国土资源部、国家发展和改革委员会、财政部、住房和城乡建设部、农业部、中国人民银行、国家林业局、中国银行业监督管理委员会关于扩大国有土地有偿使用范围的意见

The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Since the reform of the land use system, China has developed a relatively complete institutional system of paid use of state-owned construction land which has played a significant role in implementing the basic state policy of "cherishing and reasonably using land and effectively protecting cultivated land," ensuring the development of urbanization and industrialization, and promoting the establishment and improvement of the socialist market economy system. Over recent years, as China's economic development enters the phase of new normal, the ineffective coverage of the paid use of state-owned land, incomplete system and other problems become increasingly prominent, and the decisive role of the market in allocating resources is not fully played. For the purpose of further improving the system of paid use of state-owned land, the following opinions are hereby offered with the approval of the State Council under the Land Administration Law of the People's Republic of China and relevant laws and regulations. 自土地使用制度改革以来,我国已形成较为完善的国有建设用地有偿使用制度体系,对落实“十分珍惜、合理利用土地和切实保护耕地”基本国策,保障城镇化、工业化发展,促进社会主义市场经济体制的建立和完善,发挥了重大作用。近年来,随着我国经济发展进入新常态,国有土地有偿使用覆盖面不到位、制度不健全等问题逐渐凸显,市场配置资源决定性作用没有得到充分发挥。为进一步完善国有土地有偿使用制度,根据《中华人民共和国土地管理法》及相关法律规定,经国务院同意,提出以下意见。
I. General requirements   一、总体要求
(1) Guiding ideology. We shall comprehensively implement the spirit of the 18th National Congress of the Communist Party of China ("CPC") and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, extensively learn and carry out the spirit of a series of important speeches delivered by General Secretary Xi Jinping, closely center on and advance the overall layout for "economic, political, cultural, social, and ecological progress" in an overall manner and the Four-Pronged Comprehensive Strategy in a coordinated manner, firmly develop the concept of innovative, coordinated, green, open and shared development, follow the decisions and arrangements of the CPC Central Committee and the State Council, be based on the basic national conditions and development stages, adhere to and improve the ownership of state-owned land by all the people and the system of paid use of state-owned land, allow the market to play a decisive role in allocating resources, improve the role of the government, further deepen the reform of the state-owned land use and management system, expand the scope of paid use of state-owned land, promote the comprehensive conservation and intensive utilization of state-owned land resources, and better support and guarantee sustainable and sound social and economic development. (一)指导思想。全面贯彻党的十八大和十八届三中、四中、五中、六中全会精神,深入学习贯彻习近平总书记系列重要讲话精神,紧紧围绕统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,牢固树立创新、协调、绿色、开放、共享的发展理念,按照党中央、国务院决策部署,立足基本国情和发展阶段,坚持和完善国有土地全民所有制,坚持和完善国有土地有偿使用制度,使市场在资源配置中起决定性作用和更好发挥政府作用,进一步深化国有土地使用和管理制度改革,扩大国有土地有偿使用范围,促进国有土地资源全面节约集约利用,更好地支撑和保障经济社会持续健康发展。
(2) Basic principles. (二)基本原则。
The control of purposes of use shall be adhered to. The control of the purposes of use of state-owned agricultural land, construction land and unused land shall be strictly implemented, the development, utilization and protection of state-owned land shall conform to the principle of ecology first and be consistent with the overall planning on land utilization, urban and rural planning, planning on primary functional areas, and other relevant planning. 坚持用途管制。严格落实国有农用地、建设用地和未利用地用途管制,国有土地的开发、利用和保护应坚持生态优先的原则,必须符合土地利用总体规划、城乡规划和主体功能区规划等各相关规划。
Market allocation shall be adhered to. The rights and interests relating to property in state-owned land shall be implemented, and the property in state-owned land assets with the right to use as the core, types of rights and corresponding powers and functions shall be clarified. The scope of paid use of state-owned construction land shall be expanded, the paid use of state-owned agricultural land shall be advanced, and the management of the use of unused state-owned land shall be regulated. The mode of paid use of state-owned land and the fair, open and transparent rules for state-owned land markets shall be improved. 坚持市场配置。落实国有土地所有权权益,明晰使用权为核心的国有土地资产产权归属、权利类型及对应权能。扩大国有建设用地有偿使用范围,推进国有农用地有偿使用,规范国有未利用地使用管理。完善国有土地有偿使用方式,健全公平开放透明的国有土地市场规则。
Administration by the law shall be adhered to. The scope of paid use of state-owned land shall be expanded in accordance with the law, and payment must be made for the use of the state-owned land of which the paid use is specified by the law. The scope of allocated land shall be gradually narrowed in accordance with the requirements of the reform of the investment and financing system, state-owned enterprises and public institutions, agricultural reclamation and other relevant fields. Ecological land shall be strictly protected in accordance with the law. 坚持依法行政。依法扩大国有土地有偿使用范围,法律规定应当有偿使用的国有土地,必须有偿使用。根据投融资体制、国有企事业单位、农垦等相关领域改革要求,逐步缩小划拨用地范围。依法严格生态用地保护。
II. Expanding the scope of the paid use of state-owned construction land   二、扩大国有建设用地有偿使用范围
(1) Improving the policies for the land used for public service projects. In accordance with the requirement of the reform of the investment and financing system, in respect of projects of energy, environmental protection, low-income housing, elderly support, education, culture, sports, and facilities of water, gas and heating supply, among others, in addition to the supply of land by allocation, the supply of land by transfer and leasing shall be encouraged, and municipal and county governments shall be supported in providing land by making capital contribution or taking a stake with the right to use state-owned construction land at appraised value to jointly make investment in construction together with private capital. Municipal and county governments shall, based on the cost of the attainment of land, market supply and demand, industry policies and basic price of the land for other purposes, among others, set the basic land price for public service projects and assess in accordance with the law and reasonably determine the reserve price for transfer. In the transfer or leasing of land for public service projects, the principle of equity and reasonableness shall be followed, no unreasonable supply conditions shall be established, and where there is just one intended user of land, the land may be supplied by agreement. In the case that capital is contributed or a stake is taken with the right to use state-owned construction land at appraised value, the term of use shall be consistent with that of public-private partnership but shall not exceed the statutory maximum term of the transfer of the right to use corresponding land. The revision of the Catalog of Allocated Land shall be accelerated, and the scope of allocated land shall be narrowed.

 (一)完善公共服务项目用地政策。根据投融资体制改革要求,对可以使用划拨土地的能源、环境保护、保障性安居工程、养老、教育、文化、体育及供水、燃气供应、供热设施等项目,除可按划拨方式供应土地外,鼓励以出让、租赁方式供应土地,支持市、县政府以国有建设用地使用权作价出资或者入股的方式提供土地,与社会资本共同投资建设。市、县政府应依据当地土地取得成本、市场供需、产业政策和其他用途基准地价等,制定公共服务项目基准地价,依法评估并合理确定出让底价。公共服务项目用地出让、租赁应遵循公平合理原则,不得设置不合理的供应条件,只有一个用地意向者的,可以协议方式供应。国有建设用地使用权作价出资或者入股的使用年限,应与政府和社会资本合作期限相一致,但不得超过对应用途土地使用权出让法定最高年限。加快修订《划拨用地目录》,缩小划拨用地范围。
