 上诉人朱敬中因与被上诉人朱敬贵、朱敬喜恢复原状纠纷一案,不服环县人民法院(2013)环民初字第977号民事判决,向本院提起上诉。本院受理后,依法组成合议庭,于2014年1月9日公开开庭进行了审理。上诉人朱敬中与被上诉人朱敬贵、朱敬喜均到庭参加了诉讼。本案现已审理终结。
 原审判决认定,朱敬贵、朱敬喜庄子与朱敬中庄子相邻,均坐东向西,朱敬贵、朱敬喜庄基比朱敬中庄基高出1.9米左右,朱敬贵、朱敬喜同居一个院子且多年共用一历史遗留打麦场,该打麦场呈不规则圆形向朱敬中家门前延伸,比朱敬中庄基高出约1.5米。2012年农历9月,朱敬中在自家庄基内北面坐北向南新盖三间半安架房和一间半厦房,该厦房与朱敬贵、朱敬喜家打麦场部分相接,致朱敬中家房屋后面的排水受到了影响,朱敬中因此与朱敬贵、朱敬喜发生矛盾。2013年6月12日,朱敬中以自家房屋后朱敬贵、朱敬喜家高出自家的埂沿取直线将朱敬贵、朱敬喜家多年使用的打麦场长约12米、宽约6.5米的部分削去,影响了朱敬贵、朱敬喜对打麦场的正常使用。
 原审法院审理认为,原、被告相邻而居,应本着有利生产、方便生活、团结互助、公平合理的原则正确处理通行、排水等相邻关系。打麦场乃历史遗留且是朱敬贵、朱敬喜多年家庭生产、生活所必须使用的场所,现朱敬中私自强行毁损朱敬贵、朱敬喜使用多年的打麦场,破坏朱敬贵、朱敬喜多年来对该打麦场的土地利用现状,影响了朱敬贵、朱敬喜家庭的生产、生活,存在明显过错,应当承担侵权责任,朱敬贵、朱敬喜诉请让朱敬中恢复原状符合法律规定,应予支持;朱敬喜赔偿损失的诉请没有证据证实,不予支持。依据《中华人民共和国侵权责任法》第六条第一款、第十五条第一款第(五)项的规定,判决:一、朱敬中于本判决生效后10日内恢复朱敬贵、朱敬喜使用的打麦场的原状;逾期则由朱敬中给付朱敬贵、朱敬喜恢复打麦场原状的费用5000元,由朱敬贵、朱敬喜自行恢复;二、驳回朱敬喜的其他诉讼请求。如果未按本判决指定的期间履行给付金钱义务,应当依照《中华人民共和国民事诉讼法》第二百五十三条之规定,加倍支付迟延履行期间的债务利息。案件受理费50元,现场勘验费300元,共计350元,由朱敬中负担。
