| | 【案情摘要】2000年，唯冠集团旗下的子公司分别在多个国家、地区注册了iPad商标，其中包括唯冠科技（深圳）有限公司（简称深圳唯冠公司）在中国大陆注册的iPad商标。2009年，苹果公司通过IP申请发展有限公司（简称IP公司）与唯冠集团旗下一家子公司——台湾唯冠公司达成协议，约定将iPad商标以3.5万英镑价格转让给苹果公司。2010年4月19日，苹果公司、IP公司向深圳市中级人民法院起诉深圳唯冠公司，主张根据IP公司与台湾唯冠公司签订的《商标转让协议书》及相关证据，请求判令深圳唯冠公司2001年获准在计算机等商品上注册的“IPAD”商标和商标专用权归其所有及判令深圳唯冠公司赔偿其损失400万元。深圳市中级人民法院2011年11月17日作出一审判决，驳回了两原告的诉讼请求。苹果公司、IP公司向广东省高级人民法院提出上诉。广东省高级人民法院最终促成双方以6000万美元达成调解。 |
