，同月28日及4月21日分两次销售给广州金蘅源医药贸易有限公司，该公司全部销售给广东医药保健品有限公司，广东医药保健品有限公司分别于4月7日、17日、25日，分三次销售3600支给广东省中山大学第三附属医院，该院于2006年4月19日开始临床使用，一共给60余名患者使用了该药品，导致15名患者出现急性肾衰竭或病情加重，其中吴明远等14名患者死亡。@#
二、被告人王桂平犯销售伪劣产品罪。@#
2005年1月至2006年4月间，被告人王桂平以工业用丙二醇冒充药用丙二醇，以二甘醇冒充乙二醇、二聚丙二醇分别销售给齐齐哈尔第二制药有限公司、重庆市双桥应用化工有限公司、宁波千千秀日用品有限公司，销售金额计297 310元。具体情况如下：@#
1．2005年1月，被告人王桂平以1吨工业丙二醇冒充药用丙二醇销售给齐齐哈尔第二制药有限公司，销售额为14 500元；@#
2．2005年12月，被告人王桂平以 12．65吨二甘醇冒充乙二醇销售给重庆市双桥应用化工有限公司，销售额为107 525元；@#
3．2006年4月，被告人王桂平以18．4吨二甘醇冒充乙二醇销售给重庆市双桥应用化工有限公司，销售额为145 360元；@#
4．2006年4月，被告人王桂平以2．25吨二甘醇冒充二聚丙二醇销售给宁波千千秀日用品有限公司，销售额为29 925元。@#
三、被告人王桂平犯虚报注册资本罪。@#
2005年10月，被告人王桂平在没有实际缴纳注册资本的情况下，通过他人向南京正一联合会计事务所张忠仁提供其伪造的总额为500万元的现金缴款单、银行对账单、银行询证函等手续，取得验资报告，后至泰兴市工商行政管理局领取了注册资金为500万元的江苏美奇精细化工有限公司的营业执照。@#
综上，被告人王桂平以用二甘醇冒充药用丙二醇销售给制药企业的危险方法致多人死亡，情节特别恶劣，后果特别严重；在销售产品过程中以假充真；在申请公司登记过程中，使用虚假证明文件，欺骗公司登记主管部门，取得公司登记，虚报注册资本数额巨大，其行为触犯了《中华人民共和国刑法》(以下简称刑法)第一百一十五条第一款、第一百四十条、第一百五十八条
被告人王桂平辨称：本人对公诉机关指控本人犯销售伪劣产品罪、虚报注册资本罪的定性和事实均无异议，但公诉机关指控本人犯以危险方法危害公共安全罪没有事实根据。本人事先并不清楚销售给齐齐哈尔第二制药有限公司的二甘醇会作为药用，也不清楚二甘醇冒充药用丙二醇制为药品后会危及多人生命安全。本人也知道二甘醇一般只用于化工产品，不能作为药用，为了避免出事，在销售前，本人专门喝了一点二甘醇，感觉胃里有点灼痛，其他没有什么强烈反映，认为以二甘醇冒充药用丙二醇不会有什么问题才进行销售，否则本人绝不会以二甘醇冒充药用丙二醇出售。故本人的行为不构成以危险方法危害公共安全罪，只构成销售伪劣产品罪、虚报注册资本罪。本人还有检举、揭发他人犯罪线索的表现，请求法院依法从轻处罚。@#
