Implementation Plan for the Pilot Program of Reforming the Commitment System for Investment Projects of Enterprises in the Beijing Economic-Technological Development Area (for Trial Implementation) 北京经济技术开发区企业投资项目承诺制改革试点实施方案(试行)
For the purposes of further implementing the spirit of the Opinions of the CPC Central Committee and the State Council on Deepening the Reform of the Investment and Financing System, conscientiously implementing the requirements of the Notice by the Beijing Municipal Committee of the Communist Party of China and the People's Government of Beijing Municipality of Issuing the Implementation Opinions on Deepening the Reform of the Investment and Financing System (No. 1 [2018], Beijing Municipal Committee of the Communist Party of China) and the Notice by the Beijing Municipal Committee of the Communist Party of China and the People's Government of Beijing Municipality of Issuing the Implementation Plan for Taking the Lead in Taking Actions and Reforming and Optimizing the Business Environment (No. 20 [2017], Beijing Municipal Committee of the Communist Party of China), further deepening the investment approval system reform, accelerating the transformation of government functions, reforming and optimizing the business environment, and fully stimulating the vitality of social investment, this Implementation Plan is developed in light of the actual circumstances of the Beijing Economic-Technological Development Area. 为深入贯彻《中共中央 国务院关于深化投融资体制改革的意见》精神,认真落实《中共北京市委 北京市人民政府印发〈关于深化投融资体制改革的实施意见〉的通知》(京发〔2018〕1号)和《中共北京市委 北京市人民政府印发〈关于率先行动改革优化营商环境实施方案〉的通知》(京发〔2017〕20号)要求,进一步深化投资审批制度改革,加快转变政府职能,改革优化营商环境,充分激发社会投资活力,结合北京经济技术开发区实际,制定本实施方案。
I. General Requirements   一、总体要求
(1) Guiding ideology (一)指导思想
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and with the in-depth implementation of the spirit of the 19th CPC National Congress and the Second and Third Plenary Session of the 19th CPC Central Committee, all relevant parties shall conscientiously implement the decisions and arrangements of the CPC Central Committee and the State Council on deepening the investment and financing system reform and optimizing the business environment and the relevant work requirements of the Beijing Municipal Committee of the Communist Party of China and the People's Government of Beijing Municipality, and, with the implementation of enterprises' rights to make their own investment decisions as the starting point and the acceleration of the transformation of government functions as the focus, boost the redesigning of the investment project approval process, strengthen the project process service regulation, and explore for innovating the investment management modes with policy condition guidance, enterprise credit commitment and effective regulatory restraints as the core, so as to form replicable and widely applicable reform experience, and strive to create a high ground of world-class business environment. 以习近平新时代中国特色社会主义思想为指导,深入贯彻党的十九大和十九届二中、三中全会精神,认真落实党中央、国务院关于深化投融资体制改革、优化营商环境的决策部署和市委、市政府相关工作要求,以落实企业投资自主权为出发点,以加快转变政府职能为着力点,推动投资项目审批流程再造,强化项目过程服务监管,在北京经济技术开发区探索创新以政策性条件引导、企业信用承诺、监管有效约束为核心的投资管理模式,形成可复制、可推广的改革经验,努力打造国际一流的营商环境高地。
(2) Basic principles (二)基本原则
Adhering to reform and innovation. The reform and process redesigning of enterprises' investment project approval management system shall be boosted in an in-depth manner; the simplification of administrative procedures, delegation of powers, combination of decentralization and appropriate control and optimization of services shall be advanced in a coordinated manner; explorations shall be made for innovating enterprises' investment project management modes; and the removal of institutional obstacles that restrict investment implementation shall be accelerated. 坚持改革创新。深入推动企业投资项目审批管理体制改革和流程再造,协同推进简政放权、放管结合、优化服务,探索创新企业投资项目管理模式,加快破除制约投资落地的制度性障碍。
