【裁判摘要】 |
| |
夫妻关系存续期间，双方一致同意利用他人的精子进行人工授精并使女方受孕后，男方反悔，应当征得女方同意。在未能协商一致的情况下男方死亡，其后子女出生，尽管该子女与男方没有血缘关系，仍应视为夫妻双方的婚生子女。男方在遗嘱中不给该子女保留必要的遗产份额，不符合继承法第十九条规定，该部分遗嘱内容无效。 |

原告李雪花诉称：位于南京市安居里的306室房屋一套，是原告李雪花与被继承人范顺祥的夫妻共同财产。范顺祥因病死亡后，原告范洋出生。范顺祥的遗产，应当由妻子李雪花、儿子范洋与范顺祥的父母即被告范祖业、滕颖等法定继承人共同继承。原告多次与被告协商分割遗产，均未达成一致意见，请求法院解决这一析产继承纠纷。在析产时，应当考虑范祖业、滕颖有自己房产并有退休工资，而李雪花无固定收入还要抚养幼子的具体情况，对李雪花和范洋给予照顾。 |
| Li Xuehua claimed that: the premise located at Room 306, Anjuli, Qinhuai District, Nanjing City was a community property owned by Li Xuehua and the decedent Fan Shunxiang. After Fan Shunxiang died of illness, Fan Yang was born. Fan Shunxiang's legacy shall be co-inherited by his legal heirs, namely his wife Li Xuehua, his son Fan Yang, and his parents, the defendants of in this case, Fan Zuye and Teng Ying. After negotiating with the defendants on the partition of the legacy on many occasions but without reaching a consensus, the plaintiffs pleaded the court to settle the dispute over legacy allotment partitioning. In allotting partitioning the legacy, the court shall give considerations to Li Xuehua and Fan Yang as Fan Zuye and Teng Ying had their own premise and retired wages pensions, while Li Xuehua had no fixed income and had to raise her young son. | |

被告范祖业、滕颖辩称：首先，安居里 306室是范家私房被拆迁后，政府安置给范家的公房；这套房屋虽以范顺祥的名义购买，但购买时二被告还出资1万元，占总购房款的2／3，故此房不是范顺祥、李雪花的夫妻共同财产，而是范家家产，二被告起码对该房享有2／3产权。其次，范顺祥生前留下遗嘱，明确将安居里306室赠予二被告，故对该房产不适用法定继承。第三，李雪花所生的孩子与范顺祥不存在血缘关系；这个孩子虽然是范顺祥签字同意通过人工授精的方式怀孕的，但范顺祥在得知自己患了癌症后，已经向李雪花表示过不要这个孩子，其时做人工流产为时不晚；李雪花坚持要生下这个孩子，当然应该由李雪花对这个孩子负责；范顺祥在遗嘱中声明他不要这个人工授精生下的孩子，该意愿应当得到尊重，故不能将这个孩子列为范顺祥的继承人。第四，李雪花声称是范顺祥的妻子，但在范顺祥病危期间，却不拿钱给范顺祥看病，不尽夫妻扶养义务，故无权继承范顺祥遗留的房产，该房产应按范顺祥的遗嘱进行处分。第五，范顺祥生前为开店经营，曾经向滕颖借款8500元；范顺祥死亡时，留下大笔存款被李雪花占有；李雪花只提继承房产，却不将其占有的存款拿出来分割和偿还范顺祥的债务，是不公平的；应当用范顺祥遗留的存款清偿范顺祥遗留的债务，其余按法定继承处理。 |
Fan Zuye and Teng Ying defended that: firstly, the premise located at Room 306, Anjuli was a public housing property allocated by the government to Fan family after their private house was demolished; although this premise was purchased in the name of Fan Shunxiang, the two defendants contributed 10,000 yuan in purchasing, which constituted 2/3 of the total purchasing money, so this premise was not a community property owned by Fan Shunxiang and Li Xuehua, but a family property of the Fans family, the two defendants enjoyed at least 2/3 of the property right. Secondly, according to Fan Shunxiang's will, it expressly granted Room 306, Anjuli to the two defendants, so legal inheritance did should not apply to this house property. Thirdly, there was no blood lineage between the child given birth by Li Xuehua and Fan Shunxiang; this child was given birth by means of artificial insemination upon the signature and consent of Fan Shunxiang, but Fan Shunxiang indicated to Li Xuehua that he did not want to have this baby after he knew he had cancer, it was not too late for induced abortion, while Li Xuehua insisted on giving birth to this child, so certainly, she Li Xuehua shall certainly be held responsible for this child.; In addition, Fan Shunxiang claimed in his will that he refused to accept this child who was born through artificial insemination, this will shall be respected, so this child shall not be listed as a heir of Fan Shunxiang. 4. Although Li Xuehua claimed that she was Fan Shunxiang's wife, she refused to contribute money to treat Fan Shunxiang's illness, which means that she failed to perform her duty of maintenance, thus she was not entitled to inheriting the premise left behind by Fan Shunxiang, which shall be disposed of according to Fan Shunxiang's will. 5. Before his death, Fan Shunxiang once borrowed 8500 yuan from Teng Ying to open start a business,; while after his death, Li Xuehua possessed a large sum of deposit left behind by Fan Shunxiang; it was unfair that for her to Li Xuehua only mentioned the inheritance of the premise, while did not and refuse to take out the deposit she possessed for partition and to repay Fan Shunxiang' s debts; the deposit left behind by Fan Shunxiang shall be used to pay off his debts, and the rest shall be disposed of in accordance with the principle of legal inheritance. | |

Now I have a deposit of about 60,000 yuan at the Agricultural Bank of China, after my death, half of my deposit, namely 30,000 yuan, shall be inherited by my mother. | |

关于第一个问题，原告李雪花称：购房缴款单、票据、欠条和收条等证明，购房款 14582．16元是范顺祥一个人交付的，其中 1万元是向二被告借的款，不是与二被告共同出资购房；范顺祥死亡后，所借购房款已由我给二被告归还，二被告也接受了此款，现在又主张共同出资购房，没有事实根据。被告范祖业、滕颖辩称：范顺祥的自书遗嘱和代书遗嘱均证实，房屋是共同出资购买的；后来在派出所解决纠纷时，为尊重派出所的调解意见，二被告才收下原告给付的款项；这样做是为解决矛盾，不代表承认借款事实成立。法庭认为：欠条、收条证明借款事实存在，且借款已在二被告追索下返还。范顺祥在自书遗嘱、代书遗嘱中称，购房款1．5万元全部由其母滕颖出资，既与欠条和收条证明借款1万元的事实不符，也与范祖业、滕颖关于其出资1万元共同购房的主张不符；况且代书遗嘱不仅将继承房产的房号错写为安居里305室，还存在着不是两个以上见证人在场见证，由其中一人代书，并由代书人、其他见证人和遗嘱人签名的问题，不符合《中华人民共和国继承法》(以下简称继承法)第十七条第三款关于代书遗嘱形式要件的规定，不能作为证据使用。
