江苏顺天海运集团南京顺道航运有限公司等诉浙江省宁波市沥平航运有限公司船舶碰撞纠纷案—合意违反航行规则致船舶无接触碰撞的责任承担

 【裁判要旨】船舶因操纵不当或者不遵守航行规章,虽然实际上没有同其他船舶发生碰撞,但是使其他船舶以及船上的人员、货物或者其他财产遭受损失的,该航行过失行为上升为碰撞过失,应承担相应的赔偿责任。
 当事船舶协商以不符合航行规则的方式航行,发生碰撞事故后,任何一方仅以对方违反协议约定为由,主张加重对方责任或减轻己方责任,人民法院不予支持。在协议违规航行发生事故的情形下,应以航行规则为基本准则,结合当事船舶的协议内容,在综合分析紧迫局面形成原因及处置措施恰当与否的基础上,对事故责任作出评判。

 【案情】
 原告:江苏顺天海运集团南京顺道航运有限公司(以下简称顺道航运)。
 原告:紫金财产保险股份有限公司江苏分公司(以下简称紫金财保江苏公司)。
 被告:浙江省宁波市沥平航运有限公司(以下简称沥平航运)。
 “顺福”轮船舶所有人为顺道航运,“新洲6”轮船舶所有人为沥平航运。2010年11月29日6点30分,靠泊在龙吴港码头2号泊位的“新洲6”轮向上海吴泾海事处申请离泊出港,6点45分开始解缆,离泊后在码头边掉头出港。7点15分“新洲6”轮掉头完成,由于进口船舶较多,无法向右转向进入出口航道,只能以保持航向的速度缓慢行驶在码头边进口航道上。7点13分,从吴淞口6号锚地起锚进港、计划靠闸港三联供码头的“顺福”轮过徐浦大桥沿进口航道航行进口。嗣后两轮均发现对方并通过VHF互相联系,达成了绿灯会船右舷通过的一致避让意见。“顺福”轮逐渐向左修正航向,并于7点17分开始沿着航道中心线航行,航速约6.5节。7点18分,“新洲6”轮逐步向右修正航向,7点21分,沿航道中心线航行,航速约4节,此时“顺福”轮再次向左修正航向,并于7点23分进入出口航道,沿出口航道上行,航速约5节。7点24分,“顺福”轮大幅度向右转向,并于7点26分回到了进口航道,航速约4节。此时“新洲6”轮航行至白云山船坞上游端附近,并逐步向左修正航向,驶入进口航道,沿进口航道下行,航速约3节。7点27分,“新洲6”轮在进口航道内白云山船坞下游端附近大幅度向右转向,“顺福”轮小幅向右修正航向,之后两轮相距极近距离相向驶过,“新洲6”轮仍未回到出口航道。随后,“顺福”轮采取“停车”、“前进一”、“左满舵”的措施,但主机未见反应,左转缓慢;又采取全速后退措施,船舶仍以约3.5节余速行驶。7点30分,“顺福”轮船艏触碰白云山船坞。事故发生时多云,风力4级左右,能见度不良,小潮汛涨末。
 涉案事故造成“顺福”轮船舶修理费、拖轮费、船期损失、赔偿船坞损失、解缆费、停泊费等各项损失共计人民币1844248.61元,并产生鉴定评估费人民币6万元。
 涉案事故发生后,承保了沿海内河船舶保险的紫金财保江苏公司作为保险人向被保险人顺道航运支付保险赔款人民币1239572元,依法取得代位求偿权。
 两原告诉称,虽然“新洲6”轮并未与“顺福”轮发生直接碰撞,但因“新洲6”轮不遵守航行规章且避让不当,导致“顺福”轮触碰船坞,依据海商法一百七十条规定,应当由“新洲6”轮承担70%的责任。
 被告辩称,“顺福”轮触碰船坞系其自身过错所致,应由该轮承担全部责任;“新洲6”轮未违反航行规章且无操纵不当,即使存在违反航行规章和操纵不当的情况,也与“顺福”轮触碰船坞无关;原告主张的部分损失不合理。
 【审判】
 上海海事法院经审理认为:事故发生在黄浦江水域内,应适用《上海黄浦江通航安全管理规定》(以下简称《规定》)和《1972年国际海上避碰规则》的相关规定。两轮互相发现对方后通过VHF相互联系约定绿灯会船,并分别驶入逆向航道,双方的约定和航行行为违反了《规定》关于船舶各自靠右航行、分道通航的原则,对紧迫局面的形成均有过错。两轮均存在能见度不良情况下疏忽瞭望,未能对所处水域的情况进行有效观察,并对当时的局面和碰撞危险作出充分估计,未能极其谨慎驾驶,违反《规定》达成绿灯会船的合意,未按规定航路航行,未采用安全航速的航行过失。此外,“顺福”轮又再次违反绿灯会船的合意,在航行过程中突然向右转向回到进口航道航行,在紧迫局面下采取避让措施不当,是导致涉案事故的主要原因,应承担70%的责任。“新洲6”轮应承担30%的事故责任。被告系“新洲6”轮的船舶所有人,依据最高人民法院《关于审理船舶碰撞纠纷案件若干问题的规定》,应就涉案事故造成两原告的损失承担赔偿责任。
