To effectively implement the provisions of the amended Criminal Procedure Law on jurisdiction over criminal cases, and to ensure the quality in handling cases involving crimes committed by foreigners, in light of the characteristics of such cases and the actual conditions in case handling, the relevant issues concerning the jurisdiction over cases involving crimes committed by foreigners are hereby announced as follows: | |
为贯彻实施好修改后刑事诉讼法关于犯罪案件管辖的规定，确保外国人犯罪案件办理质量，结合外国人犯罪案件的特点和案件办理工作实际，现就外国人犯罪案件管辖的有关事项通知如下： |

I. The first instance cases involving crimes committed by foreigners shall be under the jurisdiction of the grassroots people's courts, except for those as prescribed in Articles 20 to 22 of the Criminal Procedure Law. As for an area where there are more cases involving crimes committed by foreigners, the intermediate people's court may designate one or more grassroots people's courts within its jurisdiction for centralized jurisdiction over the first instance cases involving crimes committed by foreigners; for an area where there are fewer cases involving crimes committed by foreigners, the intermediate people's court may, under the provisions of Article 23 of the Criminal Procedure Law, try the first instance cases involving crimes committed by foreigners under the jurisdiction of grassroots people's courts.
．．．．．． | | 一、第一审外国人犯罪案件，除刑事诉讼法第二十条至第二十二条规定的以外，由基层人民法院管辖。外国人犯罪案件较多的地区，中级人民法院可以指定辖区内一个或者几个基层人民法院集中管辖第一审外国人犯罪案件；外国人犯罪案件较少的地区，中级人民法院可以依照刑事诉讼法第二十三条的规定，审理基层人民法院管辖的第一审外国人犯罪案件。
