In September 1981, the defendant, Kaida Ltd., concluded an agreement with the Investment Promotion Bureau of Shenzhen Special Economic Zone to set up a wholly-owned factory in Shekou Industrial Park which manufactured various plastic toys, with investment capital of 1,600 U.S. dollars and 1,200 employees, and sold them on the international markets. In February 1982, after the company formally commenced production, its moulding workshop generated offensive odor and poisonous gas, which was discharged into the atmosphere without any treatment, irritated the respiratory organs of people and made people short of breath. Meanwhile, the noises generated by the machines were deafening to make people very agitated. Therefore, the enterprises, institutions, government agencies, social groups and residents nearby reported it to the Monitoring Station, and required the government to seriously deal with it.@#

被告凯达公司于一九八一年九月，与深圳特区招商局签订协议，在蛇口工业区独资建厂生产各种塑料玩具，投资一千六百万美元，职工一千二百人，产品畅销国际市场。一九八二年二月，该公司开始正式生产后，浇模车间产生恶臭和有毒气体，未经处理，即向大气排放，呛人喉鼻，使人呼吸困难；同时，机器发出的噪声，震耳欲聋，使人烦躁。对此，附近企事业单位、机关团体、居民纷纷向监测站反映，要求政府严肃处理。@#
原告监测站根据群众的强烈要求，从一九八三年五月初开始，多次督促被告对污染进行治理，并先后聘请广州有关科研单位的专家、教授和技术人员到凯达公司多次进行勘测，提供治理方案，协助治理污染，但被告均未采纳。一九八三年十月二十二日，原告向被告发出限期治理的通知。对此，被告仍未采取有效措施进行治理。在这种情况下，原告于同年十二月二十七日，向深圳市中级人民法院提起诉讼，要求被告对上述噪声和废气进行彻底治理，达到国家规定标准，并支付聘请环保科技人员前来勘测时的有关费用。@#
被告答辩称：一九八三年十月二十二日前，原告从未向我公司提供有关环境污染方面具有法律效力之科学鉴定资料和国家有关标准，却指控我公司在生产中有噪声和排放恶臭，使人困惑不解；要我公司耗费四万美元安装“过滤装置”，更难以接受；原告限我们在一九八三年十二月二十五日前将污染治理好，实在无法办到，而且浇模车间已按限期停止生产。@#
