PROCEDURAL POSTURE@#
The People's Procuratorate of Jingkou District, Zhenjiang, Jiangsu Province lodged a prosecution to the People's Court of Jingkou District, Zhenjiang, Jiangsu Province (hereafter shortened as Jingkou Disrict Court) against Sun Aiqin, the defendant, for his crime of accepting bribes and his crime of accepting bribes in the identity of a company employee.@#
The bill of indictment describes: In April 1993, Zhenjiang Supply and Marketing Cooperative Real Estate Development Company (presently named as Shenlong Real Estate Development Company, an enterprise of collective ownership, hereinafter referred to as Supply and Marketing Company) and Liu Yijiang who was affiliated to Zhenjiang Zhenhua House Development Company (hereinafter referred to as Zhenhua Company) jointly developed No. 8 land on Jiankang Road. In the process of the development, Sun Aiqin colluded with Zhu Jinshun, deputy manager of Supply and Marketing Company, and others to, by taking advantage of Zhu Jinshun's position, jointly accept CNY 200,000 of bribes from Liu Yijiang, and Sun Aiqin possessed CNY 50,000 among that amount. In June 1994, the Real Estate Administrative Bureau of Dantu County, Zhenjiang Municipality (hereinafter referred to as Dantu Real Estate Bureau) and Liu Yijiang jointly developed No. 17 land on Jiankang Road. In the process of the development, Sun Aiqin colluded with Zhou Wei, director general of Dantu Real Estate Bureau to, by taking advantage of Zhou Wei's position, jointly accept CNY 100,000 of bribes from Liu Yijiang, with either of them being distributed CNY 50,000; and later, Sun Aiqin accepted CNY 80,000 of bribes from Liu Yijiang alone. Sun Aiqin's act of colluding with Zhu Jinshun, etc. to accept bribes has violated Article 163 of the “Criminal Law of the People's Republic of China”, and has constituted the crime of accepting bribes in the identity of a company employee; Sun Aiqin's act of colluding with Zhou Wei to accept bribes from Liu Yijiang and that of accepting bribes from Liu Yijiang alone have violated Article 385 of the Criminal Law, and have constituted the crime of accepting bribes. Sun Aiqin has committed two crimes and shall be given combined punishment. Please impose a sentence on him according to law.@#

江苏省镇江市京口区人民检察院以被告人孙爱勤犯受贿罪、公司人员受贿罪,向镇江市京口区人民法院提起公诉。@#
起诉书指控:1993年4月,镇江市供销社房地产开发公司(现名神龙房地产开发公司,集体所有制企业,以下简称供销公司)与挂靠在镇江市振华房屋开发公司(以下简称振华公司)的刘以江联合开发健康路8号地块。业务过程中,被告人孙爱勤伙同供销公司副经理朱锦顺等人,利用朱锦顺的职务便利,共同收受刘以江贿赂的20万元,孙爱勤将其中的5万元占为已有。1994年6月,镇江市丹徒县房地产管理局(以下简称丹徒房管局)与刘以江联合开发健康路17号地块。业务过程中,孙爱勤又伙同丹徒房管局局长周伟,利用周伟的职务便利,先共同收受刘以江贿赂的10万元,二人各分得5万元;后孙爱勤单独收受了刘以江贿赂的8万元。孙爱勤伙同朱锦顺等人收受贿赂的行为,触犯了《中华人民共和国刑法》第一百六十三条的规定,构成公司人员受贿罪;孙爱勤伙同周伟以及单独收受刘以江贿赂的行为,触犯了刑法三百八十五条的规定,构成受贿罪。孙爱勤一人犯两罪,应当数罪并罚,请依法判处。@#