Adhering to the principle of market participants. The status of enterprises as investors shall be effectively implemented, and as for eligible investment projects, enterprises shall make their own choices and make written commitments according to the standards set by governments. Except for necessary procedures such as project initiation, planning, and construction, approval steps shall be streamlined to the largest extent through “standard + commitment”, and “approval before construction” shall be changed into “construction before inspection.” 坚持市场主体。切实落实企业投资主体地位,对符合条件的投资项目,由企业自主选择并按照政府制定的标准作出书面承诺。除立项、规划、施工等必要手续外,以“标准+承诺”最大限度精简审批环节,变“先批后建”为“先建后验”。
Adhering to intensified regulation. Regulation concepts and modes shall be innovated; service consciousness and capabilities shall be enhanced and based on Beijing Online Approval and Regulation Platform for Investment Projects and Beijing Public Credit Information Service Platform, the efficient, transparent and coordinated regulation system and credit punishment mechanisms shall be improved, and the shift of the focus of the management of enterprises' investment projects from prior approval to interim and ex post whole-process regulation services shall be accelerated. 坚持强化监管。创新监管理念和模式,强化服务意识和能力,依托市投资项目在线审批监管平台和市公共信用信息服务平台,健全高效、透明、协同的监管体系和信用惩戒机制,加快推进企业投资项目管理重心由事前审批向事中事后全过程监管服务转变。
II. Scope and Period of the Pilot Program   二、试点范围和时间
(1) Scope of the pilot program (一)试点范围
Enterprises' investment projects subject to recordation within the scope of the administrative regions of the Beijing Economic-Technological Development Area (hereinafter referred to as the “BDA”). 北京经济技术开发区(以下简称开发区)行政区域范围内的备案类企业投资项目。
(2) Period of the pilot program (二)试点时间
The period of the pilot program shall be three years commencing on the date of issuance of this Plan. 试点期为3年,自本方案印发之日算起。
III. Main Tasks   三、主要任务
(1) Unified list notification (一)统一清单告知
Establishing the project access negative list. In accordance with the Guiding Catalogue for Industrial Restructuring of the State and the Prohibition and Restriction Catalogue of New Industries in this Municipality, and advanced, sophisticated and cutting-edge industry access standards, among others, the negative list for the access of projects covered by the pilot program of the commitment system reform shall be developed and issued, and the projects not on the negative list shall be subject to commitment-based access under the principles of granting permission as long as they are not expressly prohibited by law and enterprises' voluntariness. 建立项目准入负面清单。根据国家产业结构调整指导目录、本市新增产业禁止和限制目录、开发区高精尖产业准入标准等,制定并公布承诺制改革试点项目准入负面清单,负面清单以外的项目,按照非禁即可、企业自愿原则,实行承诺准入。
Establishing the list of enterprises' commitments. The list of commitments concerning the pilot program of the commitment system reform shall be developed and issued in a unified manner, and the government approval of all commitments included in the list shall be cancelled, and be replaced with enterprises' commitment. The relevant approval departments shall, in accordance with relevant laws, regulations and rules, and under the principles of streamlining, regulation, and practicability, develop the letters of notification and commitment concerning commitments, and list all of enterprises' commitments and the conditions and standards and technical specifications that shall be satisfied, as well as the corresponding regulation and acceptance check requirements, effectiveness of enterprises' commitments, and punitive measures against enterprises' failures to fulfill commitments, among others, in the form of entry-based comprehensive written notifications. The list of commitments shall be revised at appropriate time to minimize approval items and increase commitments. 建立企业承诺事项清单。统一制定并公布承诺制改革试点承诺事项清单,对列入清单的事项,一律取消政府审批,改为企业承诺。有关审批部门依据相关法律法规规章,按照精简、规范、实用原则,制定承诺事项告知承诺书,以条目式综合告知单形式一次性全部列出企业承诺事项和应当遵照执行的条件标准、技术规范及相应的监管验收要求、企业承诺效力、不履行承诺的惩戒措施等。承诺事项清单应适时修订,最大限度减少审批事项、增加承诺事项。
The negative list for project access and the list of enterprises' commitments shall be released to the public on the government website of the BDA, and Beijing Online Approval and Regulation Platform for Investment Projects. 项目准入负面清单、企业承诺事项清单应在开发区政府网站、市投资项目在线审批监管平台公开发布。
(2) Unifying system management (二)统一系统管理
