| The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: | | 各省、自治区、直辖市人民政府，国务院各部委、各直属机构： |
| For purposes of implementing the spirit of the Fourth Plenary Session of the 19th CPC Central Committee and the Central Economic Work Conference, and in accordance with the relevant provisions of the Land Administration Law of the People's Republic of China, furthering the reform of “simplification of administrative procedures and decentralization of powers; combination of decentralization and appropriate control; and optimization of services,” reforming land management rules, and granting more decision-making power in land use to provincial people's governments under the premise of strictly protecting the arable land and economical and intensive use of land, we hereby make the following decisions: | | 为贯彻落实党的十九届四中全会和中央经济工作会议精神，根据《中华人民共和国土地管理法》相关规定，在严格保护耕地、节约集约用地的前提下，进一步深化“放管服”改革，改革土地管理制度，赋予省级人民政府更大用地自主权，现决定如下： |
I. The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government are authorized to grant the approval of repurposing of agricultural land other than permanent basic farmland as construction land, which can be authorized by the State Council. From the date of issuance of this Decision, in accordance with paragraph 3 of Article 44 of the Land Administration Law of the People's Republic of China, the State Council shall authorize the people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government to grant the approval of repurposing of agricultural land other than permanent basic farmland as construction land in batches according to an annual plan for land utilization within the extent of the scale of construction land determined in a comprehensive plan for land utilization approved by the State Council. In accordance with paragraph 4 of Article 44 of the Land Administration Law of the People's Republic of China, the State Council shall authorize the people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government to grant the approval of repurposing of agricultural land other than permanent basic farmland as construction land beyond the extent of the scale of construction land of a city, villages, and market towns determined in a comprehensive plan for land utilization.
．．．．．． | | 一、将国务院可以授权的永久基本农田以外的农用地转为建设用地审批事项授权各省、自治区、直辖市人民政府批准。自本决定发布之日起，按照《中华人民共和国土地管理法》第四十四条第三款规定，对国务院批准土地利用总体规划的城市在建设用地规模范围内，按土地利用年度计划分批次将永久基本农田以外的农用地转为建设用地的，国务院授权各省、自治区、直辖市人民政府批准；按照《中华人民共和国土地管理法》第四十四条第四款规定，对在土地利用总体规划确定的城市和村庄、集镇建设用地规模范围外，将永久基本农田以外的农用地转为建设用地的，国务院授权各省、自治区、直辖市人民政府批准。
