| Lawful and equal protection of various property rights is of great significance for heightening the entrepreneurship and innovation vitality and the will to invest of market participants and boosting the sustainable and sound development of the economy. For purposes of fully implementing Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era and the spirit of the 19th CPC National Congress, carrying out the arrangements of the CPC Central Committee and the State Council for improving the property rights protection system and protecting property rights in accordance with the law, and creating a law-oriented environment that equalizes the protection of property rights and lawful rights and interests of various ownership economies, with the consent of the State Council, you are hereby notified of the matters concerning the review of the rules and regulatory documents relating to the protection of intellectual property rights as follows: | | 依法平等保护各类产权，对增强市场主体创业创新活力和投资意愿、推动经济持续健康发展具有重要意义。为全面贯彻习近平新时代中国特色社会主义思想和党的十九大精神，落实党中央、国务院关于完善产权保护制度依法保护产权的部署，营造平等保护各种所有制经济产权和合法权益的法治环境，经国务院同意，现就开展涉及产权保护的规章、规范性文件清理工作有关事项通知如下： |
| I. Scope of review | | 一、清理范围 |
| The scope of this review shall be the rules developed by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures and the departments of the State Council and the regulatory documents developed by the local people's governments at and above the county level, their subordinate departments, and the departments of the State Council. The focus of the review shall be on the provisions contrary to the equal protection of ownership, use, management, enjoyment, and other various property rights of entities of various ownership economies; the provisions improperly restricting the production and operation of enterprises, the trading of immovables by enterprises and residents, and other exercise of property rights by parties to civil legal relations; and the provisions on differentiated and discriminatory treatment of entities of different ownership economies in the aspects of market access, use of factors of production, tax, finance, investment, price, and other policies. | | 此次清理的范围是省、自治区、直辖市、设区的市、自治州人民政府和国务院部门制定的规章，以及县级以上地方各级人民政府及其所属部门、国务院部门制定的规范性文件。清理的重点是，有违平等保护各种所有制经济主体财产所有权、使用权、经营权、收益权等各类产权的规定，不当限制企业生产经营、企业和居民不动产交易等民事主体财产权利行使的规定，以及在市场准入、生产要素使用、财税金融投资价格等政策方面区别性、歧视性对待不同所有制经济主体的规定。 |
| II. Duties of review | | 二、清理职责 |
In the review, the principle that developers are reviewers shall be adhered to. In respect of the rules and regulatory documents developed by the departments of the State Council and the regulatory documents developed by the subordinate departments of local people's governments at and above the county level, the developing departments shall be responsible for the review; if departments are joint developers, or the duties of multiple departments are involved, the leading departments shall be responsible for organizing the review; and if the developing department has been revoked, or the power has been adjusted, the department that continues to exercise the power of developing department shall be responsible for the review. In respect of the rules and regulatory documents developed by local people's governments at and above the county level, the implementation departments shall put forward review opinions and proposals and report to the people's governments at the same level for decision.
．．．．．． | | 清理工作坚持“谁制定、谁清理”的原则。国务院部门制定的规章、规范性文件和县级以上地方人民政府所属部门制定的规范性文件，由制定部门负责清理；部门联合制定或涉及多个部门职责的，由牵头部门负责组织清理；制定部门被撤销或职权已调整的，由继续行使其职权的部门负责清理。县级以上地方人民政府制定的规章、规范性文件，由实施部门提出清理意见和建议，报同级人民政府决定。