The management system for the projects under the pilot program of the commitment system reform shall be established to realize the connection and information sharing with Beijing Online Approval and Regulation Platform for Investment Projects, the collaborated platform for “integrating multiple urban plans into a single master plan,” joint completion acceptance check platform, and the business approval systems of all departments, among others, so as to achieve pilot projects' unified acceptance, whole-process recording, and real-time regulation. 建立承诺制改革试点项目管理系统,与市投资项目在线审批监管平台、“多规合一”协同平台、联合竣工验收平台、各部门业务审批系统等进行对接和信息共享,实现试点项目统一受理、全程留痕、实时监管。
(3) Comprehensive regional evaluation (三)区域综合评价
The energy conservation evaluation, environmental impact assessment, water impact assessment, traffic impact assessment, seismic safety assessment, and archaeological survey and exploration of construction projects and other assessment and examination shall be included in the list of enterprises' commitments in principle. The promotion of regional comprehensive evaluation shall be accelerated; various special evaluation tasks shall be conducted synchronously in the process of preparing regulatory detailed planning at the community level, and review conclusions shall be incorporated into the results of regulatory detailed planning; and the elimination of relevant special evaluation and review of single construction projects shall be gradually achieved. 建设项目节能评价、环境影响评价、水影响评价、交通影响评价、地震安全性评价、文物考古调查勘探等评价审查,原则上列入企业承诺事项清单。加快推动区域综合评价,在街区层面控制性详细规划编制过程中,同步开展各专项评价工作,评审结论纳入控制性详细规划编制成果,逐步实现单个建设项目不再进行相关专项评价评审。
(4) Enterprise's independent commitment (四)企业自主承诺
For an investment project to participate in the pilot program of the commitment system reform, the enterprise shall file a written application with the management committee of the BDA, and, the management committee of the BDA shall, after approving it upon deliberation, sign a letter of notification and commitment concerning commitments, and publish it on the government website of the BDA in a timely manner for the period of five working days. After the expiration of the period of publication, the project shall be formally included in the scope of the pilot program of commitment system reform, and the enterprise may file the project with the project initiation department, obtain the project code, and conduct project design and other work independently according to laws and regulations. 对拟参与承诺制改革试点的投资项目,由企业向开发区管委会提出书面申请,开发区管委会研究通过后,签订承诺事项告知承诺书,并及时在开发区政府网站向社会公示,公示期为5个工作日。公示期满后,项目正式纳入承诺制改革试点范围,企业即可向立项部门备案、获取项目代码,并依法依规自主开展项目设计等工作。
(5) Recordation of technical proposals (五)技术方案备案
An enterprise shall independently authorize an intermediary to prepare technical proposals for planning, land, environmental protection, transportation, water-related affairs, gardening, energy conservation, civil air defense, and work safety, among others and organize review and form review opinions. After the completion of the review, the enterprise shall file in a timely manner the technical proposals and review opinions with the relevant departments through the management system for pilot projects, and the relevant departments shall not conduct substantive review of the contents of the technical proposals in principle. The joint preparation and joint review of technical proposals shall be supported. The enterprise may, upon its completion of technical proposal recordation, apply to the planning department for a construction project planning permit based on the construction project design plan. The enterprise shall prepare the construction drawing and organize construction in strict accordance with the technical proposals filed, and all major changes in the technical proposals shall be reported to the recordation department in a timely manner. 企业自主委托中介机构编制规划、国土、环保、交通、水务、园林、节能、人防、安全生产等技术方案,组织评审并形成评审意见。评审完成后,企业要将技术方案和评审意见及时通过试点项目管理系统报相关部门备案,相关部门原则上不再对技术方案进行实质性内容审查。支持技术方案联合编制、联合评审。企业完成技术方案备案,即可持建设工程设计方案向规划主管部门申请建设工程规划许可证。企业要严格按照报备的技术方案编制施工图、组织施工,技术方案发生重大变更的应及时向备案部门报告。
(6) Optimizing the drawing examination procedures (六)优化图审程序