公诉机关向法庭提交了如下证据:@#
1、证人刘以江的证言,主要内容是:1993年底我挂靠振华公司期间,通过战友从部队拿到健康路8号地皮的批文。这块地上当时有一座小二层楼需要拆迁,是通过当时任拆迁办主任的孙爱勤帮忙拆迁的,因此认识了孙爱勤。我因无资质和能力开发这块地皮,就请孙爱勤给找一家有实力的开发商,把这个项目转让出去,条件是除地皮费用以外,要转让费50万元.孙同意。孙先联系了京京开发公司的陆广裕,因陆作不了主,孙又联系了振华公司的朱锦顺。开始是我委托孙爱勤、陆广裕与朱锦顺谈,地价一共算250万元,这个价码是我提出来的。我告诉孙爱勤,要250万元我就赚钱,事成以后有你们的好处。他们谈得差不多时,孙爱勤叫我出场,与朱锦顺和他们公司的经营科长一起签了协议。我又对他们讲,我不会亏待你们。土地转让费划过来后,我从中提取20万元现金送给了孙爱勤,叫他给他们几个人分分。@#
2、证人朱锦顺的证言,主要内容是:1993年3—4月份,我刚调到振华公司任副主任,很想做成一些业务,就找到孙爱勤,请他帮忙介绍。因为孙是市拆迁办的副主任,认识的开发商多,信息广。孙向我介绍了健康路8号这块地皮,说是刘以江的,问我愿意不愿意要。与刘接触后,刘说这块地皮要250万元。我认为我们可以赚钱,就接下来并签了协议。后来听孙爱勤说,刘以江答应给我们一笔费用。我认为这是“回扣”,但我和孙爱勤、刘以江事前没有商量过拿“回扣”的事。有一天晚上,孙爱勤打电话叫我,我就和我公司的王本勋一起到孙家。在孙家楼下,孙给了我和王本勋每人5万元现金,说是刘以江给我们的,并且说刘一共给了20万元。开发这块地皮,我公司赚了100多万元,孙爱勤从中起了介绍和引见的作用。@#
3、证人王本勋的证言,主要内容是:我任振华公司经营部经理期间,朱锦顺叫我协助他办开发健康路8号地皮的事。有一天晚上,朱锦顺叫我和他一起去孙爱勤家,孙把一包东西给了朱锦顺。下楼后,朱从这包东西中拿出一沓钱给我,让我先拿着,我就收下了,回来数是5万元。以后我问朱锦顺,这5万元是怎么回事?朱说这钱是刘以江给的。刘从部队上弄的地皮便宜,他赚了钱,拿出些钱来撒撒。朱还说,刘以江给我公司转让地皮这件事,是孙爱勤从中周旋,孙爱勤也得到了钱。@#
4、证人陆广裕的证言,主要内容是:我早就认识刘以江,当时他是转业军人,说他准备搞房地产,请我帮忙,我同意。孙爱勤我也是早就认识,因为都在一个系统。有一天孙爱勤对我说,他有一个朋友要搞房地产,但什么都不懂,又没有人,想让我和这个人见见面。一见面才知道是刘以江。刘说部队要搞开发,他已经和部队谈好一块地皮,叫我去看看。我看过后告诉他们,这块地皮位置好,盖了房子不愁卖。刘以江从部队拿到批文后,孙爱勤对我讲,让我帮刘以江找一家有实力的合作伙伴,并建议我去找一下以前和我在一起的朱锦顺。我就向朱锦顺介绍了刘以江这个项目,朱听后说一起谈一谈。后来谈成了,孙爱勤对我讲:“老刘这个人爽气,他说不会亏待我们。”有一天晚上,孙爱勤打电话叫我去他家,我去后,刘以江也来了。孙爱勤就让我们二人到外面,刘以江把一个袋子给了孙爱勤,说:“你们几个人的都在里面。”我说:“这是什么意思?”刘说:“这个不是事先说好的吗。我说话算数,你就不要客气了。”说完他就走了,孙给了我5万元。@#
5、被告人孙爱勤的供述,主要内容是:1993年下半年,刘以江从部队搞到一块地皮,要开发商品房。但刘没有资质,也没有能力开发。我是搞拆迁工作的,与镇江市的房屋开发商比较熟,刘就托我找人。我先帮他找了陆广裕,由于陆不合适,我又帮他找了朱锦顺,朱锦顺认为这块地可以搞。在朱锦顺、王本勋、陆广裕、刘以江他们商谈过程中,我参加几次。正式商谈地价时,朱锦顺还价,刘以江说:“地价250万元,就这么定了。你们几个我是不会亏待的。”我也附和着说;“就这样吧。”有一天晚上,刘以江给我打电话,意思是给我送钱。他把我叫到楼下,给我一只塑料袋,里面装着20万元。后来我把这些钱分给朱锦顺、王本勋、陆广裕每人5万元,我留下5万元。@#
6、证人刘以江的证言,主要内容是:孙爱勤以前和我哥哥刘以镇是邻居,我去我哥哥家打牌时认识孙爱勤,但那时没有交往。在开发健康路8号地皮的过程中,孙爱勤帮助我找到朱锦顺。健康路17号地皮是我跟军区文化站签订协议共同开发,由于在开发过程中情况发生变化,我前期投入的资金不产生效益,就又让孙爱勤帮助联系了丹徒房管局的局长周伟。我当时提出来这块地皮要有500万元资金才能合作,但周伟认为有300万元就可以运作了,我就同意周伟把300万元资金付到我账上,他们进场开发、建筑、销售,与部队的经济往来由我负责。我和房管局的合作很成功。为此,我叫孙爱勤、周伟和我一起去上海,在上海我给了他们10万元;第二次是我开车到孙家楼下,叫孙出来到我车里,我给了他8万元。这8万元孙爱勤是否分给周伟,我不知道。我给孙钱,一是因他帮助我找到了合作开发伙伴,我要向他表示感谢;二是我很想交孙爱勤这个朋友。@#
7、证人周伟的证言,主要内容是:1994年初,通过孙爱勤认识刘以江。孙爱勤介绍我们认识后,我就和刘以江谈合作开发健康路17号地皮的事,孙爱勤没有参加。有一次,刘让我和孙爱勤与他一起去上海。在酒店吃完饭我正准备洗澡,刘以江拿着一包报纸包的东西进入我和孙爱勤住的房间说:“这点钱你们拿去买东西。”我看纸包比较大,知道钱不少,就说:“买东西有个一两万就行了。”然后就去洗澡。我洗澡出来,孙爱勤从他的被子底下拿出5沓钱(每沓1万元)给我。我当时对孙说:“你反正是介绍人,没什么事。我在开发的这个房子上还要与刘以江打交道,万一他不按协议办,我们单位不好交代。我拿上2万元就行了。”孙说没事,他把5万元给了我。除这5万元以外,我和刘以江再没有其他经济来往。@#
