The Decision of the Standing Committee of the National People's Congress on Amending the Law of the People's Republic of China on the Protection of Military Installations, as adopted at the 9th session of the Standing Committee of the Twelfth National People's Congress of the People's Republic of China on June 27, 2014, is hereby issued, and shall come into force on August 1, 2014. 《全国人民代表大会常务委员会关于修改〈中华人民共和国军事设施保护法〉的决定》已由中华人民共和国第十二届全国人民代表大会常务委员会第九次会议于2014年6月27日通过,现予公布,自2014年8月1日起施行。

Decision of the Standing Committee of the National People's Congress on Amending the Law of the People's Republic of China on the Protection of Military Installations 全国人民代表大会常务委员会关于修改《中华人民共和国军事设施保护法》的决定
(Adopted at the 9th session of the Standing Committee of the Twelfth National People's Congress on June 27, 2014) (2014年6月27日第十二届全国人民代表大会常务委员会第九次会议通过)
As decided at the 9th session of the Standing Committee of the Twelfth National People's Congress, the Law of the People's Republic of China on the Protection of Military Installations shall be amended as follows: 第十二届全国人民代表大会常务委员会第九次会议决定对《中华人民共和国军事设施保护法》作如下修改:
I. Article 2 is amended to read: “For the purposes of this Law, the term “military installations” means the following buildings, sites, and equipment used by the state directly for military purposes:   一、将第二条修改为:“本法所称军事设施,是指国家直接用于军事目的的下列建筑、场地和设备:
“(1) Command organs and ground and underground command structures and operations structures. “(一)指挥机关,地面和地下的指挥工程、作战工程;
“(2) Military airfields, harbors, and docks. “(二)军用机场、港口、码头;
“(3) Barracks, training grounds, and testing grounds. “(三)营区、训练场、试验场;
“(4) Military cave storehouses and warehouses. “(四)军用洞库、仓库;
“(5) Military communication, reconnaissance, navigation, and observation stations and posts and survey, navigation, and navigation aid markers. “(五)军用通信、侦察、导航、观测台站,测量、导航、助航标志;
“(6) Dedicated military highways and railways, military communication and power transmission lines, and military oil and water pipelines. “(六)军用公路、铁路专用线,军用通信、输电线路,军用输油、输水管道;
“(7) Frontier and coastal defense control facilities. “(七)边防、海防管控设施;
“(8) Other military installations as prescribed by the State Council and the Central Military Commission. “(八)国务院和中央军事委员会规定的其他军事设施。
“The term “military installations” in the preceding paragraph shall include the temporary facilities set up necessary for the armed forces to perform missions.” “前款规定的军事设施,包括军队为执行任务必需设置的临时设施。”
II. Paragraphs 2 and 3 of Article 3 are amended to read: “The Headquarters of the General Staff of the Chinese People's Liberation Army shall, under the leadership of the State Council and the Central Military Commission, be in charge of the protection of military installations throughout the country. The headquarters of military area commands shall be in charge of the protection of military installations within their respective jurisdictions.   二、将第三条第二款、第三款修改为:“中国人民解放军总参谋部在国务院和中央军事委员会的领导下,主管全国的军事设施保护工作。军区司令机关主管辖区内的军事设施保护工作。
“In places where there are military installations, the relevant military organs and the people's governments at and above the county level shall establish a military and local coordination mechanism for the protection of military installations, and cooperate with each other in supervising and inspecting the protection of military installations.” “设有军事设施的地方,有关军事机关和县级以上地方人民政府应当建立军地军事设施保护协调机制,相互配合,监督、检查军事设施的保护工作。”
III. One article is added as Article 5: “The state shall, by overall planning, take into consideration both economic and social development and the protection of military installations to promote the coordination between economic and social development and the protection of military installations.”   三、增加一条,作为第五条:“国家统筹兼顾经济建设、社会发展和军事设施保护,促进经济社会发展和军事设施保护相协调。”
IV. Article 6 is renumbered as Article 39 and amended to read: “Where any military airfield, harbor, or dock is to be used for both military and civilian purposes, it shall be subject to the approval of the State Council and the Central Military Commission or the body authorized by them.”   四、将第六条改为第三十九条,修改为:“军用机场、港口、码头实行军民合用的,需经国务院和中央军事委员会批准或者国务院和中央军事委员会授权的机关批准。”
V. One article is added as Article 7: “The state shall grant commendations or awards to organizations and citizens that have made outstanding contributions to the protection of military installations.”   五、增加一条,作为第七条:“国家对在军事设施保护工作中做出突出贡献的组织和公民,给予表彰、奖励。”
VI. Article 7 is renumbered as Article 8 and amended to read: “The state shall demarcate military restricted zones and military administrative zones in accordance with the nature, function, security and confidentiality requirements, and requirements for effective utilization of military installations.   六、将第七条改为第八条,修改为:“国家根据军事设施的性质、作用、安全保密的需要和使用效能的要求,划定军事禁区、军事管理区。
“For the purposes of this Law, the term “military restricted zones” means the military areas demarcated under statutory procedures and standards where there are important military installations or there are military installations with significant risk factors, requiring the state to take special measures to provide priority protection. “本法所称军事禁区,是指设有重要军事设施或者军事设施具有重大危险因素,需要国家采取特殊措施加以重点保护,依照法定程序和标准划定的军事区域。