The construction drawing examination step shall be changed from overall safety examination before the commencement of the construction of a project into ex post inspection, and an enterprise shall prepare construction drawing design documents in accordance with the mandatory standards and specifications for construction, fire control, and civil air defense, among others, without the need of submitting them to the examination institution for examination; and the government shall authorize a third-party inspection institution to conduct ex post inspection by means of purchase of services. Where an enterprise has obtained the construction project planning permit and signs a construction contract, and makes a commitment that the construction site has met the conditions for starting construction, construction drawing design documents meet the relevant standards and specifications, and the construction funds have been ensured and it is not in default on project funds, the construction department may issue the construction permit for a construction project and start the quality and safety supervision simultaneously. 将施工图审查环节由开工前整体安全性审查调整为事后检查,企业按照建筑、消防、人防等强制性标准规范编制施工图设计文件,无需送审查机构审查;政府以购买服务方式委托第三方检查机构开展事后检查。企业取得建设工程规划许可证、签订施工合同,承诺现场具备施工条件、施工图设计文件符合有关标准规范且建设资金落实不拖欠工程款,建设主管部门即可核发建筑工程施工许可证,并同步启动质量和安全监督工作。
(7) Process regulation services (七)过程监管服务
Strengthening interim and ex-post regulation services, including whether the projects under priority regulation by development and reform departments meet the access conditions, and whether enterprises organize bidding, among others, according to the law, whether the enterprises under priority regulation by the planning departments prepare the design plans and construction drawings of construction projects, among others, according to standards and specifications, and whether the enterprises under priority regulation by the construction departments select construction and supervision entities according to laws and regulations and organize the construction according to standards and specifications, among others. The departments of environmental protection, transportation, water-related affairs, gardening, fire control, civil air defense, and work safety, among others, shall strengthen supervision and administration according to their duties. All relevant departments shall take the initiative to provide proactive services, strengthen policy and technical guidance, solve problems encountered in the process of project implementation in a timely manner, and boost the implementation of project construction according to the commitment conditions and standards and specifications. 强化事中事后监管服务。发展改革部门重点监管项目是否符合准入条件、企业是否依法组织招投标等。规划主管部门重点监管企业是否按照标准规范编制建设工程设计方案、施工图等。建设主管部门重点监管企业是否依法依规选择施工、监理单位,按照标准规范组织施工等。环保、交通、水务、园林、消防、人防、安全生产等工作主管部门依职责加强监督管理。各有关部门要主动靠前服务,加强政策引导和技术指导,及时解决项目实施过程中遇到的问题,推动项目按照承诺条件和标准规范实施建设。
Strengthening the whole-process supervision and inspection of projects. The management committee of the BDA shall establish and improve the joint inspection and law enforcement mechanisms, and, according to the regulatory requirements of “random selection of subjects and inspectors and public disclosure”, and based on the letters of commitment signed by enterprises and the survey, consultation, design, surveying and mapping and inspection results filed, and construction and supervision situations, among others, conduct supervision and inspection of pilot projects primarily in terms of four key nodes, namely, foundation pit inspection, the structure's overtopping of the base line (±0.000), major structure capping, and decoration project completion, and find and correct violations of laws and regulations in a timely manner. Where an enterprise's violation of any law is found in the process of supervision and inspection, the relevant department shall order it to take corrective action and impose a fine on it according to the law; order it to suspend business operations for rectification and degrade its qualification or revoke its qualification certificate according to the law if the circumstances are serious; and implement the land use right withdrawal mechanism according to the law as stipulated in the commitment if the circumstances are particularly serious or the project has not been completed and put into production within three years after the construction of the project commences, so as to effectively prevent the idling of land. Where a relevant entity or any of its employees is criminally punishable, it or he shall be held criminally liable according to the law; and where any loss is caused, it or he shall be liable for compensation according to the law. 