On February 28, 2005, the 14th Session of the Standing Committee of the Tenth National People's Congress adopted the Decision of the Standing Committee of the National People's Congress on the Administration of Judicial Authentication (hereinafter referred to as theDecision), which shall come into force as of October 1, 2005. | |
2005年2月28日，十届全国人大常委会第十四次会议通过了《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》（以下简称《决定》），将从今年10月1日起施行。 |
The judicial authentication system reform is an important part of the reform of the judicial system. The fact that the National People's Congress specially makes a decision on the administration of judicial authentication is a significant measure for promoting the reform of judicial authentication system, which is of great significance in the aspects of improving the legal system of judicial authentication of China, regulating the judicial authentication administration, solving problems facing the present judicial authentication administration, and promoting fair law enforcement. The procuratorates are state legal supervisory organs and assume important duties for maintaining the uniform and correct implementation of law and safeguarding the realization of fairness and justice in the whole society. The procuratorates establish authentication organs for carrying out necessary authentication work, which is required for performing the function of legal supervision, and cannot only provide effective technical support for investigating duty-related crimes, but also offer a scientific basis for correct investigation and judgment of evidence in the approval of arrest and the public prosecution. The Decision clarifies the establishment, functions and scope of work of the authentication organs in the procuratorates, which is an important legal basis for the procuratorates to carry out the authentication work. The procuratorates at all levels shall seriously implement the Decision, strictly regulate the authentication work of the procuratorates and carry out judicial authentication activities.

司法鉴定体制改革是司法体制改革的重要内容。全国人大常委会专门就司法鉴定管理问题作出决定，是推进司法鉴定体制改革的重要举措，对于完善我国司法鉴定法律制度，规范司法鉴定管理活动，解决当前司法鉴定管理工作中存在的问题，促进公正执法，具有十分重要的意义。检察机关作为国家法律监督机关，在维护法律的统一正确实施、保障在全社会实现公平和正义方面承担着重要职责。检察机关设立鉴定机构，开展必要的鉴定工作，是履行法律监督职能的客观需要，不仅可以为职务犯罪侦查工作提供有力的技术支持，也可以为批捕、公诉工作中正确审查判断证据提供科学的依据。《决定》明确了检察机关鉴定机构的设置、职能和工作范围，是检察机关开展鉴定工作的重要法律依据。各级人民检察院要认真贯彻《决定》，严格规范检察机关的鉴定工作，依法开展司法鉴定活动。
