Defendant: Chen Kaihua, male, 28-year-old, farmer of Wuqiao Village of Buwen Town of Longhai County, Fujian Province, and arrested on April 25th, 1991.@#
The People's Procuratorate of Longhai County, Fujian Province instituted a public prosecution with the People's Court of Longhai County against Chen Kaihua for the crime of indecent assault. Upon public hearing, the People's Court of Longhai County found that:@#
In the morning of April 7th, 1991, Chen Kaihua bringing along 10,700 yuan went to Chen Shucong's home located at Shima Town of Longhai County by car to repay the money loaned from Chen Shucong, his uncle. For dealing with any unexpected incident, Chen Kaihua carried with a powder shotgun refitted from a starting gun. At about 3:00pm, Chen Kaihua left Chen Shucong's home after drinking, and took a bus of Longhai Yufa Auto Transportation Company (car number: 35-90542) to go home. There were about 20 passengers on the bus. Before long after the bus left Shima Town, Chen Kaihua wanted to find Lin at Baituchang of Wuqiao Village to settle the dispute over digging kaolin clay. An evil thought of hijacking the bus to Wuqiao Village suddenly occurred to him. So Chen Kaihua went to behind the driver, took out the powder shotgun made by himself, put it against the driver's back brain and shouted that “Drive wherever I tell you, or I will shoot you!” The driver was forced to keep driving. But when it arrived at Xixi section, a passenger wanted to get off, so the driver stopped the bus and let the passenger get off. Chen Kaihua threatened the driver again “No more stop.” The driver drove the bus along the national highway Fu-Zhang Road till the crossroad leading to Tianzhai Village, Chen Kaihua asked the driver to change the direction and turned to an alley leading to Tianzhai Village. Before long, they saw a hand tractor standing right in the middle of the road. Chen Kaihua jumped out of the bus and got the hand tractor out of the way. The bus kept moving along the alley, but then a big truck for agricultural use blocked the way. After giving 10 yuan to the booking clerk of the bus he was in and telling the latter to take it as the gasoline fee, Chen Kaihua got off the bus and asked the big truck to get off the way. Seeing Chen Kaihua went to the corner with the big truck, which was a litter distant from the bus, the driver made a u-turn and drove the bus away. Chen Kaihua did not chase behind the bus after finding out the situation. Chen Kaihua didn't find Lin at Baituchang, so he went home alone. While the driver of the bus reported the case to the public security organ immediately after he got rid of Chen Kaihua.@#

陈开华以劫持汽车的危险方法危害交通安全案@#

被告人：陈开华，男，２８岁，福建省龙海县步文乡梧桥村农民。１９９１年４月２５日被逮捕。@#
福建省龙海县人民检察院以被告人陈开华犯流氓罪，向龙海县人民法院提起公诉。龙海县人民法院经公开审理查明：@#
１９９１年４月７日上午，被告人陈开华身带现金１．０７万元，乘汽车前往龙海县石码镇向其伯父陈树枞偿还借款。为防路遇不测，陈开华随身携带自己用体育发令枪改制的火药枪一支。下午３时许，陈开华于酒后离开陈树枞家，乘龙海县裕发汽车运输公司的公共汽车（车号３５－９０５４２）返家，当时车上有乘客２０余人。客车驶出石码镇后不久，陈开华想到梧桥许坑村白土场找林某解决因挖高岭土而产生的纠纷，即萌生劫持客车到该村的邪念。于是，陈开华在客车驾驶员背后，掏出携带的自制火药枪，对准驾驶员的后脑部命令道：“叫你开到哪，你就开到哪，否则就开枪！”驾驶员在陈开华持枪威逼下，继续开车前行。当客车行驶到西溪地段时，一乘客要下车，驾驶员遂踩刹车让该乘客下了车。陈开华又威胁驾驶员：“不能再停车！”。客车沿国道福－－漳公路继续行驶至通往天宅村的路口时，陈开华令驾驶员改变方向，拐进天宅村小路。当客车拐进小路不久，遇一手扶拖拉机阻路，陈开华跳下车叫手扶拖拉机让开。客车沿小路继续行进，又遇一农用大车挡住去路。陈开华见状，便从身上掏出１０元人民币给售票员，说是做为汽油费，遂又下车叫农用大车让路。客车驾驶员见陈开华随农用大车转到拐弯处，且已离客车有一段距离，便乘机将客车调头开走。陈开华见客车朝相反方向开走，未再追赶。陈开华后因去白土场没有找到林某，便独自回家。客车驾驶员将车开走后即向当地公安机关报案。@#
当晚，被告人陈开华发现公安人员在追捕他，即外逃隐匿。当月１５日，陈开华在其亲属带领下到公安机关投案自首，并交出了作案时用的火药枪。@#
上述事实，有被劫持汽车的驾驶员、售票员的报案笔录，陈开华投案笔录、上缴的作案作案用的自制火药枪及证人证言证实。@#

龙海县人民法院认为：被告人陈开华明知持枪胁迫驾驶员，会给驾驶员造成严重的心理恐慌，从而可能引发行车事故，却对车上乘客的生命及财产安全采取放任不管的态度，持枪劫持正在行驶中的公共汽车，其行为危害的是公共安全，已构成犯罪，应予惩处。公诉人指控陈开华犯流氓罪不妥。陈开华的犯罪行为，在《中华人民共和国刑法》分则中没有明文规定，依照刑法第七十九条的规定，适用类推比照分则中最相类似的条文定罪判刑。陈开华犯罪行为所侵害的对象是交通工具，这与刑法第一百零七条规定的破坏交通工具罪最相类似，因此应当比照该条定罪量刑。据此，龙海县人民法院于１９９１年８月２２日判决：被告人陈开华犯劫持汽车罪，判处有期徒刑三年。@#
被告人陈开华不服第一审判决，以有投案自首情节为由，提出上诉，要求从轻判处。@#