强化项目全过程监督检查。开发区管委会要建立健全联合检查执法机制,按照“双随机、一公开”监管要求,根据企业签订的承诺书和报备的勘察、咨询、设计、测绘、检测成果及施工、监理情况等,重点围绕基坑验槽、结构出正负零、主体结构封顶、装修装饰工程完成等四个关键节点,对试点项目进行监督检查,及时发现并纠正违法违规行为。对监督检查中发现的企业违法行为,由相关部门依法责令改正、处以罚款;情节严重的,责令停业整顿,依法降低资质等级或吊销资质证书;情节特别严重或项目开工后三年内未竣工投产的,按照承诺约定依法落实土地使用权退出机制,切实防止土地闲置。有关单位和从业人员构成犯罪的,依法追究刑事责任;造成损失的,依法承担赔偿责任。
(8) Joint acceptance check of a project (八)项目联合验收
If a project has been completed and meets the conditions for joint acceptance check, the enterprise shall organize the survey, design, construction, supervision and other entities to form an acceptance check group to develop the acceptance check plan, and submit a joint acceptance check application through the pilot project management system. The construction department shall take the lead in organizing relevant departments to inform once and for all the enterprise of the joint acceptance conditions, standards, procedures and application materials for special acceptance check, and the relevant departments and municipal public service enterprises shall conduct on-line review of the application materials, and conduct on-site acceptance check of those meeting the acceptance check conditions, and issue the joint acceptance check opinions to construction employers in a timely manner if the projects have passed the acceptance checks. All departments shall mutually recognize the acceptance check results. 项目完工并具备联合验收条件的,企业组织勘察、设计、施工、监理等单位组成验收组,制定验收方案,通过试点项目管理系统提交联合验收申请。建设主管部门牵头组织相关部门一次性告知企业联合验收条件、标准、程序以及专项验收的申请材料,相关部门及市政公用服务企业对申报资料进行网上审核,符合验收条件的及时开展现场验收,验收合格的及时向建设单位出具联合验收意见书,验收结果各部门互认。
(9) Review of fulfillment of commitments (九)承诺兑现复核
After a project passes the acceptance check, the management committee of the BDA shall organize a comprehensive assessment based on the project technical proposal, joint acceptance check opinions and regulation records during the regulation period, among others, to review whether the enterprise has fulfilled its commitments. If the commitments are strictly fulfilled, the project may be officially put into operation, except that the trial operation thereof is necessary in accordance with relevant provisions. 项目验收合格后,开发区管委会应根据项目技术方案、联合验收意见和监管期监管记录情况等组织综合评估,复核企业是否兑现承诺事项。严格兑现承诺的,除根据有关规定必须试运行外,项目可正式投入运行。
(10) Implementing joint rewards and punishments (十)实行联合奖惩
The red list and blacklist system for commitment fulfillment credit shall be established, and the mechanism of joint incentives for honesty and joint punishment of dishonesty shall be implemented in a comprehensive manner. The whole-process tracking of enterprises' fulfillment of commitments through the pilot program management system, and the information on enterprises and relevant personnel's fulfillment of commitments shall be sent to Beijing Public Credit Information Service Platform, and be released to the public. For enterprises that keep good faith, incentive measures shall be taken in terms of implementation of administrative licensing and project support, among others, in light of actual circumstances; and for enterprises that lose faith, punitive measures shall be taken in accordance with laws and regulations in terms of financial subsidies, government procurement, and initiating the formation or holding non-controlling shares of financial institutions, among others. 建立承诺履行信用红黑名单制度,全面实施守信联合激励和失信联合惩戒。通过试点项目管理系统对企业履行承诺情况实施全过程跟踪,将企业和相关人员落实承诺行为信息归集至市公共信用信息服务平台,并向社会公开。对守信企业,根据实际情况在实施行政许可、项目支持等方面采取激励措施;对失信企业,在财政资金补助、政府采购、发起设立或参股金融机构等方面依法依规采取惩戒措施。
IV. Guarantee Measures   四、保障措施
