According to the requirements and spirit of the 2010 Legislativeon Work Plan for the Standing Committee of the National People's Congress, and upon the consent of the State Council, we hereby notify you of the relevant matters on sorting out regulations as follows: | |

| I. Fully apprehending the significance of the sort-out of regulations | | 一、充分认识规章清理的重要意义 |
To form a socialist legal system with Chinese characteristics in 2010 is a general goal of the legislative work in the new era as set in the 15th National Congress of the Chinese Communist Party. Since 2008, the Standing Committee of the National People's Congress has deployed an all-around sort-out of the current laws, amended some laws, abolished some laws and decisions related to legal issues; in 2009, the Legislative Affairs Sub-Committee of the NPC Standing Committee issued the Opinions on Doing a Good Job in Sorting out Local Regulations, and deployed the implementation of the sort-out of local regulations nationwide. At present, the sort-out of administrative regulations is under way. | |
2010年形成中国特色社会主义法律体系是党的十五大提出的新时期立法工作总目标。2008年以来，全国人大常委会部署对现行法律进行了全面清理，修改了部分法律，废止了部分法律和有关法律问题的决定；2009年，全国人大常委会法制工作委员会又下发了《关于做好地方性法规清理工作的意见》，部署在全国开展地方性法规的清理工作。目前，行政法规的清理工作也在开展。 |
According to the principle of an inferior law must conform to superordinate laws and based on the amendments and abolishment of laws, timely sorting out regulations is not only an objective demand for guaranteeing the integrity of our socialist legal system, but also an inevitable demand for ensuring the realization of the goal of forming the socialist legal system with Chinese characteristics in 2010 on schedule. The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, the people's governments of relatively large cities and all departments of the State Council shall fully apprehend the necessity, significance and urgency of carrying out this work, take feasible and effective measures, and guarantee that the tasks of sorting out regulations are completed on time. | |
按照下位法必须符合上位法的原则，根据法律修改和废止的情况，及时对规章进行清理，既是保证我国社会主义法制统一的客观要求，也是确保2010年形成中国特色社会主义法律体系目标如期实现的必然要求。各省、自治区、直辖市人民政府和较大的市人民政府、国务院各部门要充分认识开展这项工作的必要性、重要性和紧迫性，采取切实有效措施，保证规章清理工作任务按时完成。 |

| II. Scope and work tasks of sorting out regulations | | 二、规章清理的范围和工作任务 |
The scope of the present round of sorting out regulations covers all the currently effective regulations formulated by the people's governments of all provinces, autonomous regions, municipalities directly under the Central Government, and relatively large cities and all departments of the State Council. The sort-out is to center around the demand for ensuring the formation of a socialist legal system with Chinese characteristics in 2010, find out the existing obviously conflicting, inconsistent and discordant provisions by conducting a concentrated sort-out of the current regulations, differentiate the degree of importance and urgency, conduct classified handling according to the different situations, and guarantee the unity of the country's socialist legal system and the scientificness, integrity and harmony of the socialist legal system with Chinese characteristics so as to better serve our social and economic development. | |
这次规章的清理范围是各省、自治区、直辖市和较大的市人民政府、国务院各部门制定的现行有效的全部规章。任务是围绕确保到2010年形成中国特色社会主义法律体系的要求，通过对现行规章进行一次集中清理，查找出存在的明显不适应、不一致、不协调的突出问题，根据不同情况，区别轻重缓急，分类进行处理，保证国家社会主义法制的统一和中国特色社会主义法律体系的科学统一和谐，更好地服务于我国经济社会的发展。 |
To sort out regulations is to mainly conduct research and review on regulations that feature the following three categories of problems, and respectively handle them by abolishment, invalidation upon announcement or amendments: 1. The regulations that are obviously unable to meet the requirements of social and economic development; 2. The regulations that are inconsistent with the provisions of higher-level laws; 3. The provisions that are evidently discordant between different regulations. All local governments and departments may handle them along with other problems found in sorting out the regulations.

规章清理工作主要是围绕以下三类问题对规章进行研究梳理，分别作出废止、宣布失效或者修改等处理：一是规章已经明显不适应经济社会发展要求的；二是规章与上位法的规定不一致的；三是规章之间明显不协调的。各地方、各部门在清理工作中发现规章还有其他问题的，也可以一并予以处理。
