The Measures for the Administration of Qualifications of the Enterprises Undertaking Foreign Aid Materials Projects, as deliberated and adopted at the 48th executive meeting of the Ministry of Commerce on March 14, 2011, are hereby issued and shall come into force on July 15, 2011. The Measures for the Accreditation of Qualifications of the Enterprises Undertaking Foreign Aid Materials Projects (for Trial Implementation) (Order No. 10 [2004] of the Ministry of Commerce) shall be abolished simultaneously. | |
《对外援助物资项目实施企业资格管理办法》已经2011年3月14日商务部第48次部务会议审议通过，现予公布，自2011年7月15日起施行。《对外援助物资项目实施企业资格认定办法（试行）》（商务部2004年第10号令）同时废止。 |

| Chapter I General Provisions | | 第一章 总 则 |

| Article 1 These Measures are formulated in accordance with the Decision of the State Council on Establishing Administrative Licenses for the Administrative Examination and Approval Items Really Necessary to Be Retained to regulate the administration of qualifications of the enterprises undertaking foreign aid materials projects. | | 第一条 为规范对外援助物资项目实施企业资格管理，根据《国务院对确需保留的行政审批项目设定行政许可的决定》，制定本办法。 |

| Article 2 The term “foreign aid materials projects” as mentioned in these Measures (hereinafter referred to as the “FAMP”) shall refer to the projects which are undertaken by the enterprises selected by the Chinese Government to provide production and living materials to the aided country for the purpose of gratuitous aid, interest-free loans, low-interest loans or other special aid funds granted by the Chinese Government. | | 第二条 本办法所称的对外援助物资项目（以下简称援外物资项目），是指在中国政府提供的无偿援助、无息或低息贷款和其他专项援助资金项下，由中国政府选定的企业向受援国提供生产、生活物资的项目。 |

| Article 3 The Ministry of Commerce shall be responsible for the qualifications administration of the enterprises undertaking FAMP. | | 第三条 商务部负责援外物资项目实施企业资格管理。 |
The competent commerce departments of all provinces, autonomous regions, municipalities directly under the Central Government, cities under separate state planning and Xinjiang Production and Construction Corps (hereinafter referred to as the “provincial commerce departments”) shall, according to these Measures, conduct the accreditation of qualifications of the enterprises undertaking FAMP and the preliminary examination thereof. | |
省、自治区、直辖市、计划单列市及新疆生产建设兵团商务主管部门（以下简称省级商务主管部门）根据本办法规定，承担援外物资项目实施企业资格认定和核验的初核工作。 |

| Article 4 An enterprise shall apply for the qualification to undertake FAMP in accordance with the qualification requirements and procedures as prescribed by these Measures, and undertake FAMP within the scope of the qualification. | | 第四条 企业应当按照本办法规定的资格条件和程序申请援外物资项目实施企业资格，并在资格许可的范围内承担援外物资项目实施任务。 |
The implementation of FAMP shall refer to the organization of goods in FMAP and the delivery thereof to the places designated by the aided country and the provision of other necessary services. | |
援外物资项目实施任务是指负责援外物资项目组货并运送至受援国指定地点及提供其他必要的服务。 |

| Chapter II Qualification Grades and Conditions | | 第二章 资格等级和条件 |
| |
|
| Article 5 The qualifications of the enterprises undertaking FAMP shall be classified into Grade A and Grade B according to the qualifications prescribed by these Measures. | | 第五条 援外物资项目实施企业资格按照本办法规定的资格条件，设置A级和B级两个资格等级。 |
An enterprise obtaining the qualification of a Grade A enterprise undertaking FAMP may undertake the projects prescribed in subparagraph 1 of Article 22 of the Measures for the Administration of Foreign Aid Materials Projects. | |
取得A级援外物资项目实施企业资格的企业可以承担《对外援助物资项目管理办法》第二十二条第（一）项规定的项目。 |
An enterprise obtaining the qualification of a Grade B enterprise undertaking FAMP may only undertake the FAMP with an amount of less than 10 million yuan as prescribed in subparagraph 1 of Article 22 of the Measures for the Administration of Foreign Aid Materials Projects. The Ministry of Commerce may adjust the aforesaid limit according to the work requirements and publish it in the form of announcement. | |
取得B级援外物资项目实施企业资格的企业只可以承担《对外援助物资项目管理办法》第二十二条第（一）项规定的金额在1000万元人民币以下的项目。根据工作需要，商务部可以对上述限额进行调整，并以公告形式公布。 |

