According to the data on the national average annual pay for an urban employee in the non-private sector in 2018 released by the National Bureau of Statistics on May 14, 2019, the average annual pay for an urban employee in the non-private sector was CNY 82, 461 in 2018. Based on the formula provided by the Ministry of Human Resources and Social Security for the calculation of average daily pay, the average daily pay is CNY 82, 461/12(months)/ 21.75 (number of paid days per month) = CNY 315.94. Therefore, in accordance with Article 33 of the State Compensation Law of the People's Republic of China and Article 21 (2) of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in the Handling of Cases regarding Criminal Compensation, the people's courts at all levels shall determine the daily compensation for infringement upon a citizen's personal freedom as CNY 315.94 when making state compensation decisions from May 15, 2019.
