| | （一）基本案情 |
| | 郑彦某与郑庆某买卖合同纠纷一案，生效调解书确认郑庆某于2012年7月19日即调解协议签订之日给付郑彦某10000元，余款23930元于2012年12月31日全部付清。 |
| | 然而，郑庆某除签订调解协议时给付的10000元外，余款23930元并未按协议如期履行。2013年4月22日，郑彦某向河北省枣强县人民法院申请执行。该案进入执行程序后，执行法院依法向被执行人送达了执行通知书、报告财产令，但被执行人既未履行调解书确定的义务，也未向执行法院报告财产，更不依传票传唤到庭接受调查。执行法院将被执行人在枣强县农村信用合作联社的存款2400元予以强制扣划，此外再未发现被执行人名下有可供执行的财产。后经执行法院查明，被执行人曾向某客户出售过一批兔皮。为此，执行法院决定以被执行人拒不报告财产、有履行能力而拒不履行生效法律文书确定的义务为由对被执行人予以司法拘留。 |
