| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 In order to implement the requirements of the judicial responsibility system of people's procuratorates, improve the guidance and decision-making mechanism for people's procuratorates' handling of cases, and regulate the work of request for instructions on the handling of cases by people's procuratorates, these Provisions are developed in accordance with the relevant laws, judicial interpretations, and provisions on the procuratorial work. | | 第一条 为了落实人民检察院司法责任制要求，完善人民检察院司法办案指导决策机制，规范人民检察院案件请示办理工作，根据有关法律、司法解释和检察工作规定，制定本规定。 |
| Article 2 Where, in the handling of a specific case, it is difficult for the people's procuratorate at a lower level to make a decision on actually major, difficult, and complicated problems involved in terms of application of law, case-handling procedure, and judicial policies upon research, the people's procuratorate at a lower level shall request for instructions to the people's procuratorate at a higher level. | | 第二条 下级人民检察院在办理具体案件时，对涉及法律适用、办案程序、司法政策等方面确属重大疑难复杂的问题，经本级人民检察院研究难以决定的，应当向上级人民检察院请示。 |
| Where the people's procuratorate at a higher level deems it indeed necessary, it shall require the people's procuratorate at a lower level to report the relevant information. | | 上级人民检察院认为必要时，可以要求下级人民检察院报告有关情况。 |
| Article 3 The people's procuratorates at all levels shall independently undertake the case-handling responsibilities for the determination of case facts and admissibility of evidence and the people's procuratorate at a lower level may not request for instructions on the determination of specific case facts to the people's procuratorate at a higher level. | | 第三条 各级人民检察院依法对案件事实认定、证据采信独立承担办案责任，下级人民检察院不得就具体案件的事实认定问题向上级人民检察院请示。 |

| Article 4 Where the people's procuratorate at a lower level requests for instructions to the people's procuratorate at a higher level in accordance with Article 2 of these Provisions, the request shall be decided upon deliberation by the procuratorial committee of the people's procuratorate at a lower level. | | 第四条 下级人民检察院依据本规定第二条向上级人民检察院请示的，应当经本院检察委员会审议决定。 |
| Where the people's procuratorate at a lower level decides to request for instructions to the people's procuratorate at a higher level without deliberation by its procuratorial committee, the people's procuratorate at a higher level may not accept such request. | | 下级人民检察院未经本院检察委员会审议决定向上级人民检察院请示的，上级人民检察院不予受理。 |
| Article 5 The request for instructions on case handling shall follow the principle of level-by-level request for instructions. For any major and urgent emergency case, where the people's procuratorate at a lower level must request for instructions, it shall state reasons; and if the people's procuratorate at a higher level accepting the request holds that such reasons are untenable, it shall require the people's procuratorate at a lower level to request for instructions level by level. | | 第五条 案件请示应当遵循逐级请示原则。对重大紧急的突发案件，下级人民检察院必须越级请示的，应当说明理由，接受请示的上级人民检察院认为理由不能成立的，应当要求其逐级请示。 |
| For a case on which the people's procuratorate at a lower level requests for instructions, upon deliberation and decision of the procuratorial committee of the people's procuratorate at a higher level, the people's procuratorate at a higher level may request for instructions level by level to the people's procuratorate at the next higher level. | | 上级人民检察院对下级人民检察院请示的案件，经本院检察委员会审议决定，可以逐级向更高层级人民检察院请示。 |
| Article 6 The people's procuratorate at a lower level shall request for instructions to the people's procuratorate at a higher level in the name of the people's procuratorate at a lower level. | | 第六条 下级人民检察院应当以院名义向上级人民检察院请示。 |
| Where the business department of the people's procuratorate at a lower level requests for instructions to the counterpart business department of the people's procuratorate at a higher level and the business department of the people's procuratorate at a higher level holds that the matter under the request for instructions is major, difficult, and complicated, the business department of people's procuratorate at a higher level shall require that the business department of the people's procuratorate at a lower level should submit the request to its procuratorial committee for deliberation and request for instructions in the name of the people's procuratorate at a lower level. | | 下级人民检察院业务部门向上级人民检察院对口业务部门请示，上级人民检察院业务部门认为请示问题属于重大疑难复杂的，应当要求下级人民检察院业务部门报请本院检察委员会讨论后，以院名义请示。 |
| Article 7 The people's procuratorate at a lower level shall request for instructions on the handling of a case in writing. The request document shall include the following: | | 第七条 下级人民检察院请示案件，应当以书面形式提出。请示文书包括以下内容： |
