| | 原告陈彬诉称：原、被告于2011年10月15日签订“授权合同”，被告授予原告“窦四牛杂面”特许经营权及商标使用权。该合同同时约定，被告不得允许各经营店之间的地理位置少于1. 5公里，即原告享有该范围内“窦四牛杂面”的独家经营权。但被告授权第三人设立的“窦四牛杂面”店，与原告的加盟店以地理上的直线距离计算相距不足1. 5公里。被告的行为严重违反了合同约定，要求：（1）被告继续履行合同，采取补救措施，即被告要求第三人停止在河东区泰昌路万和里21-2-101开设的“窦四牛杂面馆”的行为；（2）诉讼费用由被告负担。 |