| Article 6 An enterprise applying for the qualification of a Grade A enterprise undertaking FAMP shall concurrently meet the following conditions: | | 第六条 申请A级援外物资项目实施企业资格的企业应当同时具备以下条件： |
| |
|
| 1. It is a legal person enterprise established within China according to the law of the People's Republic of China; | | （一）依照中华人民共和国法律在中国境内设立的企业法人； |
| |
|
| 2. All capital contributors are Chinese investors; | | （二）所有出资人均为中国投资者； |
| |
|
3. It is a foreign trade operator meeting the provisions of the Foreign Trade Law | | （三）系符合《对外贸易法》规定的对外贸易经营者； |
| |
|
| 4. Its registered capital is more than 50 million yuan; | | （四）注册资本在5000万元人民币以上； |
| |
|
| 5. It is profitable during the last two consecutive years; | | （五）前2年连续盈利； |
| |
|
| 6. It has not been given any criminal punishment or administrative punishment due to engagement in illegal business activities or serious violation of the relevant provisions on the administration of foreign aid in the last two years; | | （六）前2年内未受过刑事处罚、未因进行非法经营活动或严重违反有关对外援助管理规定受过行政处罚； |
| |
|
| 7. The average annual total amount of import and export completed in cargo trade is not less than 100 million US dollars in the last two years, or the average annual amount under FAMP contracts is not less than 10 million yuan and the average annual total amount of import and export completed in cargo trade is not less than 80 million US dollars in the last two years; | | （七）前2年年均完成货物贸易进出口总额不低于1亿美元，或前2年承担援外物资项目合同金额年均不低于1000万元人民币且年均完成货物贸易进出口总额不低于8000万美元； |

| 8. It has good business reputation and sound financial rules; and | | （八）具有良好的商业信誉和健全的财务制度； |
| |
|
| 9. It has paid taxes and social insurance premiums according to law. | | （九）依法纳税和缴纳社会保险费。 |
| |
|
| Article 7 An enterprise applying for the qualification of a Grade B enterprise undertaking FAMP shall concurrently meet the following conditions: | | 第七条 申请B级援外物资项目实施企业资格的企业应当同时具备以下条件： |
| |
|
| 1. It is a legal person enterprise established within China according to the law of the People's Republic of China; | | （一）依照中华人民共和国法律在中国境内设立的企业法人； |
| |
|
| 2. All capital contributors are Chinese investors; | | （二）所有出资人均为中国投资者； |
| |
|
| 3. It is a foreign trade operator that meets the provisions of the Foreign Trade Law; | | （三）系符合《对外贸易法》规定的对外贸易经营者； |
| |
|
| 4. Its registered capital is more than 10 million yuan; | | （四）注册资本在1000万元人民币以上； |
| |
|
| 5. It is profitable during the last two consecutive years; | | （五）前2年连续盈利； |
| |
|
| 6. It has not been given any criminal punishment or administrative punishment due to engagement in illegal business activities or serious violation of the relevant provisions on the administration of foreign aid in the last two years; | | （六）前2年内未受过刑事处罚、未因进行非法经营活动或严重违反有关对外援助管理规定受过行政处罚； |

| 7. The average annual total amount of import and export completed in cargo trade is not less than 50 million US dollars in the last two years, or the average annual amount under FAMP contracts is not less than 5 million yuan and the average annual total amount of import and export completed in cargo trade is not less than 30 million US dollars in the last two years; | | （七）前2年年均完成货物贸易进出口总额不低于5000万美元，或前2年承担援外物资项目合同金额年均不低于500万元人民币且年均完成货物贸易进出口总额不低于3000万美元； |

| 8. It has good business reputation and sound financial rules; and | | （八）具有良好的商业信誉和健全的财务制度； |
| |
|
| 9. It has paid taxes and social insurance premiums according to law. | | （九）依法纳税和缴纳社会保险费。 |
| |
|
| Chapter III Qualification Accreditation | | 第三章 资格认定 |
| |
|
| Article 8 A central enterprise or an enterprise registered at the industrial and commercial administration of the State Council shall apply to the Ministry of Commerce for the qualification to undertake FAMP. | | 第八条 中央企业和其他在国务院工商行政管理机构登记的企业，向商务部申请援外物资项目实施企业资格。 |
An enterprise not prescribed in the aforesaid provisions shall submit its application documents to the local provincial commerce department. An enterprise affiliated to a central enterprise may, after obtaining the approval of the central enterprise, directly apply to the Ministry of Commerce for the qualification to undertake FAMP. | |
除前款规定外的企业向所在地省级商务主管部门提交申请文件。中央企业下属企业在取得中央企业同意后，可直接向商务部申请援外物资项目实施企业资格。 |

| Article 9 An enterprise shall provide the following application documents when applying for the qualification: | | 第九条 企业申请时应当提供以下资格申请文件： |

|
| 1. an application letter and a table of the information on the applicant enterprise; | | （一）申请函和申请企业情况一览表； |
| |
|
2. the business license of the legal person enterprise (photocopy), and identity certificates of the legal representative and main business managers;
