The “welfare lotteries” refers to instrumentsof value that are exclusively issued by China Welfare Lottery Center asauthorized by the State for the purpose of raising funds to promote thedevelopment of social welfare undertakings. Where a non-state functionary, whois under the entrustment of lottery distribution agencies to sell lotteries atthe booking office, prints and obtains lotteries without paying any wager,he commits embezzlement of the public property managed by the lottery distributionagencies. In accordance with Article272, Paragraph 1 of the Criminal Law, this act shall be convicted and punished asa crime of embezzlement.@#

Defendant: Liu Bizhong, male, 37, farmer of Group 1, Touzhuang Village, Zhendong Township, Binhai County, Yancheng City, Jiangsu Province. He was arrested on January 18, 2004.@#
The People's Procuratorate of Binhai County, Yancheng City, Jiangsu Province lodged a prosecution to the People's Court of Binhai County, Yancheng City, Jiangsu Province (hereinafter referred to as Binhai County Court) on the ground that Liu Bizhong, the defendant, committed the crime of contractual fraud.@#
The bill of indictment describes: Liu Bizhong began to run a lottery station after concluding an agreement. He printed 15 lotteries at the total amount of CNY 556,920 with his lottery stake machine by means of paying no stakes. Since Liu Bizhong was unable to pay the huge amount of lottery stakes, he attempted to escape and hide himself, but was seized. Liu Bizhong's acts violated Article 224 of the “Criminal Law of the People's Republic of China” (hereinafter referred to as the Criminal Law), and constituted the crime of contractual fraud. Please impose a sentence on him according to law.@#

1. the agreement on sale of welfare lotteries, which was concluded between Liu Bizhong and the Office of the Lottery Commission of Binhai County, Jiangsu Province (hereinafter referred to as the Office of Binhai Lottery Commission), and which proves that upon approval of the Office of Binhai Lottery Commission, Liu Bizhong became a proxy seller of the “32090322 welfare lottery station of Jiangsu Province” (hereinafter referred to as “the 0322 lottery station”) on December 1, 2003, performed the obligation of paying the money from proxy sale on time and in full amounts to the bank and account designated by the Office of Binhai Lottery Commission, and meanwhile enjoyed the right of sharing the revenues of proxy sale at the rate of 6.5%;@#

福利彩票是国家为筹集社会福利事业发展资金，特许中国福利彩票发行中心垄断发行的有价凭证。受彩票发行机构委托，在彩票投注站代销福利彩票的非国家工作人员，如果以不交纳彩票投注金的方式擅自打印并获取彩票。是侵犯彩票发行机构管理的社会公益性财产的行为。根据刑法第二百七十二条第一款规定，对这种行为应当按挪用资金罪定罪处罚。@#