“For the purposes of this Law, the term “military administrative zones” means the military areas demarcated under statutory procedures and standards where there are relatively important military installations or there are military installations with relatively significant risk factors, requiring the state to take special measures to provide protection.” “本法所称军事管理区,是指设有较重要军事设施或者军事设施具有较大危险因素,需要国家采取特殊措施加以保护,依照法定程序和标准划定的军事区域。”
VII. Article 8 is renumbered as Article 9, and one paragraph is added as paragraph 2: “Signboards shall be set up for military restricted zones and military administrative zones in accordance with the relevant provisions. The local people's governments at and above the county level shall be responsible for setting up the signboards.”   七、将第八条改为第九条,增加一款,作为第二款:“军事禁区、军事管理区应当按照规定设置标志牌。标志牌由县级以上地方人民政府负责设置。”
VIII. Article 9 is renumbered as Article 10, and paragraph 2 thereof is deleted.   八、将第九条改为第十条,删去第二款。
IX. Article 13 is renumbered as Article 29 and amended to read: “In developing national economic and social development programs, overall land utilization programs, urban and rural programs, and marine function zoning programs or arranging for construction projects that may affect the protection of military installations, the local people's governments at and above the county level shall take into consideration the requirements for the protection of military installations, and solicit opinions from the relevant military organs. In the arrangement for construction projects or development of new tourist attractions, they shall be located away from military installations. If it is impossible to do so and it is necessary to dismantle or relocate military installations or convert them for civilian use, the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government or the relevant departments of the State Council shall consult with the military organs at the military area command level, and report to the State Council and the Central Military Commission or the body authorized by them for approval.”   九、将第十三条改为第二十九条,修改为:“县级以上地方人民政府编制国民经济和社会发展规划、土地利用总体规划、城乡规划和海洋功能区划,安排可能影响军事设施保护的建设项目,应当兼顾军事设施保护的需要,并征求有关军事机关的意见。安排建设项目或者开辟旅游景点,应当避开军事设施。确实不能避开,需要将军事设施拆除、迁建或者改作民用的,由省、自治区、直辖市人民政府或者国务院有关部门和军区级军事机关商定,并报国务院和中央军事委员会批准或者国务院和中央军事委员会授权的机关批准。”
X. Article 15 is amended to read: “Any entry into a land or water military restricted zone by persons, vehicles, or vessels other than those of the unit in charge of the military restricted zone shall be prohibited, any photographing, video or sound recording, reconnaissance, survey, or graphic or narrative depiction of military restricted zones shall be prohibited, and any low-altitude flying of aircrafts over military restricted zones shall be prohibited, except with the approval of the military organs at or above the military area command level.   十、将第十五条修改为:“禁止陆地、水域军事禁区管理单位以外的人员、车辆、船舶进入军事禁区,禁止对军事禁区进行摄影、摄像、录音、勘察、测量、描绘和记述,禁止航空器在军事禁区上空进行低空飞行。但是,经军区级以上军事机关批准的除外。
“Any entry into a military restricted airspace by aircrafts shall be prohibited, except as approved in accordance with the relevant provisions of the state. “禁止航空器进入空中军事禁区,但依照国家有关规定获得批准的除外。
“Any use of photographs, video or sound recordings, or reconnaissance, survey, or graphic or narrative depiction materials of military restricted zones shall be subject to the approval of the military organs at or above the military area command level.” “使用军事禁区的摄影、摄像、录音、勘察、测量、描绘和记述资料,应当经军区级以上军事机关批准。”
XI. One article is added as Article 16: “It shall be prohibited, in water military restricted zones, to construct or set up non-military installations or to engage in aquaculture, fishing, and other activities that impede the operations of military vessels or jeopardize the security and confidentiality and the effective utilization of military installations.”   十一、增加一条,作为第十六条:“在水域军事禁区内,禁止建造、设置非军事设施,禁止从事水产养殖、捕捞以及其他妨碍军用舰船行动、危害军事设施安全保密和使用效能的活动。”
XII. Article 16 is renumbered as Article 17 and amended to read: “Where the protective measures taken in land military restricted zones are not sufficient to guarantee the security and confidentiality and the effective utilization of military installations, or the military installations in land military restricted zones have significant risk factors, the military area commands and the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government or the military area commands, the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government, and the relevant departments of the State Council may, while jointly demarcating land military restricted zones, jointly demarcate security control areas surrounding the restricted zones, and set up security warning markers at the perimeter of the security control areas. The sites for setting up the security warning markers shall be jointly determined by the unit in charge of a military restricted zone and the local people's government at or above the county level.”

   十二、将第十六条改为第十七条,修改为:“在陆地军事禁区内采取的防护措施不足以保证军事设施安全保密和使用效能,或者陆地军事禁区内的军事设施具有重大危险因素的,军区和省、自治区、直辖市人民政府或者军区和省、自治区、直辖市人民政府、国务院有关部门在共同划定陆地军事禁区范围的同时,可以在禁区外围共同划定安全控制范围,并在其外沿设置安全警戒标志。安全警戒标志的设置地点由军事禁区管理单位和当地县级以上地方人民政府共同确定。”
