Ni Peilu and Wang Ying, the plaintiffs, lodged a lawsuit before the Chaoyang District People's Court of Beijing Municipality against China World Trade Center for the dispute over the infringement on the right of reputation.@#
Two plaintiffs complained that: when they went shopping at Wellcome Supermarket affiliated to China World Trade Center, the defendant, two male employees of the defendant doubted that they had stolen goods from the supermarket, and forced them to untie cloth buttons and open bags for check. The conduct of the defendant's employees was an insult to their dignity, and seriously damaged their reputation. Two plaintiffs asked the court to order the defendant to make an apology and make a compensation for spiritual damage to them.@#

原告倪培璐、王颖因被告中国国际贸易中心(以下称国贸中心)侵害名誉权纠纷一案,向北京市朝阳区人民法院提起诉讼。@#
原告倪培璐、王颖诉称:原告在被告下属的惠康超级市场购物时,被告的两个男服务员怀疑原告偷拿了市场的东西,并迫使原告解开衣扣、打开手提包让其检查。被告的工作人员这种行为,侮辱了原告的人格,严重侵害了原告的名誉。故请求判令被告向原告赔礼道款,并对给原告造成的精神损害予以赔偿。@#
被告国贸中心辩称:被告下属的惠康超级市场规定,市场工作人员有权在收银处检查顾客带进店内的包、袋,该规定以公告形式张贴在市场的入口处,原告进入市场购物,应视为自愿接受该规定。根据法律规定,侵害名誉权行为的构成要件,只有侵权人当众实施侵害行为,使公众对被侵害人的社会评价降低时,才能认为是构成侵害名誉权的行为。被告的工作人员只是在市场内部查看了二原告的提包,询问是否未付款拿了货物,丝毫没有降低公众对二原告的社会评价,因而不构成对二原告名誉权的侵害。认为名誉权受到侵害,只是二原告的自我感觉,并非本案事实。因此,二原告的诉讼请求不能成立,应予驳回。@#
北京市朝阳区人民法院经审理查明:被告国贸中心下属的惠康超级市场,采用开架售货方式,允许进店的顾客自带包、袋,并在市场门口贴的公告称:“收银员受公司指示,对贵客带入铺内之袋(包括胶袋)作必须查看,请将袋打开给收银员过目。”@#
1991年12月23日下午5时许,原告倪培璐、王颖进入惠康超级市场购物,在糖果柜台前停留观看后,又到其他货位选购了一个像架,到收银处交款后走出市场大门。二原告走出大门外五、六米处时,被从市场内追出的理货员傅斌和高德勇叫住。傅、高二人问:“小姐,你们有没有将没交费的东西带出商场?”二原告答:“没拿。”傅、高二人不相信,仍追问:“拿没拿?到底拿没拿?”二原告仍答:“没拿,就是没拿。”傅、高二人将二原告带到市场门口,指着墙上的公告说:“我们有权检查你们的提包”。然后把二原告带进市场办公室。在这里,女职员何静也参加了对二原告的追问。在再三追问下,原告倪培璐流下了眼泪,原告王颖打开自己的手提包、解开外衣扣和摘下帽子让3名职员查看。3名职员没有查到任何属于市场所有的东西,傅斌只得表示:“我是听一位顾客说你们拿了东西,对不起,你们可以走了。”二原告想找市场经理说理,得到的答复是:“经理不在。”@#
