| This Interpretation is developed in accordance with the provisions of the Criminal Law of the People's Republic of China and the Criminal Procedure Law of the People's Republic of China for the purposes of legally punishing smuggling, illegal operation, and illegal use of stimulants, maintaining fair competition in sports competitions, and protecting sports participants' physical and psychological health. | | 为依法惩治走私、非法经营、非法使用兴奋剂犯罪，维护体育竞赛的公平竞争，保护体育运动参加者的身心健康，根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》的规定，制定本解释。 |
| Article 1 An athlete or athlete auxiliary who smuggles substances as listed in the catalogue of stimulants, or any other person who smuggles substances as listed in the catalogue of stimulants for the purpose of illegally using such substances in sports competitions, if the substances involved are goods or articles the export and import of which are prohibited by the Chinese government and fall under any of the following circumstances, shall be convicted and punished for the crime of smuggling goods or articles the export and import of which are prohibited by the Chinese government in accordance with the provisions of paragraph 3 of Article 151 of the Criminal Law: | | 第一条 运动员、运动员辅助人员走私兴奋剂目录所列物质，或者其他人员以在体育竞赛中非法使用为目的走私兴奋剂目录所列物质，涉案物质属于国家禁止进出口的货物、物品，具有下列情形之一的，应当依照刑法第一百五十一条第三款的规定，以走私国家禁止进出口的货物、物品罪定罪处罚： |
| (1) Smuggles the aforesaid substances again after having been given not less than two administrative penalties within one year for smuggling. | | （一）一年内曾因走私被给予二次以上行政处罚后又走私的； |
| (2) Uses or intends to use the aforesaid substances on juvenile athletes or disabled athletes. | | （二）用于或者准备用于未成年人运动员、残疾人运动员的； |
| (3) Uses or intends to use the aforesaid substances in major domestic or international sports competitions. | | （三）用于或者准备用于国内、国际重大体育竞赛的； |
| (4) Other circumstances causing serious and execrable social impacts. | | （四）其他造成严重恶劣社会影响的情形。 |
Whoever commits the acts as prescribed in the preceding paragraph, if the substances involved are not goods or articles the export and import of which are prohibited by the Chinese government, but the evaded or dodged tax payable amounted to over 10,000 yuan or the person smuggles the substances involved again after he or she has been given not less than two administrative penalties for smuggling within one year, shall be convicted and punished for the crime of smuggling general goods or articles in accordance with the provisions of Article 153 of the Criminal Law.
