| | 2010年9月9日，杨八民驾驶的电动车与赵小涛驾驶的豫BEP222号小型轿车追尾，造成杨八民受伤，两车不同程度损坏。经交警部门责任认定，杨八民承担此事故的主要责任，赵小涛承担事故次要责任。事故发生后，杨八民共支付医疗费8736. 66元。后经中间人杨小东等人调解，赵小涛赔付杨八民5500元。为获取更多保险赔偿款，赵小涛找到尉氏保险公司业务员许文甫帮忙，许文甫把尉氏县148法律服务所负责人周宏伟介绍给赵小涛，3人商议决定通过虚假诉讼骗取保险赔偿款。之后周宏伟未经杨八民授权，以148法律服务所名义委托开封医科法医临床司法鉴定所进行伤残鉴定。开封医科法医临床司法鉴定所医师张孝洁碍于周宏伟的请托，违背鉴定程序和操作规范，在没有对杨八民进行身体检查且另一鉴定人不知情的情况下，私自伪造了杨八民右下肢构成十级伤残的伤残鉴定意见书。2011年3月15日，周宏伟未经杨八民委托，即以杨八民的名义将赵小涛、尉氏县公路局、尉氏保险公司起诉至尉氏县人民法院，请求依法判令各被告赔偿原告医疗费、残疾赔偿金等各项费用共计33879. 2元，并指使其助手全卫华任原告杨八民的诉讼代理人，自己则担任被告赵小涛的诉讼代理人。 |
