Fan Ming and Liu Xilong Intentional Murder and Rape Case@#

Defendant: Fan Ming, male, 18, from Jing County, Hebei Province. He used to be a road maintenance crew of Feng Tai Section, Beijing Railway Sub-Bureau, lived in living quarters for railway staff and workers in Huang Village of Da Xing County, Beijing and was arrested on June, 3,1984.@#
Defendant: Liu Xilong, male, 17, (born on Oct. 17,1966) from Wu Qing County, Tian Jin. He used to be a temporary worker of Beijing Long Distance Telecommunication Facilities Factory, lived in living quarters for railway staff and workers in Huang Village of Da Xing Country, Beijing and was arrested on June 3, 1984.@#
The defendants, Fan Ming and Liu Xilong premeditated to rape Zhao Yan (17 years) who was their middle school class-mate and lived in Wang Li village, Hong Xing District, Da Xing Country. Fan Ming and Liu Xinglong deceived Zhao yan to a waterlocks room on the North side of Huang Wei Road, east of Wang Li Village at 22:00 on the evening of May 21, 1984. At first Fan Ming demanded to have sexual intercourse with Zhao Yan but was refused by Zhao Yan, then he raped Zhao with violence. Zhao cried and cried after being raped. In order to prevent divulgence of his secrets, Fan Ming went out of the waterlocks room to conspire with Li Xilong to choke her to death. Liu Xilong agreed but asked to rape Zhao first. After Liu raped Zhao, Fan Ming choked Zhao until she lost consciousness. Then Liu suggested to put Zhao on the nearby rail to let the train to run over and kill her in order to create the false impression that Zhao committed suicide by lying on the rail. Fan Ming and Liu Xilong plundered her watch and few RMB and moved Zhao on to the tail near No.39 KM road sign of Beijing-Tianjing Railway line. After several minutes, Zhao Yan was struck and extruded by the train which results in death because of heart rupture and internal hemorrhage. Then Fan Ming and Liu Xilong , ran away from the spot, after they committed the crime. But later they were brought to justice.@#

樊明、刘希龙故意杀人、强奸案@#

被告人樊明，男，十八岁，河北省景县人。原系北京铁路分局丰台工务段养路工，住北京市大兴县黄村铁路职工宿舍。一九八四年六月三日被逮捕。@#

被告人刘希龙，男，十七岁（一九六六年十月十七日生），天津市武清县人。原系北京长途电信设备厂临时工，住北京市大兴县黄村铁路职工宿舍。一九八四年六月三日被逮捕。@#
被告人樊明、刘希龙，预谋强奸中学时的同学、大兴县红星区王立庄村少女赵燕（十七岁）。一九八四年五月二十一日晚十时，樊明、刘希龙将赵燕从家中骗至王立庄村东黄魏公路北侧一水闸房内。樊明先提出要与赵燕发生性关系，遭到赵燕拒绝，即使用暴力将赵燕强奸。赵燕被强奸后啼哭不止。樊明唯恐赵燕告发，到水闸房外与刘希龙密谋掐死赵燕，以杀人灭口。刘希龙表示同意，提出待自已强奸赵燕后再将其掐死。刘希龙将赵燕强奸后，樊明即狠掐赵燕的颈部，将赵燕掐昏。尔后，刘希龙提出将赵燕放到附近铁轨上，让列车将其轧死，制造赵燕卧轨自杀的假象。随之，樊明、刘希龙掠走赵燕的手表和人民币少许，将昏迷中的赵燕移至京津铁路三十九公里路标附近的铁轨上。几分钟后，赵燕被运行的列车撞击挤压，造成心脏破裂内出血死亡。樊明、刘希龙作案后逃离现场，后被抓获归案。@#
此外，被告人刘希龙自一九八二年以来，先后伙同他人和单独在大兴县饲料公司加工厂、北京长途电信设备厂等处，盗窃手推车轱辘三副、盘条一千余斤、铜丝二十余斤、白兰地酒二十四瓶等物品，共价值人民币六百余元。@#

一九八四年八月十一日，北京市中级人民法院依法审理该案，认定被告人樊明、刘希龙合谋并共同实施犯罪行为，属于《中华人民共和国刑法》第二十二条一款规定的共同故意犯罪。樊明、刘希龙以暴力轮奸少女，犯有刑法第一百三十九条强奸罪，根据该第四款的规定，应从重处罚。樊明、刘希龙实施强奸犯罪后，为杀人灭口，将被害人赵燕掐昏置于铁轨上，致使赵燕被列车撞击挤压死亡，犯有刑法第一百三十二条故意杀人罪。此外，被告人刘希龙先后伙同他人和单独盗窃国家财产，数额较大，犯有刑法第一百五十一条盗窃罪。樊明、刘希龙二被告人犯罪手段残忍，情节、后果特别严重，应依法严惩。刘希龙犯罪时未满十八周岁，依照刑法第十四条三款的规定，可以从轻处罚；依照刑法第四十四条的规定，不适用死刑。据此，以故意杀人罪、强奸罪判处被告人樊明死刑；以故意杀人罪、强奸罪、盗窃罪判处被告人刘希龙死刑缓期二年执行。并依照刑法第五十三条一款规定，对樊明、刘希龙剥夺政治权利终身。@#
