The People's Procuratorate of Shenzhen Municipality, Guangdong Province lodged a public prosecution to the Intermediate People's Court of Shenzhen Municipality for the larceny committed by Tian Jiawei, Wang Guoci, Tang Wei and Gao Jing.@#
Upon trial, the Intermediate People's Court of Shenzhen Municipality verified that: in one day in the middle ten days of January 1997, Jiang Zhengzhong (resident of Taipei City, Taiwan Province, fugitive) asked Tian Jiawei and Wang Guoci to meet him at a coffee house of Taipei City. During their meeting, Jiang suggested finding a place at Shenzhen for them to steal cellphone numbers, make doubly numbered cellphones, dial international voice telephones and then collect the fees refunded by international voice stations, and promised that he would pay 50,000 Taiwan dollar to each of them each month. Tian and Wang agreed. Thereafter, with the funds contributed by Jiang Zhengzhong, Tian bought a code input device, a wireless air code detecting machine and other tools necessary for their criminal purpose and brought the tools to Shenzhen via Hong Kong. In the last ten days of that month, Tian rented Room E, 19th Floor and Room F, 25th Floor of Building B of Jinxiu Building, Luohu District, Shenzhen Municipality as their dens. On February 11th of the same year, Tian brought Tang Wei, his cousin in law, to Shenzhen from Beijing, Wang and Jiang came to Shenzhen in February too, all of them lived in the aforesaid two dens. With the funds contributed by Jiang, they bought, at Shenzhen and Hong Kong, one printer, 18 empty cellphones of Mode 9900, the relevant accessories and other tools for their criminal purpose. Then, with the wireless air code detecting machine, Jiang intercepted the electronic information on the serial numbers of the domestic cellphones existing within two kilometers around Jinxiu Building, input the intercepted electronic serial numbers into the 18 empty cellphones to debug with computer and printer, then, the four dialed the special telephones of international voice stations with these cellphones. On March 1st of the same year, Gao Jing, Tang Wei's girlfriend, came to Shenzhen from Beijing, Jiang hired Tang Wei and Gao Jing and paid each of them 1,000 yuan per month, and taught them how to use the code input device and how to steal the phone lines to dial international voice telephones. To avoid being discovered, Tian rented Room 220, Building 7, Overseas Chinese Village, Wenjindu on March 10th as their new den. Jiang and Tian brought the materials on the electronic serial numbers of the cellphones they intercepted to the new den, where Wang Guoci, Tang Wei and Gao Jing input these serial numbers into the 18 cellphones of Mode 9900 with the code input device and dialed international voice telephones ceaselessly by dividing a day into three shifts.@#

广东省深圳市人民检察院以被告人田嘉玮、王国赐、唐伟、高静犯盗窃罪，向深圳市中级人民法院提起公诉。@#
深圳市中级人民法院经公开审理查明：１９９７年１月中旬，江政忠（台湾省台北市人，在逃）约被告人田嘉玮、王国赐到台北市一咖啡厅，提出到大陆深圳市搞一个点盗码并机拨打国际声讯电话，然后收取国际声讯台的退费，由江每月付给田嘉玮、王国赐台币５万元。田、王二人表示同意。尔后江政忠出资，由田嘉玮在台湾购买了一部输码器、一部无线空中侦码器等作案工具，经香港带到深圳市。同月下旬。田嘉玮在深圳市罗湖区租用锦绣大厦Ｂ座１９楼Ｅ室和２５楼Ｆ室作为窝点。同年２月１１日，田嘉玮将其妻的表弟、被告人唐伟从北京带来深圳市，王国赐与江政忠也于２月份来到深圳，同住在上述窝点内。江政忠又出资在香港、深圳购买、打印机各１台，９９００型移动电话空机１８部及有关配件等作案工具。然后，江政忠用无线空中侦码器截取锦绣大厦附近两公里以内的国内移动电话电子串号资料，再用电脑、打印机把截取的电子串号输入１８部移动电话空机进行调试，从而完成盗码并机，４人用这些移动电话机拨打国际声讯台的专讯电话。同年３月１日，唐伟的女朋友、被告人高静从北京市来深圳，江政忠以每月１０００元人民币雇佣唐伟、高静二人，教会唐伟、高静用输码器输码和盗打国际声讯电话。为不被人发现，田嘉玮于３月１０日又租用文锦渡华侨新村七栋２２０室作为窝点。江政忠、田嘉玮把截取的移动电话电子串号资料拿到新窝点，王国赐、唐伟、高静３人在此用输码器把电子串号资料输入１８部９９００型移电话中，每天分三班轮流不停盗打国际声讯电话。@#
同年３月２０日，公安机关接到群众报案，在华侨新村七栋２２０室将被告人唐伟、高静抓获归案。后唐伟带领公安人员又到锦绣大厦将被告人田嘉玮、王国赐抓获归案，并缴获作案工具无线空中侦码器、输码器、电脑、打印机各一部，电脑磁盘１４张，还查获９９００型摩托罗拉移动电话１８部、交流稳压电源５个，车载电池（空壳）２８个、点烟器２８个、插头２９个、充电器３个、记载盗打国际声讯电话的笔记本１本、７２６个移动电话串号资料以及田嘉玮、王国赐的部分个人财物等。经审讯，４被告人均供述了受江政忠雇佣盗打国际声讯电话的犯罪事实。经检测：缴获的１８部移动电话中各储存有１个盗用的移动电话串号。其中有１１个电子串号已经被盗打国际声讯台电话且产生活费。查获的７２６个电子串号中有６３１个是深圳用户。其中有３２０个深圳用户被盗打国际声讯台电话且产生话费。经核算：３３１个深圳用户被盗打国际声讯电话的话费为人民币５８０６４９．３８元。按深圳市电信局规定，３２０个被盗打并机的深圳用户和１８部移动电话的开户入网费共计人民币１１５５９６０元。@#
以上事实，有现场勘查笔录、缴获的作案工具、物证、书证等证据证实。各被告人亦供认不讳。@#
审理中，被告人王国赐及其辩护人辩称：王国赐已经于３月１４日明确向江政忠表示辞职，不再为其盗打国际声讯台电话，并且已经托香港的朋友买好３月２１日返回台湾的飞机票，这说明王国赐有犯罪中止情节，应当减轻处罚。被告人唐伟的辩护人提出：唐伟协助公安人员抓获同案犯，有立功表现，要求从轻或者减轻处罚。@#

深圳市中级人民法院认为：最高人民法院１９９５年９月１３日法复（１９９５）６号《关于对非法复制移电话码号案件如何定性问题的批复》中规定：对非法复制窃取的移动电话码号的行为，应当以１９７９年刑法第一百五十二条规定的盗窃罪从重处罚，盗窃数额以当地邮电部门规定的移动电话入网费计算。对明知是非法复制的移动电话而使用，给他人造成损失的，也以盗窃罪追究刑事责任，盗窃数额以移动电话合法用户的实际损失计算。全国人大常委会在《关于严惩严重破坏经济的罪犯的决定》中，将１９７９年刑法第一百五十二条的法定刑修改为：“情节特别严重的，处十年以上有期徒刑、无期徒刑或者死刑，并处没收财产。”１９９７年１０月１日施行的《中华人民共和国刑法》第二百六十五条规定：以牟利为目的，盗接他人通信线路、复制他人电信码号或者明知是盗接、复制的电信设备、设施而使用的，依照第二百六十四条规定的盗窃罪定罪处罚。第二百六十四条的法定刑是：“数额特别巨大或者有其他特别严重情节的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没有财产”。@#
