 ——超出卖房人欲售价格的房款如何处分

 裁判要旨
 对超出卖房人欲售价格的房款,房产经纪公司和卖房人未约定如何处理。买房人实际出资购买房屋的价款是其真实意思表示,对超出卖房人欲售价格的房款,买房人无权要求退回。
 案情
 河南省洛阳市老城区义勇北街6号院1单元202号房产原属朱喜荣所有。2010年8月16日,第三人朱喜荣委托张爱华出售该房产,并进行了公证。同年9月21日,通过洛港房产经纪公司介绍,张爱华以朱喜荣名义与原告李秋香签订一份房屋买卖合同,约定:朱喜荣将位于洛阳市老城区义勇北街6号院1单元202号房产一套出售给李秋香,价款为16万元;签订合同时,朱喜荣向洛港房产经纪公司交纳中介服务费3200元及过户费300元,李秋香向洛港房产经纪公司交付定金1500元,剩余房款于2010年9月24日前交付房产经纪公司。合同签订后,李秋香于9月25日将购房款16万元交付洛港房产经纪公司,经手人为海闪闪。同日,洛港房产经纪公司将该房产交付给李秋香。同年9月29日,李秋香办理了该房产的产权过户手续。此后,因李秋香得知朱喜荣仅收到购房款13万元,且朱喜荣售房时承诺赠送配套储藏室一间,遂认为洛港房产经纪公司、海闪闪侵犯其合法权益,故诉至法院,要求洛港房产经纪公司和海闪闪交付与房产配套的储藏室一间并退还不当得利3万元。
