He Yuantang et al. operated a clam farm of 312 mu located in the Gaosha waters of Hougang River Outlet in Xichang Township, Hepu County. In the middle of November 2003, a large number of clams of He Yuantang et al. started to die. According to the monitoring results of the North China Sea Environmental Monitoring Center on November 25, the sewage discharged by Guangxi Hepu Xichang Yongxin Sugar Co., Ltd. (hereinafter referred to as “Yongxin Sugar Company”) seriously exceeded the prescribed discharge standard. On January 8, 2004, the Fishery Environment Monitoring Center of Guangxi Zhuang Autonomous Region issued a Written Report on Investigation and Authentication of the Fishery Pollution Accident, according to which the waters involved were polluted by foreign pollutants. According to the Conclusion on the Pollution Accident of Clam Breeding in Xichang Township, Hepu County, Guangxi as issued on May 10 of the same year by the Fishery Affairs Office of the Bureau of Aquatic Products of Guangxi Zhuang Autonomous Region, in November 2003, the deaths of clams in the farm located in Xichang Township, Hepu County were caused by the discharge of sewage that seriously exceeded the prescribed national discharge standard by Yongxin Sugar Company. 2,118,000 kilos of clams died, with the direct economic losses of no less than 9,319,200 yuan. Therefore, He Yuantang et al. instituted a lawsuit in the Beihai Maritime Court. The Court found that He Yuantang et al. had no aquaculture certificate and their waters use license has also been expired.
．．．．．． | | 何远堂等人合伙经营位于合浦县西场镇鲎港江出海口高沙海域的312亩文蛤养殖场。2003年11月中旬何远堂等人的文蛤大量死亡。11月25日，北海环境监测中心监测结果显示：广西合浦西场永鑫糖业有限公司（以下简称永鑫糖业公司）排放的污水严重超标。2004年1月8日，广西壮族自治区渔业环境监测中心作出《渔业污染事故调查鉴定报告书》表明涉案海域受到了外来污染物的污染。同年5月10日广西壮族自治区水产局渔政处所作《广西合浦县西场镇养殖文蛤受污染事件结论》认为，2003年11月期间，合浦县西场镇文蛤养殖场文蛤死亡原因系永鑫糖业公司排放严重超过国家规定排放标准的污水所致，造成文蛤死亡损失2118000公斤，直接经济损失不低于9319200元。何远堂等人据此向北海海事法院提起诉讼。法院查明，何远堂等人没有养殖证，且海域使用许可证也已过期。
