| In the first half of 2004, without the environmental impact assessment of the administrative department of environmental protection and the project initiation approval of the administrative department of construction, Jiangyin Port Container Company (hereinafter referred to as “Container Company”) added the unloading operation of iron ore (powder) commodity. In the operation process, Container Company adopted the method of outdoor unloading, which caused the direct intrusion of iron ore dust into the residences of nearby residents; and the Container Company adopted the method of flushing to dispose of red dust scattering on the roads inside and outside the port area, and directly discharged the wastewater generated in the flushing into surrounding river courses and the Yangtze River. Such wastewater deposited in the river courses, caused air pollution and water pollution in the surrounding environment, and seriously affected the air quality of surrounding areas, the water quality of the Yangtze River, and the living environment of nearby residents. Zhu Zhengmao and nearby residents have reported this situation, the People's Government of Jiangyin City has held coordination meetings, and the Container Company has also adopted rectification measures, but the pollution phenomena still failed to be thoroughly eliminated. On July 6, 2009, Zhu Zhengmao, as the representative of nearby residents, and the All-China Environment Federation jointly instituted a lawsuit and requested the court to order that the Container Company should stop the infringement, make the atmospheric environment conform to the prescribed environmental standards, and eliminate obstacles; deal with flushing of iron ore dust and eliminate hazards to drinking water sources and water intakes; and restore sewers near the port to the original state and conduct hazard-free treatment of iron ore powder mud. On the next day after this case was accepted and heard, the Intermediate People's Court of Wuxi City (hereinafter referred to as the “IPC of Wuxi City”) conducted an on-spot inspection, made a ruling to order that defendant should immediately stop its pollution infringement, issued letters to the Office of Legislative Affairs of the People's Government of Wuxi City and the People's Government of Jiangyin City, and obtained the cooperation and support of government departments. In addition, the IPC of Wuxi City convened a hearing and ordered that the Container Company should adopt feasible schemes and measures before this case was closed and rapidly improve the environmental quality status. Based thereon, the Container Company adopted rectification measures again and raised an application for mediation in the hearing of this case. | | 2004年上半年，江阴港集装箱公司（以下简称集装箱公司）未经环境保护行政主管部门环境影响评价和建设行政主管部门立项审批，自行增设铁矿石（粉）货种接卸作业。在作业过程中，该公司采用露天接卸，造成了铁矿石粉尘直接侵入周边居民住宅；采用冲洗方式处理散落在港区路面和港口外道路上的红色粉尘，形成的污水直接排入到周边河道和长江水域，并在河道中积淀，造成了周边环境大气污染、水污染，严重影响了周边地区空气质量、长江水质和附近居民的生活环境。虽经朱正茂等周边居民反映情况、江阴市人民政府召开协调会议，集装箱公司亦采取了整改措施，但仍未彻底消除污染现象。2009年7月6日，朱正茂作为周边居民代表与中华环保联合会共同提起诉讼，请求判令集装箱公司停止侵害，使港口周围的大气环境符合环境标准，排除妨碍；对铁矿粉冲洗进行处理，消除对饮用水源地和取水口产生的危险；将港口附近的下水道恢复原状，铁矿粉泥做无害化处理。江苏省无锡市中级人民法院（以下简称无锡中院）于受理本案的次日，进行了现场勘验，裁定责令被告立即停止污染侵害行为，并向无锡市人民政府法制办公室、江阴市人民政府发函，取得政府部门的配合和支持。该院还召集听证，责成集装箱公司在案件审结前采取切实可行的方案和措施，迅速改善环境质量状态。集装箱公司据此再次采取整改措施，并在审理过程中提出调解申请。 |