(1) Strengthening the implementation of responsibilities. The management committee of the BDA shall maximize its overall coordination role, specify and break down work tasks, improve the coordinated implementation and promotion mechanisms, optimize and improve the operational procedures, and promote the pilot program of the reform in a solid manner. The relevant departments of the BDA shall develop supporting reform measures as soon as possible, specify and improve the guidelines for handling affairs, operation methods and relevant technical guide rules, and take the initiative to provide effective policy consultation and technical guidance services. (一)强化责任落实。开发区管委会要充分发挥统筹协调作用,细化分解工作任务,健全协调落实推进机制,优化完善操作流程,扎实推进改革试点工作。开发区有关部门要尽快制定配套改革措施,细化完善办事指南、操作方法和相关技术导则,主动做好政策咨询和技术指导服务。
(2) Strengthening work connection. The municipal approval powers involved by pilot projects shall in principle be delegated to lower levels or be entrusted to the management committee of the BDA, and the relevant municipal departments shall effectively conduct supervision and guidance. For projects that have passed the review of commitment fulfilment, the relevant departments of the BDA shall ensure the effective connection of approval procedures, and may directly issue relevant certificates and licenses by means of incompleteness-tolerance acceptance, among others. The management committee of the BDA shall coordinate with the relevant financial institutions in simplifying the procedures for handling affairs and innovating service measures, and provide necessary financing support for pilot projects. (二)强化工作衔接。试点项目涉及市级审批职权的,原则上下放或委托开发区管委会行使,市级有关部门要做好监督指导工作。对承诺兑现复核合格的项目,开发区有关部门要做好审批手续办理衔接,可采取容缺受理等方式直接核发相关证照。开发区管委会要协调有关金融机构简化办事手续、创新服务措施,为试点项目提供必要的融资支持。
(3) Intensifying work guidance. The Beijing Municipal Commission of Development and Reform (“BMCDR”) and the Beijing Municipal Administration of Government Services shall strengthen the monitoring and analysis, tracking and guidance and supervision and inspection of the implementation of the pilot reform of the commitment system reform, sum up experience in a timely manner, and strengthen risk prevention and control; and shall explore the establishment of an inspection and assessment system for the implementation of the pilot program of the commitment system reform, and introduce third-party assessment agencies at appropriate time to access the effectiveness of the reform. (三)强化工作指导。市发展改革委、市政务服务局要加强对承诺制改革试点实施情况的监测分析、跟踪指导和督促检查,及时总结经验,加强风险防控。探索建立承诺制改革试点落实情况检查评估制度,适时引入第三方评估机构,对改革成效进行评估。
(4) Enhancing publicity and guidance. The BMCDR and the management committee of the BDA shall make full use of various news media to widely publicize the policies and measures for the pilot program of the reform, keep effectively conducting the publicity and interpretation for enterprises, and respond to enterprises' concerns in a timely manner, so as to create a good atmosphere for further advancing the pilot program of the reform. (四)强化宣传引导。市发展改革委、开发区管委会要充分利用各种新闻媒体广泛宣传改革试点政策措施,持续做好面向企业的宣传解读,及时回应企业关切,为改革试点深入推进营造良好氛围。

III. Projects with the energy consumption per unit of product higher than the energy consumption access standard for industries in the BDA.   三、单位产值能耗高于开发区行业能耗准入标准的项目;
IV. Projects that fail to meet the green ecological indicator requirements of the BDA and whose total annual discharges of major pollutants exceed the indicators as prescribed by the state, Beijing Municipality and the BDA.   四、未达到开发区绿色生态指数要求,主要污染物年排放总量超过国家、北京市和开发区规定指标的项目;
V. Projects that fail to meet the requirements for advanced, sophisticated and cutting-edge industries in the BDA, and in which enterprises make less annual research and development investments than the industry target values issued by the BDA.   五、未达到开发区高精尖产业要求,企业年度研发经费投入强度低于开发区公布的行业目标值的项目;
VI. Steel, electrolytic aluminum, cement, flat glass and other projects in industries with severe overcapacity.   六、钢铁、电解铝、水泥、平板玻璃等产能严重过剩行业的项目;
VII. Mining and metal smelting projects and other projects with high-safety risks, such as those for production, storage, loading and unloading of dangerous goods.   七、矿山、金属冶炼及用于生产、存储、装卸危险物品等高安全风险的项目;
VIII. Projects included in land recycling access list for the transformation and upgrading of the BDA.   八、列入开发区转型升级土地循环利用准入清单的项目。
