The Decision of the Ministry of Land and Resources to Amend the Measures for the Administration of the Examination and Submission for Approval of Construction Land, as deliberated and adopted at the 4th executive meeting of theMinistry of Land and Resources on November 25, 2016, is hereby issued, and shall come into force on January 1, 2017. 《国土资源部关于修改<建设用地审查报批管理办法>的决定》,已经2016年11月25日国土资源部第4次部务会议审议通过,现予发布,自2017年1月1日起施行。

Decision of the Ministry of Land and Resources to Amend the Measures for the Administration of the Examination and Submission for Approval of Construction Land 国土资源部关于修改《建设用地审查报批管理办法》的决定
To further simplify the approval procedures for construction land, reduce the essential elements of approval, and improve the efficiency of approval, it is hereby decided to amend the Measures for the Administration of the Examination and Submission for Approval of Construction Land (Order No. 3, Ministry of Land and Resources) as follows: 为进一步简化建设用地审批程序,减少审批要件,提高审批效率,决定对《建设用地审查报批管理办法》(国土资源部令第3号)作出如下修改:
I. Article 4 is amended to read: “At the stage of approval, confirmation, or recordation of a construction project, the construction project owner shall apply for pre-examination of land used for the construction project to the department of land and resourcesat the same level of the construction project approval authority.   一、将第四条修改为:“在建设项目审批、核准、备案阶段,建设单位应当向建设项目批准机关的同级国土资源主管部门提出建设项目用地预审申请。
“The department of land and resource that accepts a pre-examination application shall, according to the comprehensive plan for land utilization, standards of land use, and the state's land supply policies, conduct pre-examination of the relevant matters on the construction project, and issue a pre-examination opinion on the land used for the construction project.” “受理预审申请的国土资源主管部门应当依据土地利用总体规划、土地使用标准和国家土地供应政策,对建设项目的有关事项进行预审,出具建设项目用地预审意见。”
II. Paragraph 2 of Article 5 is amended to read: “The construction project owner shall, when filing a land use application, complete an Application Form for Construction Land, with the following materials attached thereto:   二、将第五条第二款修改为:“建设单位提出用地申请时,应当填写《建设用地申请表》,并附具下列材料:
“(1) Pre-examination opinion on the land used for the construction project. “(一)建设项目用地预审意见;
“(2) The approval, confirmation, or recordation document on the construction project. “(二)建设项目批准、核准或者备案文件;
“(3) The preliminary design approval or confirmation document for the construction project. “(三)建设项目初步设计批准或者审核文件。
One paragraph is added as paragraph 3: “Where a construction project is to occupy arable land, a proposal on arable land replenishment shall also be submitted; or where a construction project is located in an area where geological hazards tend to occur,a geological hazard risk evaluation report shall also be provided.” 增加一款,作为第三款:“建设项目拟占用耕地的,还应当提出补充耕地方案;建设项目位于地质灾害易发区的,还应当提供地质灾害危险性评估报告。”
III. One article is added as Article 6: “For a unit construction with a controlled construction period and other constructions in urgent need of commencement due to a tight project schedule or seasonal effects under a key construction project of the state, the department of land and resources of a province, an autonomous region, or a municipality directly under the Central Government may apply to the Ministry of Land and Resources for land use in advance.

   三、增加一条,作为第六条:“国家重点建设项目中的控制工期的单体工程和因工期紧或者受季节影响急需动工建设的其他工程,可以由省、自治区、直辖市国土资源主管部门向国土资源部申请先行用地。
