 再审申请人(一审原告、二审上诉人):善巴依,蒙古族。
 被申请人(一审被告、二审上诉人):张振华,汉族。
 被申请人(一审被告、二审上诉人):赵芳。
 被申请人(一审被告、二审上诉人):徐建疆(曾用名徐建江),汉族。
 被申请人(一审被告、二审上诉人):邱建兰,汉族。
 被申请人(一审第三人、二审上诉人):吴芳,汉族。
 被申请人(一审被告、二审被上诉人):古丽先,维吾尔族。
 再审申请人博尔塔拉蒙古自治州机动车辆交易中心(以下简称博州机动车交易中心)、善巴依为与被申请人张振华、赵芳、徐建疆、邱建兰、吴芳、古丽先所有权确认纠纷一案,不服新疆维吾尔自治区高级人民法院(2014)新民一终字第186号民事判决,向本院申请再审。本院依法组成合议庭对本案进行了审查,现已审查终结。
 博州机动车交易中心申请再审称:一、原审认定博州机动车交易中心所支付的7万元为垫付资金,据此认为博州机动车交易中心不属于涉案房屋的权利人,不能获得补偿,缺乏证据证明。垫付应是双方的合意,并应偿还垫付款。本案中,既没有双方垫付的合意的表示,也没有自1999年“垫付”至今向“垫付人”偿还的任何表示。二、张振华、古丽先、赵芳、徐建疆已将其在涉案房屋中一万元份额转让给博州机动车交易中心。博州机动车交易中心已根据2003年5月22日签订的《房屋购买金入股协议》,将上列当事人价值一万元的份额转换为货币,作为其在博州善兴旧机动车鉴定估价所有限公司(以下简称善兴公司)的出资。由博州机动车交易中心按对价给付货币作为其他公司的出资,其行为未违反法律规定,合法有效,原审不予认可没有事实和法律依据。三、所涉房屋购买价13万元,当事人只给付了6万元,现房屋拆迁补偿款为2483424元,当事人对其金额全部均分违背了公平原则,侵害了博州机动车交易中心的合法权益。四、本案第三人吴芳是否为所涉房屋权利人,是否将其份额转让,如侵害其权利,应在诉讼时效期限依据法律规定和相关司法解释处理,但原审法院却径直认定吴芳应分得同等份额,该认定不符合事实和法律规定。五、上列当事人购得涉案房屋后,博州机动车交易中心对屋内附属物及后院停车场进行了投资,其评估的202005.72元上列被申请人无权进行分配。现根据《中华人民共和国民事诉讼法》第二百条第二项的规定申请再审。