江苏省盐城市滨海县人民检察院以被告人刘必仲犯合同诈骗罪，向江苏省盐城市滨海县人民法院提起公诉。@#
起诉书指控：被告人刘必仲通过签订协议，开始经营彩票投注站。其以不交纳投注金的手段，从其经营的彩票投注机上一次打印出总金额55.692万元的15张彩票。由于无法支付巨额彩票投注金，刘必仲企图逃匿，被抓获。刘必仲的行为，已触犯《中华人民共和国刑法》（以下简称刑法）第二百二十四条规定，构成合同诈骗罪，请依法判处。@#
公诉机关提交以下证据：@#
1．刘必仲与江苏省滨海县有奖募捐委员会办公室（以下简称滨募办）签订的福利彩票销售协议书，用以证明经滨募办批准，刘必仲于2003年12月1日成为“江苏省32090322福利彩票投注站”（以下简称“0322投注站”）代销员，履行将代销款准时、足额上缴滨募办指定银行和账号的义务，同时享有按代销额6.5%提成的权利；@#
2.证人刘德祥的证言，用以证明刘必仲是接替其成为“0322投注站”代销员，其教会刘必仲打印复式彩票；@#
3.事业单位法人证书、机构编制委员会批复，用以证明盐城市福利彩票发行中心和滨募办均为民政系统举办的事业单位，负责组织、实施本地福利彩票的发行销售工作；@#
4.中国福利彩票2003087期第20至34号彩票，用以证明该15张复式B001彩票每张面值37128元，总面值55.692万元，是2003年12月21日17：01时至17：28时由“0322投注站”打出；@#
5.中国福利彩票发行中心（以下简称中国福彩中心）技术管理部证明、数据光盘和深圳思乐数据技术有限公司软件工程师沈霓的证明，用以证明中国福利彩票2003087期第20至34号共15张复式B001彩票是有效彩票；@#
6.滨募办工作人员赵武杰、李章辉的证言，用以证明12月21日晚，盐城市福利彩票发行中心发觉“0322投注站”的销售异常，立即指令滨募办调查。接受指令后，他们于第二天找到刘必仲，刘必仲写下55.7048万元（含前期应缴的投注金128元）的欠款条，由其兄刘必正担保；@#
7.2003年12月22日刘必仲给滨募办打下的欠款条，用以证明刘必仲承认欠彩票款55.7048万元；@#
8.邻居曹克建的证言，用以证明刘必仲家境贫寒，无能力偿还巨额投注金；@#
9.刘必仲的供述，主要内容是：其梦想发财，意欲通过中大奖来改变生活条件。2003年12月1日，在交纳了保证金1万元并与滨募办签订协议后，接替刘德祥管理“0322投注站”。经多次研究福彩走势，自认为已掌握中奖规律。由于至12月21日，当期福利彩票的大奖尚未出现，其认为有可能在最近的彩票中出现大奖，因此于当日下午空打面额达55.692万元的彩票，以期中大奖后再补缴投注金，但仅中奖8320元。空打彩票被发觉后，滨募办来人核查，其给打了一张55.7048万元的欠条。因无力还债企图躲避，被抓。@#
被告人刘必仲及其辩护人对起诉书指控的事实无异议。刘必仲辩称，其是欠款购彩票，欠下的彩票投注金已经出具欠条，没有诈骗，不构成诈骗罪。刘必仲的辩护人认为：1．经过签订协议，刘必仲接受滨募办管理，成为隶属于滨募办的投注站工作人员，其与滨募办之间存在着劳动合同关系，不是经济合同关系，刘必仲不是经济合同的一方当事人；2.合同诈骗罪必须以非法占有为目的，而非法占有的前提是有财产可供占有。彩票投注站的账目记录在彩票投注机中，同时在彩票发行机构的财务账目中也有完整反映，彩票投注站的经营人想通过篡改账目来实现对彩票投注金的非法占有，事实上办不到。彩票投注金来自于投注人，彩票投注站的经营人自己投注却不交纳投注金，如何能实现对彩票投注金的非法占有；3.彩票是发行者用来换取投注者手中现金的工具，不是人民银行发行的钞票；彩票上标注的面值，只说明发行者想以该彩票换取多少投注金，不证明该彩票代表多少财产价值；只有交纳投注金后购买的彩票，才能有效、有价；不交纳投注金打出的彩票，是一张无效的废纸；4.即使刘必仲打出的彩票有效，对巨额彩票投注金，其已经给滨募办出具欠条，说明其是“欠款买票”，与滨募办之间存在着民事债权债务关系；其逃匿，仅仅是为了逃债，不具有刑事违法性。刘必仲没有侵犯滨募办的财产所有权和国家对合同的管理制度，不构成合同诈骗罪。@#
滨海县人民法院经审理查明：@#
2003年12月1日，被告人刘必仲与滨募办签订了代销福利彩票协议。在交纳投注机设备保证金1万元后，刘从原代销员刘德祥手中承接了“0322投注站”的彩票销售权。同月21日下午5时许，刘必仲认为当期销售的彩票还未出现中奖号码，遂利用自身销售彩票的便利，以不交纳投注金的方式，从彩票投注机上一次性打出总金额为55.692万元的15张彩票，以期中得大奖后归还投注金。但中奖号码揭晓后，刘必仲仅中奖8320元。在当晚开奖前，盐城市福利彩票中心即发现“0322投注站”的销售异常，迅速责令滨募办派人调查。同月22日，刘必仲向滨募办打下一张欠彩票款55.7048万元的条据。24日中午，刘必仲因无法支付巨额彩票投注金企图逃匿，在盐城汽车站被公安机关抓获。@#
