With regard to disputes between the Postal Administration of Nanhai City (hereinafter referred to as Nanhai Administration) and Cui Lixin (also referred to as Cui) concerning the payment of outstanding telephone expenses, the Postal Administration filed suit in the People's Court of Nanhai City, Guangdong Province.@#
Nanhai Administration claimed in the complaint that Cui Lixin should have paid telephone expenses of RMB 9589.10 in November, 1995, but that there was only RMB 436.26.in his dedicated telephone expense account. Nanhai Administration advised Cui to pay the telephone expenses. Cui refused to pay said expenses because, after checking the telephone bill, he alleged that someone had used his telephone without authorization. After negotiations between Nanhai Administration, Huangqi Branch and Cui, a “summary of minutes”, in which Cui agreed to pay the outstanding telephone expenses within 7 days, was signed. However, Cui subsequently went back on his word and refused to make the payment. Nanhai Administration then asked the Court to order Cui to pay the outstanding telephone expenses of RMB 9589.10 together with a fine for delayed payment calculated at 1% per day from the date on which payment should have been made to the date on which payment was received.@#

南海市邮电局诉崔立新欠付电话费纠纷案@#

原告广东省南海市邮电局因与被告崔立新发生欠付电话费纠纷，向广东省南海市人民法院提起诉讼。@#
原告诉称：被告住宅电话１９９５年１１月份的电话费是９５８９．１０元，而该月被告的电话费帐户内仅有余额４３６．２６元。原告通知被告支付电话费，被告查阅了通话清单后，以他人盗用该电话线路为由拒付。后经我局下属的黄岐分局与被告协商，被告同意在７天内支付所欠话费，并签署了一份“会议纪要”，但事后反悔。请求判令被告支付所欠电话费９５８９．１０元，以及该款从欠付之日起至付清之日止按日１％计付的滞纳金，诉讼费用由被告承担。@#
被告崔立新辩称：经查通话清单得知，原告所称我欠付的电话费中，有９４５７．０５元是被他人盗打产生的，原告派人查线后也认为是被人盗用。此案已由公安机关立案侦查，尚未破案。此款应当在破案后，由盗打电话的人支付。可是原告以我拖欠电话费为由，先后三次对我的住宅电话停机，又以停机、罚款、取消电话的胁迫手段与我签订一份还款“会谈纪要”。我不同意无条件交付，如强迫我交这笔款项，我要保留索赔及向上反映的权利，希望国家法律保护我的合法权益。@#
南海市人民法院经审理查明：被告崔立新的住宅电话一门（号码５９３１１２１），由原告南海市邮电局的下属黄歧分局开通。１９９５年１２月１５日，南海市邮电局发现崔立新１１月份的电话费为９５８９．１０元，而其电话费帐户内的余额仅有４３６．２６元，即通知崔立新补付。崔立新于同月２５日查看了通话清单。清单列明：１１月８日１０时４９分至１１时３４分，１４时３６分至１６时２０分，９日３时２７分至６时１２分，两日三段时间共通话２９次，均打往国外声讯台，话费为９４５７．０５元。崔立新认为这些电话不是他及家人所打，应崔立新的要求，邮电局派员检查，发现该电话线路设在三层楼处的接线槽被撬开，通往七层楼崔立新家的电话接线口螺丝被松开。崔立新即向公安机关报案，黄岐派出所派人查看现场后，出具了“崔家外线路盒有被人撬过的痕迹，此案仍在侦破过程中”的证明。之后，南海市邮电局曾多次向崔立新追收所欠电话费，崔立新均以电话线路被他人盗用、该月电话费不应由其承担为由要求协商解决，但数次协商未果。南海市邮电局以崔立新借故拖延缴纳电话费为由，先后两次中止了对崔立新住宅电话的通话服务。１９９６年９月２３日，南海市邮电局与崔立新经协商，签订了一份协议，约定崔立新在７天内一次性支付所欠电话费９５８９．１０元，南海市邮电局免收上述电话费的滞纳金及利息。后崔立新反悔，南海市邮电局就再次中止了对崔立新住宅电话的通话服务。诉讼期间，南海市邮电局以崔立新电话费账户内尚余４３６．２６元，将请求崔立新支付的电话费变更为９１５２．８４元。@#
