1. For a dispute over air passenger transport, a passenger may bring a lawsuit against the actual carrier or the contracting carrier or both the actual carrier and the contracting carrier. Where the sued carrier files a motion to add the other carrier to the proceedings, the court may decide whether to grant the motion according to the actual circumstances of the case. 1.对航空旅客运输实际承运人提起的诉讼,可以选择对实际承运人或缔约承运人提起诉讼,也可以同时对实际承运人和缔约承运人提起诉讼。被诉承运人申请追加另一方承运人参加诉讼的,法院可以根据案件的实际情况决定是否准许。
2. Where a flight is delayed for a force majeure, as a result of which the airline company fails to carry passengers who would connect to other flights to the destination on time, the airline company is obligated to clearly notify passengers of whether endorsement services are provided after they arrive at the destination and how passengers would handle their travelling formalities if the airline company does not provide endorsement services. If the airline company fails to perform such an obligation, causing losses to transit passengers, the airline company should assume the compensatory liability. 2.当不可抗力造成航班延误,致使航空公司不能将换乘其他航班的旅客按时运抵目的地时,航空公司有义务及时向换乘的旅客明确告知到达目的地后是否提供转签服务,以及在不能提供转签服务时旅客如何办理旅行手续。航空公司未履行该项义务,给换乘旅客造成损失的,应当承担赔偿责任。
3. By noting “non-refundable and non-endorsable” on discount air tickets, an airline company only intends to prevent passengers holding discount air tickets from refunding or endorsement for personal reasons, and should not deprive passengers of their right to take the flight and arrive at the destination on time after payment of the ticket fares. 3.航空公司在打折机票上注明“不得退票,不得转签”,只是限制购买打折机票的旅客由于自身原因而不得退票和转签,不能据此剥夺旅客在支付票款后享有的乘坐航班按时抵达目的地的权利。

Basic Facts 基本案情
On December 29, 2004, Abdul Waheed (hereinafter referred to as “Abdul”) purchased an air ticket with Cathay Pacific Airways Limited (Hong Kong) (hereinafter referred to as “Cathay Airways”) as the issuer. The flight schedule listed on the air ticket was as follows: At 11:00 on December 31, 2004, departing from Shanghai for Hong Kong, and at 16:00 on the same day, departing from Hong Kong for Karachi; on January 31, 2005, departing from Karachi for Hong Kong, and on February 1 of the same year, departing from Hong Kong for Shanghai. China Eastern Airlines Co., Ltd. (hereinafter referred to “CE Airlines”) was the actual carrier for the flight between Shanghai and Hong Kong, and Cathay Airways was the actual carrier for the flight between Hong Kong and Karachi. It was stated in clauses on the back of the ticket that this Contract should be governed by the rules and restrictions regarding liabilities as specified in the Warsaw Convention. It was a discount ticket indicating “non-refundable and non-endorsable.” 2004年12月29日,ABDUL WAHEED(阿卜杜勒·瓦希德,以下简称阿卜杜勒)购买了一张由香港国泰航空公司(以下简称国泰航空公司)作为出票人的机票。机票列明的航程安排为:2004年12月31日上午11点,上海起飞至香港,同日16点香港起飞至卡拉奇;2005年1月31日卡拉奇起飞至香港,同年2月1日香港起飞至上海。其中,上海与香港间的航程由中国东方航空股份有限公司(以下简称东方航空公司)实际承运,香港与卡拉奇间的航程由国泰航空公司实际承运。机票背面条款注明,该合同应遵守华沙公约所指定的有关责任的规则和限制。该机票为打折票,机票上注明“不得退票、不得转签”。
At 15:00 on December 30, 2004, moderate snow fell in Shanghai Pudong International Airport, resulting in the forced shutdown of this airport for one hour from 22:00 to 23:00 on the day, and 104 flights were delayed. On December 31, for aircraft deicing, flight rescheduling, and other reasons, 43 flights on that day were cancelled and 142 flights were delayed, with the ratio of airplane departure being only 24.1%. Due to the bad weather, the MU703 flight of CE Airlines was also delayed for three hours and 22 minutes, causing Abdul and his family's failure to catch the connecting flight of Cathay Airways for Karachi after they landed at the Hong Kong Airport. The employees of CE Airlines notified Abdul of only two solutions: Abdul and others would wait at the airport for three days for the next flight of Cathay Airways at their own expenses during the three days; or buy air tickets to Karachi of another airline company with fares of HKD 25,000. Abdul refused to accept these two solutions on the spot, his wife Dulin called CE Airlines, but CE Airlines said that relevant employees were off duty. Dulin could not accept the handling by CE Airlines, and became anxious and emotional because she carried an infant. Finally, after intervention by employees of the Hong Kong Airport, Abdul and his family paid a total of HKD 17,000 for air tickets and luggage fares of Emirates Airlines, and arrived at Karachi via Dubai. For this reason, Abdul paid HKD 4,721 for air ticket fares and HKD 759 for luggage fares, HKD 5,480 in total.

 2004年12月30日下午15时起上海浦东机场下中雪,导致机场于该日22点至23点被迫关闭1小时,该日104个航班延误。31日,因飞机除冰、补班调配等原因,导致该日航班取消43架次、延误142架次,飞机出港正常率只有24.1%。东方航空公司的MU703航班也因为天气原因延误了3小时22分钟,导致阿卜杜勒及其家属到达香港机场后未能赶上国泰航空公司飞卡拉奇的衔接航班。东方航空公司工作人员告知阿卜杜勒只有两种处理方案:其一是阿卜杜勒等人在机场里等候3天,然后搭乘国泰航空公司的下一航班,3天费用自理;其二是阿卜杜勒等人出资,另行购买其他航空公司的机票至卡拉奇,费用为25000港元。阿卜杜勒当即表示无法接受该两种方案,其妻子杜琳打电话给东方航空公司,但该公司称有关工作人员已下班。杜琳对东方航空公司的处理无法接受,且因携带婴儿而焦虑、激动。最终由香港机场工作人员交涉,阿卜杜勒及家属共支付17000港元,购买了阿联酋航空公司的机票及行李票,搭乘该公司航班绕道迪拜,到达卡拉奇。为此,阿卜杜勒支出机票款4721港元、行李票款759港元,共计5480港元。
